16 Indian Country Top Priorities: Conservation Improving Conservation Program Access and Tribal Forestry Management Senate Bill Sec. 2503(c) Alternative Funding Arrangements to Support Tribal Access to Conservation Programs This provision requires the Secretary of Agriculture to work with tribal producers and provide alternative funding arrangements for two essential conservation programs: Environmental Quality Incentives Program (EQIP) and Conservation Stewardship Program (CSP). This change is important as it recognizes that tribal producers must have full access to EQIP and CSP programs while recognizing traditional tribal agriculture structures and systems.

17 Indian Country Top Priorities: Forestry Improving Conservation Program Access and Tribal Forestry Management House Bill Secs and 8402 Improving Tribal Forestry Stewardship and 638 Management Section 8401 makes important changes to the Tribal Forest Protection Act of 2004 (TFPA) to expedite and improve the USDA review/approval process of tribal stewardship contracts. Further, Section 8402 allows USDA and DOI to enter into 638 self-determination contracts to take over the management of federal forests under the TFPA. Both provisions support strong tribal management and self-determination in protecting the health and substantiality of our forestry systems. Combine House Bill Sec and Senate Bill Sec Tribal Parity in Good Neighbor Agreements Tribal parity on par with state governments in the Good Neighbor Agreements must be included in the final conference Farm Bill. This acknowledges tribal sovereignty and promotes cooperation between all forest owners and managers. Native Farm Bill Coalition

18 Indian Country Top Priorities: Nutrition Title Furthering Tribal Nutrition Programs and Access to Traditional Foods Senate Bill Sec. 4102(b) Tribal Self-Determination for Food Procurement in FDPIR The establishment of demonstration projects for 638 self-determination contracts to procure foods for Food Distribution Program on Indian Reservations (FDPIR) packages is an important step forward for tribal self-governance at USDA. This allows tribal organizations to provide cost-effective and appropriate foods for tribal citizens who use the FDPIR, while promoting efficient access to healthy, traditional, and Native-produced foods.

19 Indian Country Top Priorities: Nutrition Title Furthering Tribal Nutrition Programs and Access to Traditional Foods Combine House Bill Sec and Senate Bill Sec. 4102(a) FDPIR Carry-Over Funding and Matching Requirements The final conference Farm Bill should include both these House and Senate provisions which support the 276 tribes utilizing the FDPIR program and the over 100 tribal organizations running it. Both provisions allow for two-year carry-over funding for longterm planning and ensure the continuation of the FDPIR in uncertain budgetary climates. Further, the Senate language sets the FDPIR tribal match requirement at 20 percent, allows for a waiver and full USDA funding if the match causes a substantial hardship, and allows tribes to leverage other federal funding sources to reach the match requirement.

20 Indian Country Top Priorities: Rural Development Title Building Rural Tribal Infrastructure and Economic Development Senate Bill Sec Establishment of Technical Assistance Program Establishing a permanent office providing technical service and assistance across all RD funding authorities, via a cooperative agreement with USDA, would help with two major issues of access to RD programs in Indian Country: the complexities of lending and infrastructure establishment in Indian Country and the trust responsibility of the federal government to tribes to support the need to establish technical assistance interventions. Senate Bill Secs. 6201, 6205, 6209, et al. Supporting Refinancing for RD SUTA Loans The current Substantially Underserved Trust Areas (SUTA) designation for several of the Rural Development programs helps provide tribes with priority to obtain important water, electric, and broadband infrastructure loans. These new provisions allow USDA to refinance these often decades-long loans to adjust to economic and governmental realities while continuing repayment. Native Farm Bill Coalition

22 Indian Country Top Priorities: Rural Development Title Building Rural Tribal Infrastructure and Economic Development Senate Bill Sec Tribal College and University Essential Community Facilities Both the Senate and House bills reauthorize this program, though its funding was cut in half in the House Bill Section The final conference Farm Bill must have the Senate version of the reauthorization to maintain the funding for this vital program that supports our Tribal Colleges and Universities and helps build tribal communities. Combine House Bill Sec and Senate Bill Sec Water Systems for Rural and Native Villages in Alaska Both of these sections reauthorize this essential water system infrastructure program for Alaska Native Villages, and the Senate provision that includes eligibility for tribal consortia (with a 2 percent set-aside for the consortia) and Alaska Native villages must be maintained in the final Farm Bill.

23 Indian Country Top Priorities: Rural Development Title Building Rural Tribal Infrastructure and Economic Development Senate Bill Secs. 6206, 6207, and 6305 Supporting Tribal Broadband Broadband connectivity in tribal communities, especially in rural areas and in Alaska, are among the lowest rates in the United States. These provisions in the Senate Rural Development Title should be included in the final Farm Bill to provide specific tribal priority, inclusion, and access to broadband programs to connect and build infrastructure and development opportunities in Indian Country.

24 Indian Country Top Priorities: Research Title Education and Research for the Next 7 Generations in Tribal Agriculture Senate Bill Secs.7414 and 7419 Parity in Access for Tribal Colleges and Universities One of the biggest changes in the 2018 Farm Bill must be to provide parity in access to education and research funding for Tribal Colleges and Universities (TCUs). Section 7414 makes 1994 Land Grant TCUs eligible for McIntire-Stennis Cooperative Forestry Act funds to educate the next generations of tribal foresters. Additionally, Section 7419 provides access to TCUs to both the Children, Youth and Families at Risk (CYFAR) Program and the Federally Recognized Tribes Extension Program (FRTEP), improving the outreach of these programs in Indian Country.

25 Indian Country Top Priorities: Research Title Education and Research for the Next 7 Generations in Tribal Agriculture Combine House Bill Sec (b) and Senate Bill Sec Wokini/New Beginning The final conference Farm Bill must contain the Wokini/New Beginning Initiative to provide mandatory funding for scholarships for Native students to attend 1862 Land Grant Institutions and include 1994 TCUs as eligible for the program as well.

26 Indian Country Top Priorities: Miscellaneous Title Opportunities, Outreach, and Upholding the Government-to- Government Relationship Senate Bill Sec Tribal Advisory Committee This provision establishes a new Tribal Advisory Committee through the Office of Tribal Relations to provide advice to the Secretary on tribal related issues and policies throughout USDA and must remain in the final Farm Bill.

27 Indian Country Top Priorities: Miscellaneous Title Opportunities, Outreach, and Upholding the Government-to- Government Relationship DO NOT Include House Bill Secs (a) and Maintain the Office of Tribal Relations in the Office of Secretary Tribal governments, as sovereign nations, have a direct government-to-government relationship with the federal government which serves as the basis for the federal trust responsibility. The 2014 Farm Bill codified the Office of Tribal Relations (OTR) as a separate, direct reporting office within the Secretary s office to acknowledge its role as a trustee to tribal nations. Further, when USDA announced its reorganization of the OTR and held both a consultation and public comment period, tribes, tribal leaders, and tribal organizations across Indian Country spoke out against this move. OTR s statutory authority must remain as a separate office within the Secretary s Office to acknowledge the federal trust responsibility and government-to-government relationship.

28 Indian Country Top Priorities: Miscellaneous Title Opportunities, Outreach, and Upholding the Government-to- Government Relationship Senate Bill Sec The Combined Farming Opportunities Training and Outreach This provision combines the Beginning Farmers and Ranchers Development Program and Outreach and Assistance for Socially Disadvantaged Farmers and Ranchers and Veteran Farmers and Ranchers Program, and it creates permanent, mandatory baseline funding for these programs. Additionally, the provision specifies tribal government and tribal producer eligibility for grants under the programs and includes tribal information in the reporting on the program.

29 Indian Country Top Priorities: Miscellaneous Title Opportunities, Outreach, and Upholding the Government-to- Government Relationship Senate Bill Sec Legalizing Hemp Production with Tribal and State Regulatory Plans Section makes hemp farming legal and allows tribes and states to develop plans regarding hemp production. The opening up of this sector will provide many tribes and tribal producers the opportunity not only to enter into hemp production but allow for its tribal regulation, which is a strong recognition of tribal sovereignty and self-governance.

32 House Farm Bill Tribal Provisions: Title IV Nutrition Sec Food Distribution Program on Indian Reservations Adds regionally-grown to the traditional foods provision purchase provision for FDPIR. Requires the Secretary to purchase traditional foods that can be producer cost-effectively. Allows 2-year carryover funding for FDPIR. Sec Service of Traditional Foods in Public Facilities Adds state, county, and local education programs as eligible for the donation of traditional foods provision into public and nonprofit facilities.

33 House Farm Bill Tribal Provisions: Title V Credit Sec GAO Report on Availability of the Farm Credit System to Meet the Agriculture Credit Needs of Indian Tribes and their Members Requires the GAO to study the availability of agriculture credit to tribes and tribal producers within the Farm Credit System.

34 House Farm Bill Tribal Provisions: Title VI Rural Development Sec Strengthening Regional Economic Development Incentives Adds an emphasis on inclusion and coordination with tribes as strategic partners in the development of Strategic Community Plans. Sec Tribal College and University Essential Community Facilities Cuts funding for the program from $10 million to $5 million. Sec Water Systems for Rural and Native Villages in Alaska Reauthorized at current funding level.

35 House Farm Bill Tribal Provisions: Title VII Research and Ed. Sec Education grants to Alaska Native serving institutions and Native Hawaiian serving institutions Both reauthorized at current levels. Sec Equity in Educational Land-Grant Status Act of 1994 Adds Nueta Hidatsa Sahnish College and Red Lake Nation College to the 1994 Tribal Land Grant Institutions list. Reauthorizes endowment, capacity funds, and research grants for tribal colleges. Sec Beginning Farmer and Rancher Development Program Maintains level funding for this program at $20 million through 2023 and authorizes a waiver or reduction of the 25% match as necessary to effectively reach an underserved area or population.

36 House Farm Bill Tribal Provisions: Title VIII Forestry Sec Good Neighbor Agreements Adds tribes as eligible for Good Neighbor agreements. Sec Protection of Tribal Forest Assets Through the Use of Stewardship End Result Contracting and other Authorities Expedites the Secretary s review and initial response of tribal request under the Tribal Forest Protection Act of 2004 (TFPA) to 120 days. Requires that any notice of denial be provided within 1 year of submission. Within 2 years the Secretary must complete all environmental reviews and enter into agreement with a tribe. Requires the Secretary to take action on requests from tribes under the TFPA.

37 House Farm Bill Tribal Provisions: Title VIII Forestry Cont. Sec Tribal Forest Management Demonstration Project Permits the Secretaries of Interior and Agriculture to enter into 638 self-determination demonstration project agreements with Tribes to take over the management and functions of the federal government under the Tribal Forest Protection Act. Sec Healthy Forests Restoration Act of 2003 Amendments Allows for using any combination of a 30-year contract, a 10-year cost-share agreement, or permanent easement to enroll tribal acreage into the plan.

38 House Farm Bill Tribal Provisions: Title IX Horticulture Sec Recognition of Role of State Lead Agencies Allows tribes to regulate the use of pesticides under the Federal Insecticide, Fungicide, and Rodenticide Act.

39 House Farm Bill Tribal Provisions: Title XI Miscellaneous Sec Outreach and Assistance for Socially Disadvantaged Farmers and Ranchers and Veteran Farmers and Ranchers Establishes priority designation for projects providing agricultural education, employment, and training for socially disadvantaged and underserved youth under 18 years old. Sec Office of Partnerships and Public Engagement Changes the name of the Office of Advocacy and Outreach to the Office of Partnerships and Public Engagement and adds outreach to tribal farmers and ranchers as part of the mission area. Provision not representative of Native Farm Bill Coalition priorities. Sec (a) Office of Tribal Relations Amends the 2014 Farm Bill which established the Office of Tribal Relations as a separate office within the Office of the Secretary and moves it under the new Office of Partnerships and Public Engagement. 40 House Farm Bill Tribal Provisions: Title XI Miscellaneous Cont. Sec (b) New Beginnings Initiative Creates a new Native American student scholarship fund for tribal students attending land-grant universities and colleges.

42 Senate Farm Bill Tribal Provisions: Title I Commodities Sec Supplemental Agricultural Disaster Assistance Adds tribes and tribal organization to definition of an eligible producer for the program. Sec.1501 (a) amends section 1501(a)(1)(B) of the Agricultural Act of 2014 to add an Indian tribe or tribal organization (as those terms are defined in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304) as an eligible producer. Sec.1501 (c) amends section 1501(e) of the Agricultural Act of 2014 to require a reimbursement of 75 percent of the losses for beginning farmers, ranchers, and veterans under the Tree Assistance Program. 43 Senate Farm Bill Tribal Provisions: Title II Conservation Sec Regional Conservation Partnership Program Includes tribes as eligible producers for the Regional Conservation Partnership Program. Sec (a) Funding Increases funding to $50 million, including $5 million cap for outreach and technical assistance, for the transfer of retiring agriculture land to new and beginning or socially disadvantaged producers in the Conservation Stewardship Program - Transition Incentives Program. Sec (d) Assistance to Certain Farmers or Ranchers for Conservation Access Set-asides for both beginning and socially disadvantaged farmers or ranchers are increased from 5 percent to 15 percent in the Environmental Quality Incentives Program and the Conservation Stewardship Program.

44 Senate Farm Bill Tribal Provisions: Title II Conservation Cont. Sec. 2503(c) Administrative requirements for conservation programs Requires USDA to enter into alternative funding arrangements for conservations programs under the Conservation Stewardship Program and Environmental Quality Incentives Program. Requires the Secretary to provide incentives to certain farmers, ranchers, acequias, and Indian Tribes. Certain reporting requirements will not apply to commodity program participants in the Farm Service Agency. The Secretary is directed to encourage source water protection practices in the conservation stewardship program and environmental quality incentives program. Provides administrative requirements for payments to acequias.

45 Senate Farm Bill Tribal Provisions: Title III Trade Sec Foreign Trade Missions Provides for greater inclusion and participation on Native farmers, ranchers, and producers on international trade missions. Requires a report to Congress within 2 years regarding the efforts of the agencies to increase tribal inclusion on international trade missions.

46 Senate Farm Bill Tribal Provisions: Title IV Nutrition Sec. 4102(a) Food Distribution Program on Indian Reservations Requires USDA to pay 80 percent of administrative costs FDPIR, with a 20 percent tribal match. Adds waiver of match requirement if it causes a substantial burden on a tribe. Tribes can use other federal funding sources to meet matching requirement. Does not allow the Secretary to limit the administrative costs for tribes that receive a waiver. Allows FDPIR administrative funds to remain available for two fiscal years. Sec. 4102(b) Food Distribution Program on Indian Reservations Demonstration Project for Tribal Organization Authorizes demonstration projects for tribal organizations to enter into 638 self-determination contracts to procure foods for FDPIR packages. Sec The Gus Schumacher Food Insecurity Nutrition Incentives Tribal agencies can use other federal resources and funds (i.e. IHS funding) to meet the Food Insecurity Nutrition Incentive program matching requirement.
