10 DATE: November 4, 2008 TO: FROM: All Natural Resource Developers and Applicable Regulatory Agencies Stoney Tribal Council (STC) RE: Stoney Information Letter Revision 3 December 8, 2008 WHEREAS, the Stoney Nakoda Nations (SNN) consisting of the Bearspaw Nation, Chiniki Nation and Wesley Nation are signatories to Treaty 7 (1877) and WHEREAS the SNN have constitutionally recognized Treaty and Aboriginal rights, titles and interests to certain Reserve Lands at Morley, Alberta (I.R. #142, 143, 144), Eden Valley (I.R. #216), Rabbit Lake (I.R. #142B), and Bighorn (I.R. 144A), and to their Traditional Lands which encompass a broader area than the Reserve Lands as identified by the SNN and attached as Appendix A; hereto; and WHEREAS such rights, titles and interest are protected by Section 35 of The Constitution Act, 1982, and as such require that the SNN be consulted and their protected rights, titles and interest(s) recognized and accommodated in the undertaking of any development activity on or potentially impacting the SNN Reserve Lands and Traditional Lands; and WHEREAS the SNN have filed claims in the courts of Saskatchewan, Alberta and British Columbia, action numbers Q.B of 2003, Action No and Action No. S respectively, to protect such rights, titles and interests; and WHEREAS the SNN is a self governing body under the authority of Treaty 7 and the Indian Act, R.S.C. 1985, c. I-5, and provides leadership and direction in respect of all natural resource development applications through the duly elected Chiefs and Councils of the member Nations, collectively known as the Stoney Tribal Council at duly convened meetings; and WHEREAS the Stoney Tribal Council has mandated the Stoney Natural Resource Committee (SNRC) and the Stoney Consultation Team (SCT) with the delegated responsibilities to actively engage and gather initial information on natural resource development applications that have direct or indirect impacts upon the SNN Indian Reserves and Traditional Lands: THEREFORE, all proponents of development activities that may directly or indirectly affect activities within the SNN Reserve Lands and Traditional Lands are advised as follows: The Stoney Nation Managing Consultation Coordinator of the SNRC and SCT shall receive all development proposals on behalf of SNN including complete project description, duration of project, and proposed submission date at least 90 days in advance of the proponent submitting such proposal to Canada, Alberta or the applicable regulatory authority as the case may be, for the purpose of consultation and accommodation of the rights and interest(s) of SNN; Stoney Consultation Information Letter Rev. 4 January 2012

Early Notification 2. Initial Project Meeting proponent proposal, project description, location, schedule, key contacts, maps, surveys, etc. 3. Environmental/Cultural Identification of Concerns, Assessment, Evaluation, Monitoring 4. Education, Communication Issues 5. Stoney Cultural Awareness, Safety and Community Orientation 6. Employment, Training Opportunities 7. Detailed Scheduling Quality Control 8. Community and First Nation Project Updates 9. Other The SNRC and SCT shall report and advise the Stoney Tribal Council on progress of consultation with all development proponents and regulatory agencies in order to receive comment and direction; The SNRC and SCT shall communicate and engage with development proponents and government on an as required basis in order to ensure that adequate consultation and accommodation of the rights and interests of the SNN is conducted; Consultation and accommodation must be held to the satisfaction of the Stoney Nakoda People that meets the minimum legal requirements of precedent law in accordance with our constitutionally recognized treaty and aboriginal rights. This interim information letter on consultation and accommodation will be subject to regular review and approval by the STC. The STC will provide all amendments and updates to all development proponents and regulatory agencies through postings on the Stoney Nation website at A detailed Consultation Guide and Handbook is in preparation and will be available in early Stoney Consultation Information Letter Rev. 4 January 2012
