1 Ripon City Council Special Meeting Minutes December 21, 2016 The Special City Council meeting was called to order by Mayor Uecker at 5:30 p.m. ROLL CALL: Council Members Daniel de Graaf, Jake Parks, Leo Zuber, Vice Mayor Michael Restuccia, Mayor Dean Uecker. OTHERS PRESENT: City Administrator Kevin Werner, City Attorney Tom Terpstra, Planning Director Ken Zuidervaart, Recreation Director Kye Stevens, Director of Public Works Ted Johnston, Police Chief Ed Ormonde, City Clerk Lisa Roos, Deputy City Clerk Tricia Raymond, Information Systems Technician Dan Brannon, Armond Ross, Stephen Meece, Tony Mistlin, Chad DeGraff. PUBLIC DISCUSSION: No one from the public wished to speak at this time. IN THE MATTER OF: 1. DISCUSSION ITEMS NOTES: A. SITE ACCESS AGREEMENT Tony Mistlin Donation Indoor Soccer Facility Approve and authorize the Mayor to sign the Site Access Agreement for an indoor soccer facility to be located at Mistlin Sports Park. City Administrator Werner said Mr. Mistlin has donated a number of items towards the Mistlin Sports Park, which includes land, a water feature, softball fields, a concession stand, dining area inside the tower, and miscellaneous features throughout the park. Mr. Mistlin is interested in making another donation to the sports park an indoor soccer facility. Mr. Mistlin has come to an agreement with DeGraff Development to design and construct a 20,000 square foot indoor soccer facility. The facility will include one indoor synthetic turf soccer field, bleachers, HVAC, restrooms, landscaping and ADA access. Werner said the facility is proposed to be located west of the park s western access road, across from the existing parking lot. This parcel has not yet been annexed into the City and is currently located within San Joaquin County. In order to move forward with this project prior to an annexation, the City will need to enter into an Out-of-Service Area Agreement with the Local Agency Formation Commission (LAFCO) and San Joaquin County. Werner said the project will not require any financial commitment from the City towards the construction of the facility, but the City would be responsible for administering some site reviews and processing the Out-of-Service Area Agreement. One known expense will be the applicable Habitat Mitigation Fee. It is estimated to be $8, $10, Council Member Zuber asked if staff has compiled numbers on operational cost.

2 Werner said there has been conversation on how the facility will be run, whether it s by City staff or leased to a group that will run the facility. There will be maintenance cost of utilities, cleaning, and regular maintenance. The biggest maintenance fee will be the synthetic turf. Werner said staff will create a fee structure and an account will be set up for the maintenance of the facility. Ongoing reports will be provided to Council if this project is approved. MOTION: MOVED/SECONDED (PARKS,DE GRAAF) AND CARRIED BY A 5-0 VOTE TO APPROVE AND AUTHORIZE THE MAYOR TO SIGN THE SITE ACCESS AGREEMENT FOR AN INDOOR SOCCER FACILITY TO BE LOCATED AT MISTLIN SPORTS PARK. Zuber said as this project moves forward, an operational cost and budget and operating plan should be created and brought forward for Council review. B. CONGESTION MITIGATION AND AIR QUALITY (CMAQ) GRANT PROJECT CONSIDERATION Authorize staff to complete the CMAQ program application for the Stockton Avenue sidewalk project. Engineering Supervisor Pease said the San Joaquin Council of Governments (SJCOG) is soliciting projects for the Congestion Mitigation and Air Quality (CMAQ) Program. The CMAQ program was implemented to support surface transportation projects that provide air quality improvements and congestion relief. There is approximately $23.5 million of grant funding available for eligible projects in San Joaquin County. Ripon has received funding through the CMAQ program for the Jack Tone Park and Ride Lot Project in 2014 and a portion of a new Compressed Natural Gas Refuse Truck Purchase to be delivered in Pease said the Engineering Department staff has evaluated two potential projects which have eligible components under the CMAQ program. The first project is the installation of a sidewalk on Stockton Avenue between Second Street and Doak Boulevard. The second project includes the installation of a traffic signal at the intersection of Colony Road and Hoff Drive. Pease said this is a competitive grant process where each project is scored based on the air quality benefit and how cost effective the project will be once complete. Pease said staff is proposing to submit an application for the Stockton Avenue Sidewalk Project for the 2016 call for projects. Grant applications are due to SJCOG on January 13, 2017 and the SJCOG Board is expected to approve projects to receive CMAQ funding on February 23, Council Member Zuber asked if there was a better chance of getting the grant funds for the traffic signal project rather than the sidewalk project. City Administrator Werner said the San Joaquin Council of Governments is changing how they score sidewalk projects. But the details have not been released yet. Vice Mayor Restuccia asked how the projects were graded who sits on the scoring committee. Pease said the committee is made up of city and county representatives.

3 Restuccia and Council Member Parks said they both agree with Zuber that the traffic signal project should be first priority. MOTION: MOVED/SECONDED (ZUBER,RESTUCCIA) AND CARRIED BY A 5-0 VOTE TO SUBMIT APPLICATIONS FOR THE STOCKTON AVENUE SIDEWALK PROJECT AND THE TRAFFIC SIGNAL PROJECT TO SJCOG FOR CMAQ FUNDING. IF TIME OR RESOURCES ARE LIMITED PRIORITY SHOULD BE GIVEN TO THE TRAFFIC SIGNAL PROJECT. C. DONATION Unmanned Aircraft System Program Accept the donation from Diamond Pet Foods for the purchase of an Unmanned Aircraft System to be operated by the Police Department. (Donation: $10,000.00) Police Chief Ormonde said the Ripon Police Department has an opportunity to receive donated funds from a local business to purchase, train, and operate an Unmanned Aircraft System (UAS) program. Ormonde is recommending the City Council accept the donation being provided by Diamond Pet Food Company to secure equipment to operate an Unmanned Aircraft System Program. Council Member Zuber asked why the Police Department would want an Unmanned Aircraft System Program and what it would be used for. Ormonde said the application will be beneficial to the Police Department, Fire District, and citizens. It will assist in missing person cases, set up perimeters when serving warrants, and assist with search and rescue by traveling in areas hard to reach on foot. Ormonde said he is aware of the concern with privacy. The UAS will only be used under special circumstances and not for daily use. Vice Mayor Restuccia asked if the donation would cover the capital expenditures and maintenance of the Unmanned Aircraft System. Ormonde said the donation covers all operational expenditures with an excess of $ and approximately $ a year will be built into the budget for maintenance. Zuber asked if the UAS has to abide by the current city drone ordinance. Ormonde said the UAS would be exempt from the current ordinance because it will be used for emergency situations. Zuber asked when and how the use of the UAS will be monitored. Ormonde said the UAS will be used in emergency situations and has to be approved by a supervisor in order to take flight. Flight logs will be documented along with digital flight pattern tracking. MOTION: MOVED/SECONDED (ZUBER,RESTUCCIA) AND CARRIED BY A 5-0 VOTE TO ACCEPT THE DONATION FROM DIAMOND PET FOODS FOR THE PURCHASE OF AN UNMANNED AIRCRAFT SYSTEM TO BE OPERATED BY THE POLICE DEPARTMENT.

ELECTRIC MOTORCYCLE SURPLUS REQUEST Approve designating two City of Ripon 2013 Zero DS motorcycles as surplus and authorize the exchange of the two Zero DS motorcycles to the Tracy Police Department for two 2014 Harley Davidson Electra Glide motorcycles. The exchange would be at no cost to either department. Police Chief Ormonde said the Ripon Police Department is requesting the Ripon City Council consider a surplus declaration for two 2013 Zero DS motorcycles in an effort to obtain two 2014 Harley Davidson Electra Glide motorcycles from the Tracy Police Department. Once surplus, the electric motorcycles would be exchanged at no cost to either department. Ormonde said the units will serve to supplement our existing electric units, which have limited range due to battery size. The department also utilizes motorcycles for many police events to include training, funerals, escorts, parades, and other civic events. Vice Mayor Restuccia asked if there will be a change in the operating budget and capital costs moving forward with the new motorcycles. Ormonde said the capital costs are the same and operating budget will account for the battery maintenance. MOTION: MOVED/SECONDED (RESTUCCIA,PARKS) AND CARRIED BY A 5-0 VOTE TO APPROVE DESIGNATING TWO CITY OF RIPON 2013 ZERO DS MOTORCYCLES AS SURPLUS AND AUTHORIZE THE EXCHANGE OF THE TWO ZERO DS MOTORCYCLES TO THE TRACY POLICE DEPARTMENT FOR TWO 2014 HARLEY DAVIDSON ELECTRA GLIDE MOTORCYCLES.
