2 Third Party Fundraising Guidelines Third party fundraising activities by groups, individuals and organisations and vital to the ongoing viability and success of the Pancare Foundation. Funds raised will be used by Pancare across our three main areas of work: 1. Patient Support: Providing holistic & individualised support to those affected by pancreatic, liver, biliary, oesophageal and stomach cancers; from the point of diagnosis through to recovery and bereavement. 2. Innovative, World-Leading, Research: Overseeing Australia s biggest research facility solely dedicated to pancreatic, liver, biliary, oesophageal and stomach cancers. 3. Advocacy, Collaboration & Development: Working with corporate Australia; Federal/State & Local Governments as well key community leaders & organisations to advocate action and put a lasting spotlight on pancreatic, liver, biliary, oesophageal and stomach cancers. Fundraising Regulations While we support and appreciate the efforts of third parties to raise funds on our behalf, Pancare does not have the resources to manage or monitor each fundraising activity and ensure it complies with the various Fundraising Acts to which we must adhere. If you wish to hold a fundraiser or fundraising event with the intention on giving proceeds to the Pancare Foundation, then it is essential you obtain the correct licenses to do so. As we cannot advise on your specific fundraising registration/licensing requirements, we recommend you take the time to read the information provided by the relevant government bodies, details of which can be found at: ACT: NSW: NT: no current website QLD: SA:

3 TAS: VIC: WA: If you need assistance applying for a permit, you can contact the Pancare Foundation at info@pancare.org.au Event Management Any event organised by a third party (individual, group or organisation), external to Pancare is not an official Pancare event. The Pancare Foundation bears no responsibility for the management or conduct of a fundraiser or fundraising event organised by a third party. For the avoidance of doubt, it is the responsibility of the third parties to ensure they are compliant with the relevant legislative requirements, including obtaining the appropriate permits / licenses if necessary. Insurance Third party fundraising events are not covered by the Pancare Foundation s insurance policy for public indemnity. Legal requirements for any event held by a third party such as insurance is the responsibility of the third party organiser. Check with your venue before you obtain your own insurance, many establishments have coverage for third party events. Branding & Imagery You can state that the proceeds from the event are going to the Pancare Foundation but we cannot authorise third parties to use our logo or imagery on their collateral including merchandise.

4 Media & Communications Any communications produced by third party fundraisers must specify: The intent / purpose of the fundraiser. What percentage or amount of funds will go to Pancare. The activity is a third party fundraiser and clause stating it is not run by Pancare (see below). [Name of person/group/organisation] supports the work of the Pancare Foundation by raising funds for research and patient care. The Pancare Foundation appreciates the support of [person/group/organisation] but is not involved in any of its fundraising activities. Receipting Pancare does not provide receipt books for third party events however can provide individual receipts by or post after the fundraising activity has taken place. Third parties need to provide Pancare with a list of names, addresses (post and ) and donation amounts post event so Pancare can send receipts directly to the individual donors once the funds and donor information has been received. Monies raised must be remitted to Pancare within 28 days of the event taking place and include a financial summary. Because not all donations are tax deductible, please refer to the Frequently Asked Questions section (below). FAQ s Do I have to register with the government as a fundraiser? You do not have to register with Pancare to undertake a fundraising event, however, you may be required to register with Consumer Affairs, or the relevant state body, to proceed. Some organisations are exempt from the need to register by either the Fundraising Act itself or by Ministerial order. In some states, you must be a charity to be granted a fundraising authority. Exempt organisations in some states include:

5 A state school, council or registered school. Universities, TAFE colleges and other tertiary educational institutions. Hospitals and other registered funded agency under the Health Services Act Religious bodies with authority to conduct marriages, registered political parties, registered trade unions and registered workplace relations or industrial relations organisations. Kindergartens and other licensed children s services that receive funding for a pre-school program. To find out if you have to register as a fundraiser, we recommend you visit the relevant websites below ACT: NSW: NT: no current website QLD: SA: TAS: VIC: WA: Are people going to be able to receive a tax-deductible receipt? Yes, if you provide a list of the contributors name, address ( and post) and donation amount, the Pancare Foundation can individual tax receipts. All donations of $2 and above are generally tax deductible. Please note that, where you are conducting an auction as part of your fundraising event, we are unable to provide tax deductible receipts in relation to both the donation of and purchase of charity auction items. If I can t use your logo how can I prove to people that this is a legitimate fundraising activity and the money is going to the Pancare Foundation? If you register your event with Pancare, and with the relevant government bodies, we can provide a letter stating this event has been registered with us, but is not the responsibility of the Pancare Foundation.
