4 THE PLAN ROOM POST From Plan Room Manager, John Grandetti What s New? The newest feature for our upgrade members is the long awaited update to our viewer. We are currently Beta testing the new viewer, and I am very impressed with the better mobility and features available through the viewer. You will still be able to use the lite and pro viewer for now, but I encourage you to try out the new viewer. As it is in the programming phase still, if there are things you hate or want to see changed, let us know by ing the address provided in the information box. We want you to dissect this new viewer so we can put the best product out there to use. In the planroom itself, we continue a slower and steady pace of new projects and new members. As hard as it is to believe, we are looking ahead to what the holiday season will bring here at BX Dayton. Construction Confluence The Builders Exchange of Dayton is holding its second annual Construction Industry Confluence on November 14 th at Cox Arboretum. From attending the event last year, I personally recommend our members to attend. The Confluence is a very relaxing evening to meet up with old friends and potentially make some new contacts, along with food and drink. You should have received information and details regarding this event in the mail, and if you did not, please contact the office. Holiday Schedule We will be closed on the following days. November 27 th -28 th for Thanksgiving. On December 24 th, we close at noon and offices will be closed on the 25 th and 26 th. We will be open until noon on December 31 st and closed January 1 st and 2 nd, The schedule is also posted on Renewal With the end of the year approaching, we will be sending out renewal invoices for 2009 membership sometime in December. For our current membership, if you are interested in trying out the online service or seeing the upgrade if you are one of our news only members, we can let you try it out for a month or so like we do for our non-member prospects. If you decide that you are interested in upgrading your membership, we will simply add it to you invoice. If not, you will get the invoice that you would normally receive for renewal. 12 ASA President s Monthly Newsletter-October 2008 Dear ASA Member: The turmoil in financial markets over the past several weeks is causing stress for everyone. The uncertainties driving banks to fail or merge, and stock markets to plummet one day and rally the next, concern us all. Everyone hopes that the many ASA members throughout the country that have been busy and doing well will continue to thrive. Whatever actions are taken by our federal government, let s hope that they will help alleviate concerns about diminished credit and our financial futures. No one wants to see a repeat of the early 1990s, when many firms in our industry went bankrupt for lack of profitable projects, because of slower payment practices, and/or because of the inability to obtain needed credit. One of the lessons we can take away from the current financial crisis is that packaging can mask the value or lack of value of an underlying product. Buyers and sellers of mortgage-backed securities assumed that these securities would provide a good return because they looked like other successful investments. They didn t see the wolf in sheep s clothing. The wolf was in the details of the mortgage financing paperwork. With a sufficiently large number of these mortgages defaulting, it appears we ll all pay the price through our tax bills, our home equity, our investments, and our retirements. Investment banks and investors that mistook something that looked almost as good for the real thing now see that all mortgage-backed securities are not the same! If there s one good thing that comes from this crisis, it ll be a renewed focus on real return-oninvestment. Certainly, everyone will look more closely at the real value of their personal and business investments. And, while the economy may add pressure for subcontractors to bid aggressively, we must take the time to remind our clients that two different bids, even at the same number, are not interchangeable. Remind your clients of the real return-on-investment they ll get with your company. Differentiate yourself and show your company s true value. All contractors are not alike. The current financial crisis is a lesson that not everything that walks like a duck, is a duck. Today, on this 100th anniversary of the rollout of the Model T (on Oct. 1, 1908), the point couldn t be, well, more poignant. A construction project isn t like a Model T, and the typical construction firm doesn t operate like an assembly line. The low-bid mentality fails to recognize that real project success defined as safety, quality, efficiency, price and timeliness of construction depends on healthy and effective working relationships, including contracts and values that both sides can live with. 27 LAMCA SUPPORTS ALLEN COUNTY VISIONARIES The Lima Area Mechanical Contractors Association (LAMCA) supported the Allen County Visionaries at the Visionaries Annual Dinner Meeting held October 2 nd at Shawnee Country Club in Lima. The Visionaries were established so that Allen County could take an aggressive approach to economic development. The Visionaries work to bring all of the pieces together to attract business to Allen County and coordinate all of the resources in Allen County to assist that business when they have made the decision to either locate or expand in Allen County. 29 How To Cover Those Who Work Outside Ohio New Interstate Jurisdiction Law Benefits Ohio Employers Ohio employers who have employees working outside Ohio can reduce the payroll they report to BWC thanks to a new state law. Effective with the payroll reporting period beginning Jan. 1, 2009, employers do not have to include their employees who work outside Ohio on their payroll report if they have workers compensation coverage in the state they work. Those employers will pay premium to BWC based on payroll for labor and services performed only in Ohio. Employers can take advantage of this change when they file their payroll report and pay their premiums for the Jan. 1 to June 30, 2009, payroll period. To do this, they must send their decision electing to segregate payroll to BWC along with proof of other states insurance. Other provisions of the law: Employers based in another state who have employees temporarily working in Ohio must obtain workers compensation coverage from BWC unless their state affords Ohio employers some degree of reciprocity. What does this mean? Example: Under current Ohio law, out-of-state employers can send employees to work in Ohio for up to 90 days without obtaining workers compensation coverage in Ohio. Their state s coverage applies. Under the new law, we offer out-of-state employers what their state offers us. In West Virginia, an Ohio employer can only work in that state for 30 days before the company needs workers compensation coverage in West Virginia. Therefore, a West Virginia employer can only work in Ohio for 30 days before needing workers compensation coverage in Ohio. Also, BWC can hold out-of-state employers who do not obtain the required Ohio coverage liable for all costs associated with an Ohio workers compensation claim for which they lacked coverage. Finally, injured workers may only file a claim in one jurisdiction. Once they file a claim with one state, they waive their right to file in Ohio regardless of why the claim was denied. 38 LEGALLY SPEAKING by Bob Dunlevey NEW MENTAL HEALTH INSURANCE LAW HIDDEN IN BAILOUT Strange things happen in Washington! Just recently, the Senate turned a mental health parity bill into the massive financial bailout bill and a few days later it became law. The Mental Health Parity and Addiction Equity Act of 2008 (HR 6983) actually had affixed to it this Economic Stabilization Act of 2008 (HR 1424). While most businesses were paying attention to the financial aspects of the bailout bill, several pork barrel type proposals were added. In addition, mental health insurance provisions were included. The new health parity law requires group health insurance plans for employers with more than 50 employees to have the deductibles, co-payments, co-insurance, and out-of-pocket expenses applied to mental health and addiction benefits in the same fashion as other medical benefits. Said another way, the employee s financial requirements for mental health and addiction coverage can be no more restrictive or costly than the financial requirements applied to comparable medical and surgical benefits under the applicable medical plan. In addition, the group health plans must now ensure that the treatment limitations, such as frequency of treatment, number of visits, and the days of coverage, apply equally to mental health and addiction benefits and are no more restrictive than the treatment limitations applied to comparable medical and surgical benefits under the plan. If the existing plan offers out of network benefits, it must offer out of network benefits on the same terms for mental health services. This bill merely establishes a federal floor and permits states to go further to protect constituents. The bill provides remedies to protect beneficiaries rights and permits enforcement of the bill s equity requirement by the Internal Revenue Service, the Department of Health & Human Services and the Department of Labor. The law requires the Department of Labor, the Department of Health & Human Services, and Treasury to issue regulations within one year. It will be interesting to see how these three governmental entities attempt to work together to promulgate coherent regulations by the intended deadline. Interestingly, the bill does not mandate insurers or group health plans to provide any coverage. Instead, it only applies to plans that choose to offer mental health coverage. Thus, some employers may choose to exclude these types of benefits for fear of escalating the cost of employee benefit coverage. The non-partisan Congressional Budget Office has estimated a miniscule impact on premiums for the mental health parity bill just two-tenths of one percent. However, this does not seem realistic. You should consult your benefit advisors as soon as possible as to the issues and costs of compliance. Previously, the Mental Health Parity Act of 1996 required group health plans to provide some comparable benefits for mental health treatment but most of the provisions were set to expire at the end of Also, over the last eight years, the Federal Employee Health Benefits Program has made parity coverage for mental health care available to members of Congress and 8.5 million other federal employees. So, some provisions existed before we got to the great bailout. It is estimated that 113 million Americans are suffering from mental illness. The non-profit organization Mental Health America estimates that 67% of adults and 80% of children requiring mental health services do not receive help, in large part because of discriminatory insurance practices. This was a bipartisan bill which has been struggling for passage for almost a decade through the leadership of Senator Edward M. Kennedy of Massachusetts and Patrick Kennedy of Rhode Island, as well as Republican Senator Pete Domenici of New Mexico. Senator Domenici led the fight because he has a daughter diagnosed with schizophrenia. So, the great financial bailout of 2008 had far more in it than one could ever imagine. Not only is the financial impact of the bailout bill still undecided, but so is the economic impact to employers facing this new governmental requirement for mental health parity. 54 SHEET METAL JAC PROVIDES LAGGING COURSE The Sheet Metal & Roofing Contractors Association of the Miami Valley, Ohio (SMRCA) and Sheet Metal Workers Local Union No. 24 (SMWIA) Joint Apprenticeship Committee (JAC) graduated 17 Journeymen from their Sheet Metal Lagging Training Program held in September, at the JAC Training Center located on Poe Avenue in Vandalia. The JAC offers instruction in the fabrication and application of Sheet Metal Lagging as a part of its ongoing Apprentice Training Program. This course however, was an intensive advanced course for Journeymen. The course curriculum was provided by the International Training Institute (ITI), along with close reference to the Sheet Metal and Air Conditioning Contractors National Association (SMACNA) nationally published standards manual Accepted Industry Practices For Sheet Metal Lagging. The course included accepted practices in lagging for types of materials, lagging support systems, expansion and contraction; joint & edge sealing; noise and sound control; weight considerations; tanks; round and rectangular flue and duct; flashing; doors and openings; pre-insulated panels; buckstays; drawings; seismic restraint provisions; wind loading; and specialties. Eugene Frazier is the JAC Coordinator for both Journeymen and Apprentice training. Eugene, along with the Joint Apprenticeship Committee is looking into several areas of specialty sheet metal training that will be offered to SMWIA 24 Members. SHEET METAL JAC RECEIVES NATIONAL CAD DETAILING CERTIFICATION The Sheet Metal & Roofing Contractors Association of the Miami Valley, Ohio (SMRCA) and Sheet Metal Workers Local No. 24 (SMWIA) Joint Apprenticeship Training Program (JAC) received national certification from the International Training Institute (ITI) for training in Computer Aided Design (CAD) Detailing. Apprentice and Journeymen Instructor John Schwytzer received the CAD Detailing certification from ITI as an Approved Instructor; and the JAC Computer Lab was certified by ITI as a CAD Certified Detailing Training Facility John was required to successfully complete an intensive national curriculum in order to be approved as an Instructor. This training not only included the technical side of teaching CAD, but also included courses on instruction techniques teaching detailing. The JAC Training Facility received its certification by successfully completing a Facility Audit, which verified that the computer lab, where the instruction is to be given, meets the required technical standards. In receiving this certification, the JAC is now permitted to instruct Journeymen and Apprentices Sheet Metal Workers in CAD, using the newly developed ITI CAD coordination software. This will provide affiliate firms of Local No. 24 a pool of highly skilled employees using this new CAD system. 57 COURT DECISION NO IMPACT ON NON-COMPETE There has been some discussion that a recent Supreme Court of Ohio decision concerning the Ohio Trades Secret Act has made non-compete clauses broader in scope and easier to enforce. This does not seem to be the case as was reported at a recent Membership Meeting of the Sheet Metal and Roofing Contractors Association of the Miami Valley, Ohio (SMRCA). Stan Dubrowski of the Legal Firm of Calfee, Halter, Griswold stated that the case dealt with the specific issue that protected trade secret information does not lose its character as a trade secret under the Uniform Trade Secrets Act (TUSA) merely because a former employee memorized it rather than writing it down or copying it in some other tangible medium. A trade secret is defined as Informatino, including any business information or plans, financial information, or listing of names, addresses, or telephone numbers, that satisfies both of the following: (1) it derives independent economic value, actual or potential, from not being generally known to, and not being readily ascertainable by proper means by, other persons who can obtain economic value from its disclosure or use. (2) It is the subject of efforts that are reasonable under the circumstances to maintain its secrecy. In summary, this court decision was very specific and employers still must use non-compete clause to protect their rights.
