ThisfiscalyearsawsomechangestothemembershipoftheEISC.Inthefirsthalfof theyearmr.fredwolkilefttheeisc,andmr.calvinpokiakofwasappointedtofill thisvacancy.inmarch2014longxstandingcanadamembermr.johnnylennie informedthecommitteethathewouldnotbeacceptingarexappointmenttothe EISCduetohisexpandedworkcommitmentspostApril1 st 2014andtheNorthwest TerritoriesDevolution.Mr.RudyCockneyhasacceptedanappointmenttotheEISC asthenewcanadamember.mr.cockneyhasanillustrioushistorywiththeeisc,as hewasoneoftheoriginalmemberswhentheeiscwasfirstestablished. Theactivitylevelfortheperiodintermsofsubmissionswasaboutaveragewithno discernibletrendapparent.themainactivitiesencompassedtheareasofscientific andacademicresearch,infrastructurebuildingandmaintenance,remediation,and renewableresourcedevelopment. ThisfiscalyearhasseenarealizationofthebenefitsoftheEISCPreXscreening Subcommittee(whichwasestablishedduringthe2011X2012fiscalyear).ThePSC reportsdirectlytotheeisc.themainroleofthepscistodeterminewhetherornota projectproposalrequiresanenvironmentalimpactscreening.thisdetermination requiresanassessmentofaspecificsetoffactsagainstexistingguidelinesand proceduresinordertodeterminewhetheraparticularapplicationis development asdefinedintheinuvialuitfinalagreement(ifa).further,iffoundtobe development istheapplication exempt fromscreeningasitisdeterminedtobe aclass,ortype,ofdevelopmentdescribedontheexclusionlistestablishedbythe ScreeningCommittee.ThepreXscreeningdecisionisexpectedtobemadewithin7 calendardays 1 ofaprojectsummaryquestionnairebeingfiledwiththeeisc.inthe pastthesedecisionswerebeingmadesolelyatregulareiscmeetingsheldevery6 weeks.theeiscseesclearevidencethatthisnewphasingoftheeisprocessis resultinginmoretimelydecisionsindeterminingwhetherornotaprojectproposal requiresanenvironmentalimpactscreening.thisallowsthecommitteeofthewhole toconcentrateontheirprimarymandateofenvironmentalimpactscreeningand ReviewofdevelopmentXbasedprojects. 1 As part of the broader environmental impact screening and review process the EISC is required to fulfill its roles and responsibilities for the environmental impact screening of proposed developments in a reasonable and expeditious manner in accordance with the requirements of the Inuvialuit Final Agreement. 2
5 IacknowledgewithgratitudethesupportfundingfromAANDC.Thereaderwillnote belowinourfinancialsummary,thesurplusesreported.thisyearhasbeenanother quietoneintermsofcommercialorindustrialundertakings;indeedtheeconomyin theisrappearstobeflattenedingeneral.thissaid,theeiscexpectsitswork volumetoremainsteadyforthecomingyear.thequestionforthecommitteeisnot whether,butwhenthistrendwillturnaround.theeiscmustcontinuetomaintain capacitytomeetitsrolesandresponsibilities. TheregularEISCmeetingscheduleissetayearinadvance(acopyofourcalendar canbefoundonourwebsite).developersverymuchrelyuponthisprexsetschedule astheyprepareandregistertheirplans.followingit smandate,theeischeldoneof itsscheduled2012x2013meetingsintheyukontoreflectthefactthataculturally significantaspectoftheifaistheyukonnorthslope,whichiswithintheisr.the CommitteemetinWhitehorsefromNovember13X16,2013.Commencingthisnew fiscalyear(2013x2014)theeisccoordinatorandonecommitteememberwillbe visitingtwoofthesixinuvialuitcommunitiestopromotewhatexactlytheeiscdoes: explaintheprocessesinvolved,developstrongerrelationshipswithlocalhunter s andtrapper scommittees,andansweranyquestionsthatmaybepresent.the committeevaluesthefacextoxfaceaspectofthesemeetings,andourcommittee recognizestheimportanceofmeetingthepeoplefromourvariouscommunities. Throughtheseconnections,bothformalandinformal,thecommitteeknowledge basecanonlyexpand,andthisinturn,willaidtheeiscinthedecisionswemakeon thebehalfoftheinuvialuit. Inclosingwewillcontinuetoprovisionmoreefficientandeffectiveoperationswithin theeisc,alwayswithanexpectanteyeforaninevitableincreaseineconomicactivity withintheisr. 6 PeriodofthisReport The Environmental Impact Screening Committee (EISC) has produced twentyxsix annual activity reports since its inception in This report describes the EISC s activitiesforthefiscalperiodof1april2013to31march2014 itstwentyxeighthyear ofoperation. TheInuvialuitFinalAgreement OnJune5,1984,theCommitteeforOriginalPeoples Entitlement(representingthe Inuvialuit) and the Federal Government of Canada signed the Inuvialuit Final Agreement (IFA), which was subsequently legislated under the Western Arctic (Inuvialuit)ClaimsSettlementAct[S.C.32X33ElizabethIIC.24.].ProvisionsoftheIFA enable the Inuvialuit to participate, and be meaningful partners, in all decisionsx making processes dealing with the management of the environment and wildlife within the Inuvialuit Settlement Region (ISR). Section 1 of the IFA expresses the followingprinciples. To preserve the Inuvialuit cultural identity and values within a changing northernsociety. To enable the Inuvialuit to be equal and meaningful participants in the northernandnationaleconomyandsociety. To protect and preserve arctic wildlife, environment and biological productivity. As one of five coxmanagement groups established under the terms of the IFA, the EISC plays a vital role in achieving these stated goals through implementing the screeningportionoftheifaenvironmentalimpactscreeningandreviewprocess. 4
7 Mandateofthe EnvironmentalImpactScreeningCommittee The Western Arctic (Inuvialuit) Claims Settlement Act, and the IFA, takes precedence over anyotherfederal,territorial,provincial,ormunicipallawtotheextentofanyinconsistency orconflictbetweenthem.developers,operators,andregulatoryagenciesarecompelledby thisacttocomplywiththeprovisionsoftheifaenvironmentalimpactscreeningandreview Process. TheIFArequiresthescreeningofdevelopmentsandactivitiesofconsequencetotheISRthat couldhaveasignificantnegativeimpactontheenvironmentorwildlifeharvesting.theifa alsodictatesthatregulatoryagenciesmustnotissuelicensesorapprovalsthatpermitany developmenttoproceedwithoutenvironmentalscreeningand,ifnecessary,review. Section11oftheIFAprovidedfortheestablishmentoftheEISCtocarryoutthescreeningof relevant developments. Provisions governing the activities and operation of the EISC are describedmainlywithinsection11and13.section11.(17)requiresthattheeiscmakeoneof thefollowingdecisionsafterexaminingaprojectdescription: a) that the development will have no significant negative impact and may proceed withoutenvironmentalimpactassessmentandreview; b) thatthedevelopment,ifauthorizedsubjecttotermsandconditionsrecommended bythescreeningcommittee,willhavenosuchsignificantnegativeimpactandmay proceedwithoutenvironmentalimpactassessmentandreview; c) that the development could have significant negative impact and is subject to assessmentandreview,or d) thatthedevelopmentproposalhasdeficienciesofanaturethatwarranttermination ofitsconsiderationandsubmissionofanotherprojectdescription Subject to the aforementioned provisions, the EISC produced its Operating Guidelines and Rules of Procedure, which govern the processes and activities in regard to the actual screeningofdevelopmentproposals.duringthetimeofthisreport,theeiscamendedand updated and these two documents to reflect the changes to the processes with the formation of the EISC PreXscreening Subcommittee. These revisions were approved during our April 15X17, 2014 meeting, and the new documents are now in effect; and have been postedfordistributiononourwebsite(seebelow). 8 Membership TheEISCconsistsofsevenmembers,includingtheChair.TheInuvialuitGameCouncil(IGC) appointsthreemembers.thefederalgovernmentofcanada(canada),theyukonterritorial Government(YTG),andtheGovernmentoftheNorthwestTerritories(GNWT)nominateone membereach,whois then appointed by the Government of Canada. The Government of Canada, withtheconsentoftheigc, appointsthechair.eachmemberisappointedfora threexyear term with the option of rexappointment if agreed to by the nominating and appointingbodies.eventhoughparticulargroupsappointthemembers,theeiscservesasa nonxpartisan organization. 9 AdministrativeandTechnicalAssistance The EISC receives administrative, technical, and clerical support from the Joint Secretariat Inuvialuit Settlement Region, situated in Inuvik, NT. The EISC CoordinatorservesastheSecretarytotheEISC,andprovidesfullXtimeofficesupport. DarrellChristieistheEnvironmentalImpactScreeningCoordinator. During the period of this report the EISC also received administrative support from various employees of the Joint Secretariat including: Dr. Norm Snow, Executive Director; Peggy Madore, Senior Administrative Officer; Linda McDonald, Office Manager;EuniceThrasher,FinanceOfficer;ShannonJensen,Travel/Accommodation Coordinators; Bernice Joe, Secretary/Receptionist; Myrna Button, Office Clerk/Librarian; and Eli Nasogaluak, the Environmental Impact Review Board(EIRB) Coordinator. JohnDonihee,ofMcLennanRossLLPprovidedcontractuallegalservices. Activities Members attended screening meetings approximately every six weeks and participated in other activities on behalf of the EISC, as required, to fulfill the mandateoftheeisc. Onescheduledmeetingwascancelled:January30X31,2014. InadditiontotheregularEISCmeetings,thePreXscreeningSubcommittee(PSC)met electronically,asandwhenrequired,todeterminewhetherornotaprojectproposal requiredanenvironmentalimpactscreening. 7
10 Submissions It is the responsibility of the proponent to submit a project description to the EISC for environmental screening. Under the Inuvialuit Final Agreement (IFA), section 11(36), no# license# or# approval# shall# be# issued# that# would# have# the# effect# of# permitting# any# proposed# development#to#proceed#unless#the#provisions#of#[ifa#section#11(36)]#have#been#complied#with. This requirement has the effect of requiring competent authorities to give notice of applicationsforlicenses,permitsorotherauthorizationstotheeisc.theseapplicationsfor proposeddevelopmentsmustbereviewedbytheeisctodetermineiftheyaresubjectto environmentalimpactscreening. ApreXscreeningdecisionastowhetherornotaprojectproposalrequiresanenvironmental impactscreeningismadebyasubcommitteeofthreeoftheseveneiscmembers.apanelof fiveeiscmembersmakesenvironmentalimpactscreeningdecisions.thepanelconsistsof the Chair, two Inuvialuit members, the Canada member, and the Territorial member nominated by the territory (YT or NT) within which the project is to occur. Decisions are madeonamajorityvotebasis,withthechairvotinginthecaseofatie. Of the total submissions, one project was referred to the Environmental Impact Review Board. Insummary,theEISCscreened68projectdescriptionsduringfiscalyear2013/2014including: HydrocarbonOilandGasrelatedprojects(1);Researchprojects(35);InfraXStructureprojects (10); Remediation (2); Tourism (1); Site Maintenance (2); Exploration (2); Cancelled (1); OffshoreTransit(1)Government(Municipal/Territorial/Federal)(13) PleaseseeAppendixC:EISCSubmissionsforachartshowingalltheaboveactivity. OtherActivity In addition to developments that are screened, the EISC asks to be informed of other projectsthatareproposedfortheinuvialuitsettlementregion,butforvariousreasonsare exempt from the screening process. This task is undertaken so that the EISC may have a broadpictureoftheactivitiesbeingcarriedoutwithintheisrforthepurposesofcumulative impactassessment.theeiscgreatlyappreciatedtheeffortsoftheotherjointsecretariat coxmanagement groups, the government agencies, the Aurora Research Institute, and the InuvialuitLandAdministrationduringthereportingyeartokeeptheEISCapprisedofsuch activities. 8
