1 COMMONWEALTH OF PENNSYLVANIA DEPARTMENT OF ENVIRONMENTAL PROTECTION GRANTS CENTER 1. Short Title GROWING GREENER PLUS APPLICATION FORM LINE-BY-LINE INSTRUCTIONS (Applies to all grants unless noted otherwise) Provide a short, descriptive title for your project. The title should be five words or less and clearly communicate project type, e.g. Orange Creek AMD Treatment System, Muddy Run Stream Bank Stabilization. 2. Applicant/Sponsor Information To be a grantee, the applicant must meet one of the below bulleted criteria. Otherwise, the applicant must partner with a sponsor that meets one of the following criteria to act as grantee on the applicant's behalf. When a sponsor is used, the sponsor is the entity that enters into the grant agreement and is responsible for all aspects of the project, including payment for work performed. Use the applicant organization's/sponsor's legal name. Watershed organization recognized by DEP that promotes local watershed conservation efforts (organization must be incorporated); For information on incorporating, contact the Department of State, Corporation Bureau at County and Municipality (borough, township, etc.); County Conservation District; Council of Governments; or Other authorized organization involved in research, restoration, rehabilitation, planning, acquisition, development, education or other activities, that furthers the protection, enhancement, conservation, preservation or enjoyment of Pennsylvania's environmental, conservation, recreation or similar resources. The organization must be: o o o A tax exempt corporation under Section 501(c)(3) of the Internal Revenue Code and registered with the Pennsylvania Bureau of Charitable Organizations. If an applicant/sponsor is claiming an exemption from registering with the Bureau of Charitable Organizations, the applicant/sponsor must provide proof of such exemption with the application. Conservation Commissions or Foundations created by State or Federal legislation or action are exempt from the incorporation requirement. An Educational Institution (only School Districts qualify for SMCRA Bond Forfeiture and AMD Set-Aside funding) involved in these authorized activities, or A Municipal Authority. 3. Type of Organization If a sponsor is named in Question 2, select the type of organization for the sponsor. If not, select the type of organization for the applicant. 4. Project Location Enter the project location county(ies) and municipality(ies). If the project location is statewide, enter All in the County field and leave municipality(ies) blank. If the project location does not cover the entire state but does - 1 -

2 include a select watershed(s) or another regionally defined area, please identify all the counties in the area selected, no municipality identification is needed in this case. Mark the project location on an 8 ½ x 11 copy of a USGS 1:24,000 scale map. The project boundaries and the quadrangle name are required. If your project area is too large to fit, other topo map scales are acceptable. Latitude and longitude (center of project area) are required. A map is not required for statewide projects but is required for regional projects spanning a complete watershed or other defined project area which is a subset of the entire state. Indicate what percent of the project will take place within the Chesapeake Bay watershed. 5. Application/Project Category Watershed Protection Grants (Includes GG and 319) Eligible proposals will address nonpoint source pollution through local, watershed-based planning, restoration or protection efforts. Check only one of the categories (a) through (i). (DEP reserves the right to change the proposed project type designation if it believes the proposal does not sufficiently match the project type identified). AND if the project is to be submitted for 319 approval Section 319 Nonpoint Source Grants Check box (j) if the project is being submitted for Section 319 Nonpoint Source Grants consideration. Please note that projects submitted for this grant type need to be for projects implemented in one of the 36 approved 319 watersheds listed in the document titled EPA Section 319 Nonpoint Source Priorities (form # 1010-FM-GC0001k), or for a statewide projects relevant to Section 319 funding. OR Surface Mining Conservation and Reclamation Act (SMCRA) Check box (k) for projects submitted under the bond forfeiture program where the sites fit the definition of ABS Legacy Sites in 25 Pa Code The applicant must contact the local mining Watershed Manager listed on page 2 of the document titled Pennsylvania Department of Environmental Protection Contact Information (form # 1010-FM-GC0001l) to identify which ABS legacy bond forfeiture sites need remediation work. Check box (l) for projects submitted under the set-aside program where project sites are located in Qualified Hydrologic Units as defined by the Federal SMCRA under the 2006 reauthorization. A map and list of these watersheds is located in the document titled Abandoned Mine Drainage (AMD) Prioritization Activities and Watersheds (form # 1010-FM-GC0001j). 6. Discussion with DEP staff Applicants must contact the appropriate DEP staff prior to preparing a grant application. See the document titled Pennsylvania Department of Environmental Protection Contact Information (Form 1010-FM-GC0001l) for contact information for the staff identified below. Regional Watershed Managers should be contacted for Growing Greener projects. Watershed Support staff under the Office of Water Resources Planning should be contacted for watershed protection projects that are statewide or affect multiple DEP regions. Watershed Support staff under the Office of Water Resources Planning should be contacted for any 319 project including mining projects located in approved WIPs. AMD Set-Aside Watershed Contacts at the Bureau of Abandoned Mine Reclamation should be contacted for any AMD Set-Aside projects. District Mining Office staff should be contacted for only Bond Forfeiture projects. Keep in mind that a site visit is recommended for most projects; therefore, contacting the appropriate DEP staff person prior to December 21, 2016 would be advantageous. DEP staff can provide direction on how to improve your application. See the document titled Pennsylvania Department of Environmental Protection Contact Information (form # 1010-FM-GC0001l) for appropriate contact information. Applicants are strongly encouraged to contact their county conservation district when developing projects and preparing their grant application. The conservation district coordinates activities and resources at the local - 2 -

3 level and may be able to connect you with other groups interested in the same watershed. A draft application sent in advance to the conservation district may facilitate such communication. County conservation district watershed specialists are listed at - listed under Related Information - Contacts. 7. Budget Summary and Task and Deliverable Budget Worksheet Note: For AMD Treatment Projects, a detailed final plan that addresses the Operation, Maintenance & Repair/Replacement needs of the project is required to be submitted to the Department as a project deliverable prior to completing the project. Budget Summary Complete the Task and Deliverable Budget Worksheet. Use the Task and Deliverable Budget Worksheet to complete item 7, Budget Summary on the Application Form. The dollar amounts for each of the categories in the Budget Summary must match those developed in the Task and Deliverable Budget Worksheet. For assistance on budgets, see the Primer for Fitting Charges with Budget Categories at click on Help for Applicants, Additional Application Information. For Growing Greener and AMD Set-Aside projects, a 15 percent match of the grant request is required. Eligible match contributions will be permitted for up to THREE YEARS prior to the grant submittal deadline date through the life of the grant agreement as long as the eligible match expenditures are directly related to the project. Only cash and in-kind match funds already committed and reserved for the project can be included within the budget and deliverables worksheet. All applied for match dollars yet to be confirmed by the provider may be described in the project description section including an indication of their status for approval, understanding that these uncommitted match funds may not be authorized for inclusion when calculating the 15% match obligation. If the project is relying on applied for match funds to meet the 15% match obligation, please indicate this in the Budget Summary section of the Task and Deliverables Worksheet and provide sufficient documentation and justification in the application write-up for DEP review staff to consider when assessing match for the project application. Match contributions cannot include other DEP funding sources, DEP County Environmental Initiative funding or DEP in-kind services, including laboratory analysis. You may provide additional budget information for reviewers to evaluate the project. Section 319 Nonpoint Source and SMCRA grants do not have a match requirement, but any match provided will improve the competitiveness of the application. In the event of an award for an SMCRA project, the percent of match identified in the application will be required as part of the terms of the grant agreement entered into with the Department. All match must be expended within the grant period of performance. The Task and Deliverable Budget Worksheet must be attached to the application. Prevailing Wage Please note that, if the grant project includes construction work where the total project cost is greater than $25,000, the Act of August 15, 1961 (P.L. 987), as amended, known as the Pennsylvania Prevailing Wage Act (43 P.S et seq.) may apply. Construction is defined to mean public work projects including construction, reconstruction, demolition, alteration and/or repair work other than maintenance work. It is the responsibility of the applicant or sponsor to contact the PA Department of Labor and Industry, Bureau of Labor Law Compliance at for guidance. 8. Accepting Federal Funds Only those applications with the Yes box checked will be considered for EPA Section 319 NPS and other potential federal funding including SMCRA Bond Forfeiture and AMD Set-Aside funding. By checking Yes you are agreeing to accept all conditions/restrictions of that funding source. 9. Projects on Grantee-Owned Lands Is your project located on land owned or controlled by the grantee? If not, a Landowner Letter of Commitment or Landowner-Grantee Agreement is required to be submitted with the application for all design and/or construction and OM&R projects

Projects on State-Owned Lands If your project is located on land owned or controlled by the Commonwealth of Pennsylvania (i.e., Bureau of Forestry, Bureau of State Parks, Pennsylvania Game Commission, Pennsylvania Fish & Boat Commission), you must contact the appropriate agency for landowner consent and submit a landowner letter of commitment with your application. Following is contact information: DCNR Bureau of Forestry: Ryan Szuch DCNR Bureau of State Parks: Rachel Reese Pennsylvania Game Commission: Mike DiMatteo , Ext Pennsylvania Fish & Boat Commission: Bernie Kiesnoski Sustainable Forestry The Environmental Stewardship and Watershed Protection Act requires that no monies shall be used for any purpose that, directly or indirectly, precludes access to or use of any forested land for the practice of sustainable forestry and commercial production of timber or other forest products. 12. Land Use Planning Grant applications are evaluated for their consistency with DEP Policy for Consideration of Comprehensive Plans and Zoning Ordinances, Acts 67 and 68 of Grant applicants must complete and submit the appropriate form or letter(s) as identified in the Land Use Policy for projects involving Design and/or Construction, Technical Assistance or Developing a Watershed Plan. The land use policy is available in Help for Applicants found at click on Act 67 and 68 Land Use Planning. The Land Use Planning Form and Multi-Municipal Planning Form are available at General Questions about the Land Use Policy can be answered by contacting the DEP Office of Policy at Questions concerning project consistency with local land use regulations should be directed to your County Planning Agency. 13. Commonwealth Investment Criteria The Commonwealth has established criteria to promote sustainable development. Additional consideration will be given to your project if you checked the Yes box. Check the Yes box if your project will: INCREASE JOB OPPORTUNITIES. Retain and attract a diverse, educated workforce through the quality of economic opportunity and quality of life offered in Pennsylvania's varied communities. Integrate educational and job training opportunities for workers of all ages with the workforce needs of businesses. Invest in businesses that offer good paying, high quality jobs that are located near existing or planned water and sewer infrastructure, housing, existing workforce and transportation access (highway or transit). FOSTER SUSTAINABLE BUSINESSES. Strengthen natural resource based businesses that use sustainable practices in energy production and use, agriculture, forestry, fisheries, recreation and tourism. Increase our supply of renewable energy. Reduce consumption of water, energy and materials to reduce foreign energy dependence. Lead by example: support conservation strategies, clean power and innovative industries. Construct and promote green buildings and infrastructure that use land, energy, water and materials efficiently. Support economic development that increases or replenishes knowledge-based employment, or builds on existing industry clusters. Also, if you checked yes, please provide the number of anticipated NEW jobs created in the appropriate column under 13a as a result of your project and the number of anticipated jobs that will be RETAINED as a result of a your project under 13b in the appropriate column. 14a. Environmental Justice To see if your project is in an Environmental Justice Community (EJ), go to: click on PA Environmental Justice Areas. If you have questions regarding whether your project is located in an EJ or need additional information, please refer to the environmental advocate contact identified in the document titled Pennsylvania Department of Environmental Protection Contact Information (form # 1010-FM-GC0001l). If you check the yes box, additional consideration will be given to your project. 14b. Act 47 Financially Distressed Municipality Act To see if your project is in a financially distressed municipality go to: 47-financial-distress. If you check the yes box, additional consideration will be given to your project

Project Eligibility and General Priority Identification: Growing Greener projects proposed in the Chesapeake Bay watershed: For projects proposed to be implemented in the Chesapeake Bay watershed, please describe how the project follows the Project Eligibility Criteria outlined on pages 4 and 5 of the Submittal (form # 1010-FM-GC0001c) in these guidelines. Projects addressing these criteria in a cost effective manner that are likely to have a significant positive impact on stream or lake water quality will receive preference for funding. Growing Greener projects proposed outside the Chesapeake Bay watershed: For projects proposed to be implemented outside the Chesapeake Bay watershed using Growing Greener funding, please indicate how the project meets the Project Eligibility Criteria outlined on page 5 of the submitted instructions (form # 1010-FM-GC0001c) as well as how the project addresses any of the General Priority Activities and any Special Program Initiatives as outlined in the documents relating to Special Watershed Initiatives (form # 1010-FM-GC0001h), Growing Greener Priorities Outside of the Bay Watershed (form # 1010-FM-GC0001i) and for mining projects, the document relating to AMD Prioritizations (form # 1010-FM-GC0001j). Eligible projects addressing one or more of these priority activities will receive preference for funding. EPA Section 319 Nonpoint Source Grant projects: For projects proposing to be funded using Section 319 Nonpoint Source Grant funds, describe how the project meets the Project Eligibility Criteria outlined on page 6 of the Submittal (form # 1010-FM-GC0001c) and describe how the project supports the implementation of the EPA approved WIP. Projects with a strong connection to implementing priority projects outlined in the WIP will receive preference for funding. SMCRA Bond Forfeiture Grant and AMD Set-Aside Grant projects: For projects proposing to be funded under either of these SMCRA AMD remediation programs, describe how the project meets the Project Eligibility Criteria outlined on pages 8 through 10 of the Submittal (form # 1010-FM-GC0001c) and whether the project meets any of the General Priority Activities outlined in the document relating to Growing Greener Priorities Outside of the Bay Watershed (form # 1010-FM-GC0001i). 16. Regional Priority Identification for Growing Greener and Section 319 Nonpoint Source Applications This Section is not relevant to Growing Greener projects proposed in the Chesapeake Bay watershed. For these projects the applicant should indicate Not applicable - Chesapeake Bay Growing Greener project application in this area of the application. Growing Greener project applications outside the Chesapeake Bay watershed: The Department has identified targeted watersheds to focus project implementation efforts in an effort to gain significant and observable improvements in water quality. For a listing of Growing Greener priority watersheds see the documents relating to Growing Greener Priorities Outside of the Bay Watershed (form # 1010-FM-GC0001i) and for mining projects, AMD Prioritizations (form # 1010-FM-GC0001j) and the document relating to EPA Section 319 Priorities (form # 1010-FM-GC0001k) for a listing of Section 319 priority WIP watersheds. Please list the watershed in which the project is proposed to be implemented, and indicate whether or not that watershed is on either of the Priority Watershed listings. Projects located in either of these Priority Watershed listings will receive preference for funding. In addition, the Department has identified Regional Priority Activities for Growing Greener projects, listed in the documents relating to Growing Greener Priorities Outside of the Bay Watershed (form # 1010-FM-GC0001i) and for mining projects, AMD Prioritizations (form # 1010-FM-GC0001j). Please identify if the activities proposed in the Growing Greener project meet any of the regional priority activity criteria. 319 project applications: For projects submitted for Section 319 Nonpoint Source Grant consideration, indicate the watershed where the project is proposed to be implemented. The EPA approved Section 319 WIP watersheds are listed in the document titled EPA Section 319 Nonpoint Source Priorities (form # 1010-FM-GC0001k). 17. Mining Program Priority Watersheds for SMCRA Bond Forfeiture and AMD Set-Aside Grants Please list here the specific watershed where your project will be implemented and describe whether or not the watershed is a priority as indicated below. The Department has identified specific priority watersheds relating to SMCRA grants that applicants should consider when developing project applications. Projects implemented in one of these priority watersheds will receive preference for funding. See the document titled Abandoned - 5 -

6 Mine Drainage (AMD) Prioritization Activities and Watersheds (form # 1010-FM-GC0001j) for the listing of mining priority watersheds. As well as the document titled Growing Greener Priorities For Watershed Protection Grants Outside the Bay Watershed (form # 1010-FM-GC0001i). 18. Project Executive Summary An Executive Summary should be a comprehensive but concise narrative that summarizes the nonpoint source pollution (NPS) problem and cause and includes the project s expected environmental results including the types and amount of the various practices or activities that will be implemented. This summary should also indicate the level of improvement to the water body that can be expected through the implementation of the project, including the expected pollutant load reductions if the applicant is able to provide this information. Detailed Project Description REQUIRED ATTACHMENTS WITH ALL APPLICATIONS The following format outline must be used to prepare a detailed but concise project description that is generally between two to ten pages in length. If you need help, see Guidance for Specific Watershed Protection Project Types available at under Help for Applicants to assist in developing this description. Please note the following as you develop the Project Description: The Project Description should be written so that it is easily understood, concise, non-repetitive, and complete, with information included for each of the elements listed below or include a not applicable statement for areas in the below outline that are not relevant to your project. You should provide a visual description of the problem with photographs of the existing conditions at the site(s). Additionally, photographs showing examples of similar improvement or remediation techniques to those being proposed are helpful in describing your project. a. Statement of Environmental Need (Please keep in mind, this is the essence of your project; the reason that funds should be awarded.) 1. Describe in concise detail how this project will address or support the following in relation to improving water quality or remediating environmental degradation: a. For Growing Greener Projects within the Chesapeake Bay watershed: i. The Chesapeake Bay Project Eligibility Criteria found on pages 4 and 5 of the Submittal (form # 1010-FM-GC0001c) for Growing Greener Projects in the Bay Watershed, b. For 319 NPS Projects: i. The 319 Eligible Project Criteria found on page 6 of the Submittal (form # 1010-FM-GC0001c). c. For all other applications: i. The Eligible Project Criteria relevant to the particular grant type. See the submittal instructions (form # 1010-FM-GC0001c) ii. General Priority Activities (see the documents relating to Growing Greener Priorities Outside of the Bay Watershed (form # 1010-FM-GC0001i) and for mining projects, AMD Prioritizations (form # 1010-FM-GC0001j)) iii. Specific Regional and Mining DEP Priority Activities (see the documents relating to Growing Greener Priorities Outside of the Bay Watershed (form # 1010-FM-GC0001i) and for mining projects, AMD Prioritizations (form # 1010-FM-GC0001j)). iv. Specific Regional and Mining DEP Priority Watersheds (see the documents relating to Growing Greener Priorities Outside of the Bay Watershed (form # 1010-FM-GC0001i) and for mining projects, AMD Prioritizations (form # 1010-FM-GC0001j) and the document relating to EPA Section 319 Priorities (form # 1010-FM-GC0001k)). v. Special Watershed Initiatives (see the document titled Special Watershed Initiatives Under the Growing Greener Grants Program (form # 1010-FM-GC0001h))

7 vi. Existing local or regional needs. 2. Describe how this proposal supports or relates to a Watershed Restoration and/or Protection Plan or other coordinated community efforts. - Focus on describing items such as coordination efforts with other individuals, municipalities and/or organizations. - Is this project a sub-element of a larger local or regional effort or on-going program? - Describe any subsequent actions or successive projects that are intended for a later time. b. Justification of Funding 1. Explain why the project should be funded and how it fits into Pennsylvania's Nonpoint Source Management Program Update (found in the DEP elibrary under the publications tab with the document number 3700-BK-DEP4490) and/or local watershed initiatives. If a TMDL has been completed in the watershed, that report should be referenced. TMDLs may be viewed from the DEP website at: 2. Explain why Growing Greener/319/SMCRA is the most appropriate funding source for this project. 3. If the proposed project is a continuation of past or current efforts, document the success of that project to support continuance of those efforts. c. Match Briefly describe each source of match (cash or in-kind service) provided by the Individual, Staff, or Contractor that you have listed on the Task and Deliverable Budget Worksheet. Describe the task they will perform and/or the item provided. Documentation of match should be provided in the form of a letter from each source or describe why this documentation is not available. If any source of match has been applied for but not yet approved, please describe that funding source, what your request was, and the status of that request. d. Proposed Scope of Work The Guidance for Specific Watershed Protection Project Types, which is available at under Help for Applicants, provides an outline of the topics that should be considered when writing this scope of work. In addition, ensure that your scope of work addresses the following: 1. State the goal or purpose of the project. 2. List the project's expected environmental results and be as specific and quantifiable as possible. The scope of work must discuss how that improvement will be measured (e.g. lbs of pollutant load reduced, ph change expected, feet of impaired stream restored, tons of sediment load reduced, etc). 3. Describe the project deliverables. These deliverables should relate directly to those activities outlined in the Task and Deliverable Budget Worksheet. 4. Include the type and amount of the various practices or activities you plan to implement under this project. 5. Describe the landowner s interest in the completion of the project and provide reference to DEP s Landowner Letter of Commitment or Landowner-Grantee Agreement, attached at the end of your application. 6. Describe any special approvals or permits needed to complete your project. 7. Describe how any long-term operation and maintenance activities will be carried out and funded. 8. Provide an implementation schedule timeline for all significant tasks under the project, and list all parties who will be involved in completing those tasks. 9. Identify contractor involvement, contracting procedures and construction inspection provisions

8 e. Contractor Provisions Describe the process you will use for selecting contractors to complete the project. If contractors are proposed, preference will be given to those projects that use a competitive selection process such as Requests for Proposals (RFP) and/or competitive bidding. The selection process used is up to the applicant; but, the intent is to encourage the most cost-effective and efficient use of funding without mandating unnecessary requirements to all applicants. Contractor involvement, contracting procedures and construction inspection provisions should be identified. Applicants choosing not to use a competitive selection process for contractors must provide adequate justification for not using a competitive process in their project description. The Department of Environmental Protection encourages grant applicants and recipients to solicit and use small diverse businesses as prime contractors, and encourages all prime contractors to make a significant commitment to use small diverse businesses as subcontractors and suppliers. A Small Diverse Business is a DGS-verified minority-owned business, woman-owned business, veteranowned business or service-disabled veteran-owned business. A Small Business is a business in the United States which is independently owned, not dominant in its field of operation, employs no more than 100 full-time or full-time equivalent employees, and earns less than $7 million in gross annual revenues for building design, $20 million in gross annual revenues for sales and services and $25 million in gross annual revenues for those businesses in the information technology sales or service business. Project Data Submission Describe data that are expected to be collected during the implementation of the project and how that data will be provided to the Department in accordance with the following criteria. If the AMDTreat software is required to be used for the development of the proposal as described below, indicate that the required report is submitted as an element of this application. Any GIS data or electronic databases produced as a result of the grant must be identified here and provided to DEP without restrictions by the conclusion of the project. Grantees are also required to submit data, information and applicable project deliverables. All of these submittals must be done in accordance with DEP's Guidance for Data Management policy. The policy can be viewed at Help for Applicants under Maps and Data. All applications for design and/or construction of Abandoned Mine Drainage (AMD) treatment facilities must include the use of AMDTreat software for rough sizing and cost estimating. A printed report from AMDTreat must be included in the proposed scope of work. The AMDTreat software is available to the public on the Federal Office of Surface Mining website at For AMD Remediation Projects, the Western Pennsylvania Coalition for Abandoned Mine Reclamation (WPCAMR) or the Eastern Pennsylvania Coalition for Abandoned Mine Reclamation (EPCAMR) may be - 8 -

The Commonwealth has established investment criteria to promote sustainable development. Describe, if applicable, how the project will result in increased job opportunities and how the project will foster sustainable businesses. Use statistics, demographic data, growth trends, existing landuse plans, etc., to support your position. Preference will be given to projects that address these investment criteria. 2. Preference will also be given to applicants proposing projects in designated environmental justice communities. See the following site for more information on Environmental Justice: If applicable, describe how this project will have a direct or indirect positive impact on an environmental justice community. h. Landowner Access Authorization (Required if the project involves only monitoring) The applicant or sponsor organization shall obtain landowner authorization to access the property to perform the monitoring. The Landowner Access Authorization Form is found on the DEP elibrary as form # 1010-FM-GC0001o. This is the only signed form allowed; no substitutions are permitted. b. Landowner Letter of Commitment (Required if the project involves design, installation/replacement of a conservation practice/best management practice). A signed letter of commitment from the landowner(s) must be included in the application. If the project is located on land owned or controlled by the Commonwealth, see page 4 of the Line-By-Line (form # 1010-FM-GC0001f) for the appropriate Commonwealth representative. The Landowner Letter of Commitment is found on the DEP elibrary as form # 1010-FM-GC0001m. This is the only signed form allowed; no substitutions are permitted. c. Landowner Letter of Commitment (SMCRA) (Required if the project involves design and/or construction on a Bond Forfeiture site).
