Implemented Auxiliary aids for persons with disabilities are available upon advance request RULEMAKING ACTION RULE SUMMARY OAR about the SNAP income and payment standards is being amended to reflect the sunset of the American Recovery and Reinvestment Act of 2009 (ARRA) by reducing the payment standards for the Thrifty Food Plan in the SNAP program as of November 1, In addition, the above rule may also be changed to reflect new Department terminology and to correct formatting and punctuation. The Department requests public comment on whether other options should be considered for achieving the rule's substantive goals while reducing the negative economic impact of the rule on business. Department of Human Services - Self-Sufficiency Programs OAR Chapter 461 Agency and Division Administrative Rules Chapter Number Rule Caption: Changing OARs affecting public assistance, medical assistance, or Supplemental Nutrition Assistance Program clients In the Matter of: Amending OAR Statutory Authority: ORS Other Authority: 7 USC 2014, 7 CFR 273.9(d)(6)(iii) Statutes Implemented: ORS , ORS Need for the Rule(s): OAR needs to be amended to reflect the sunset of the American Recovery and Reinvestment Act of 2009 (ARRA). Under ARRA, maximum allotments were to remain the same each year until the TFP adjustment increased allotments above those set by the Recovery Act. This provision sunsets effective November 1, As a result, on November 1, 2013, maximum allotments will decrease. Documents Relied Upon (and where they are available): August 1, 2013 Memo from Food and Nutrition Service regarding the new standards and Oregon SNAP State Plan submitted to Food and Nutrition Service available from DHS - SNAP Program, 500 Summer Street E48, Salem Oregon Fiscal and Economic Impact, including Statement of Cost of Compliance: The Department estimates that amending OAR will have a negative fiscal impact on the participants in the SNAP program because maximum allotments will decrease. The Department is unable to estimate the extent of the impact on client benefits because each case is calculated based the household's specific circumstances. The maximum reduction will range from $8 - $11 per person in the need group per month.. This amendment will have no fiscal impact on the Department because SNAP benefits are 100 percent federally funded. There is no fiscal impact estimated on the general public, local government, and business, including small business. There is no cost of compliance for small business. No small businesses are subject to this rule. How were small businesses involved in the development of this rule? Small businesses were not involved in the early development of these rules but will be included in the public review and comment period.
