2 Statements & Search Criteria Mission The mission of Legal Aid Service of Collier County is to provide high quality free civil legal advice, representation and education to the residents of Collier County, based on need, so as to encourage self sufficiency and improve the lifestyle and living conditions of the entire community. Vision Statement To provide every person in Collier County who cannot afford an attorney with the civil legal representation needed to ensure their safety, health and minimum economic security. 2

3 Background Background: Legal Aid Service of Collier County is a private, non-profit law firm, and a Division of Legal Aid Service of Broward County (LASBC) - a 501c(3) non-profit corporation providing free civil legal services to the underprivileged. Legal Aid Service of Collier County is the successor entity to the former Collier County Legal Aid Society ( Society ), which was established in In October of 2004, during a statewide restructuring, LASBC merged with the Society and the Immokalee office of the Florida Immigrant Advocacy Center (FIAC) - creating Legal Aid Service of Collier County as a new agency. LASCC currently employs 20 professionals, including 8 Staff Attorneys, operating a main office in Naples and an outreach office in Immokalee. LASCC is the only non-profit agency in Collier County solely dedicated to providing free legal services to the community. LASCC handles civil legal matters only, serving low-income individuals and families. Legal Aid prioritizes providing free legal services to civil legal clients in high stakes matters involving safety, health and issues of minimal economic security. The clients we help include children who have been abused, neglected or abandoned, families facing homelessness through foreclosure or wrongful eviction, the elderly, disabled and veterans seeking benefits, victims of domestic violence, and children with learning disabilities in need of representation on education law matters. Need: In Collier County, 14.2% of the population (over 47,000 people) lives under the Poverty Level established by the Federal Poverty Guidelines. At Legal Aid, eligibility for our services depends upon the income limits imposed under grants which govern the areas of law for which assistance is provided. These income limits for eligibility typically range from 150% of the Federal Poverty Guidelines to 80% of the Median Household Income for Collier County. Therefore, conservatively, well over 75,000 residents in Collier County are eligible for Legal Aid. There is a growing need in Collier County for LASCC s services. In 2013 (the most recent year for which data is available), there were 1,427 incidents of domestic violence in Collier County. Legal Aid staff attorneys combat this growing problem by protecting victims of domestic violence by obtaining injunctions for protection against abusers. Approximately 70% of all social security claims made in Florida are initially rejected. 11.8% of Collier County residents are veterans entitled to government benefits. Legal Aid staff attorneys empower veterans and permanently disabled clients by obtaining monetary and medical benefits to which they are legally entitled. Our attorneys also prepare wills, medical care directives and other related legal instruments for low income veterans and seniors. Every year, Florida Department of Children and Families receives hundreds of tips related to suspected human trafficking. Legal Aid staff attorneys help protect victims of human trafficking and other violent crimes by obtaining protection for the victims, and when appropriate, providing immigration assistance. More than 61% of Collier County s 45,000 public school students (more than 27,000 students) are categorized as economically needy. Legal Aid attorneys help Collier County special needs children maximize their potential by securing testing and special education services to which they are entitled at school. Collier County schools have 5,980 children with disabilities. Our attorneys also represent at-risk children who have been abused, neglected or abandoned in dependency cases. In Collier County during the period from October 2012 to September 2013, there were 3,796 reports of maltreatment of children, triggering 2,752 investigations, which resulted in findings that 419 children had been confirmed as victims. Of these 419 child victims, 184 suffered neglect, 35 were physically abused, 27 were sexually abused, and 173 were victims of other abuse. Almost 400 children were in foster care in Collier County between April 2013 and March In addition to the types of cases discussed above, LASCC also handles several other types of cases. Our staff attorneys regularly represent clients in danger of losing their home to foreclosure, negotiate with the IRS to assist low income taxpayers, represent clients at hearings to secure unemployment compensation benefits for 3

4 those with meritorious claims, and handle many other types of legal problems. Additionally, private attorney volunteers have handled over 680 cases through Legal Aid since The demand for the free legal services provided by Legal Aid Service of Collier County continues to grow, as the economic recovery has left many low income individuals and families behind. In 2013, Legal Aid handled a record number of cases for our program over 2,700. This record level of service was shattered last year (2014), as Legal Aid handled over 3,400 cases. Fairness Our poorest and most vulnerable citizens need real and meaningful access to civil Courts when facing the most serious possible losses or consequences involving basic human needs, regardless of their ability to pay for legal counsel. Justice Basic human needs continue to be jeopardized in our local civil courts for those without counsel in high stakes matters involving safety, health or minimum economic security. Equal justice demands representation for all in these matters. Protect Children Every at risk child (abused, neglected or abandoned) must be provided with legal representation, as needed, to protect them and provide for their safety, health, and education. All children are entitled to the provision of basic human needs, such as shelter, safe living conditions, and a home environment adequate to provide them with a chance to reach their full potential. Protect Victims Every victim of domestic violence, assault or other abuse (including stalking) must be provided with legal assistance adequate to secure their safety and well-being, regardless of their ability to pay. Prevent Homelessness All families and households who are at risk of homelessness through foreclosure or eviction are entitled to adequate legal assistance to secure their rights, regardless of ability to pay for counsel. Protect the Elderly, Disabled, and other Vulnerable Citizens Low income seniors, veterans, and the disabled are among the most vulnerable members of our society. Legal assistance must be furnished when they cannot afford counsel and need help to secure benefits, housing, medical care, or other basic needs. Safeguard Human Rights Appropriate legal assistance must be provided to individuals facing immigration issues that affect their personal safety regardless of their ability to pay for counsel. Individuals such as human trafficking victims, victims of severe domestic violence, unaccompanied children, and political asylum seekers facing the threat of death upon return to their home country are entitled to basic legal assistance as a matter of human rights and ordinary notions of fairness and equal justice. Educate those with Learning Disabilities Every child has the right to a free and appropriate education in the least restrictive academic environment possible. When schools do not provide children with learning disabilities or special needs with the services and supports to which they are entitled under law, these children must be provided with legal representation to secure their rights and reach their full potential. Promote Healthy Home Environments for Families with Minor Children No parent should lose custody of a child simply because they cannot afford legal counsel. The consequence of a loving parent losing custody of a child is as serious as any in our legal system. Areas Of Service Areas Served 4

6 Programs Programs Legal Aid for Collier Kids Description The Legal Aid for Collier Kids Project addresses a dangerous gap in services in Collier County to meet the critical legal needs of children who have been victimized by exposure to domestic violence, abuse, abandonment, or neglect. Legal Aid is the only provider of these kinds of free direct legal services to these at-risk children in Collier County. Budget Dependency and Family Law. The Project has made an immediate and substantial impact in promoting the safety, stability and overall well being of at-risk children in Collier County. The type of legal assistance rendered under the Project is prioritized based on the level of emergency posed to the children. Legal assistance provided under the project includes obtaining Injunctions for Protection against Domestic Violence or Sexual Abuse. Education Law. The Legal Aid for Collier Kids Project also serves the education law needs of children. The Education Legal Rights Project of Collier County provides legal representation to children and parents when the child s needs are not being met in the school. The child may need additional services due to a learning disability, physical, mental or emotional disability, other health impairment, or another disabling condition under the Individuals with Disabilities Education Act (IDEA). Since the Project began in July of 2012, the Legal Aid for Collier Kids Project has handled 469 cases involving at-risk children, including those who have been abused, neglected or abandoned. Children and Youth (0-19 years) Victims 6

7 Family Law Unit Description In 2013, there were 1,427 incidents of domestic violence in Collier County. Studies show 23.6% of women and 11.5% of men reported at least one episode of intimate-partner violence in their lifetime. The Legal Services to Victims ( LSTV ) Project provides safety and stability to victims of domestic violence, sexual assault, dating violence, repeat violence, elder and other abuse. The LSTV project provides free legal services to these individuals, primarily by obtaining injunctions for protection for the victims. Our attorneys also represent clients in custody and divorce matters, seeking to achieve just outcomes that improve the lives of families and children in poverty. A further objective of the LSTV Project is to promote the prevention of domestic abuse through community education and seminars, to alert the at-risk population as to their rights, best practices to secure their safety, and the resources available in the community to safeguard them. Long-Term Success Stabilizing the lives of families and victims of domestic violence or other abuse, and assisting low-income clients to secure child custody, support, visitation, dissolution and other appropriate relief. Examples of Long-Term Success Since 2010, Legal Aid Service of Collier County has handled over 895 family law cases. Target Population 1 Target Population 2 Victims Children and Youth (0-19 years) Consumer Law and Elder Law Description Public Benefits for the Elderly, Veterans, and the Disabled: Our Public Benefits Unit provides assistance to the elderly, veterans, the disabled, and others in need who are experiencing problems related to Medicaid, Medicare, Social Security Disability and SSI, Veterans Administration ( VA ) Benefits, Unemployment Compensation, Food Stamps, and other public benefits to which our clients are lawfully entitled. Our Senior Citizen Unit also provides legal advice and representation to Collier County residents who are 60 years of age or older for all general, civil legal matters. Consumer Law: Legal Aid's Consumer Law unit protects the rights of consumers by providing legal assistance to the victims of fraud, identity theft, and other deceptive practices. Legal Aid attorneys provide assistance with various consumer issues, including wage garnishment, credit and collections, identity theft, fraud, contract disputes, usury issues, insurance disputes, healthcare claims, and others. 8 Immigration Law Unit Description Long-Term Success Examples of Long-Term Success Target Population 1 Target Population 2 Legal Aid Service of Collier County s Immigration Unit provides assistance to income eligible residents of Collier County in the following areas: Immigrant victims of domestic violence, victims of human trafficking, and victims of other violent crimes, in obtaining lawful immigration status. Abused, abandoned, or neglected immigrant children in their applications for lawful permanent residence. Clients with meritorious defenses such as adjustment, cancellation, political asylum, and NACARA in removal proceedings in immigration court. We also work at family reunification through family petitions and visa practice, especially for families of farm workers. We represent applicants for Temporary Protected Status ( TPS ). To meet the most critical legal needs of Collier County residents with immigration issues, including victims of violent crimes, trafficking or other abuse, unaccompanied minors and abused or abandoned children, clients with meritorious defenses, asylum seekers, those under temporary protected status, and family reunification for eligible migrant workers. Since 2010, the Immigration Law Unit has handled 3,482 cases. Immigrant, Newcomers, Refugees Victims Housing Unit Description Collier County homeowners facing foreclosure often find themselves in a whirlwind of confusion, frustration and stress. They may immediately jump to the conclusion that they will lose their homes or face financial ruin. Homeowners have many rights and legal options of which they may be unaware. There are many alternatives to foreclosure. LASCC provides legal advice and representation for Collier County homeowners, who are in or near foreclosure, including: Providing legal defenses to foreclosure lawsuits Educating homeowners about the judicial foreclosure process Representing and assisting homeowners in mediation sessions Providing information on alternatives to foreclosure Identifying fraudulent documentation and other widespread illegal foreclosure practices Helping homeowners gain crucial time needed to work toward a solution Long-Term Success Examples of Long-Term Success Target Population 1 Target Population 2 To prevent and find alternatives to foreclosure for Collier County homeowners who cannot afford counsel, and to identify and protect clients against fraud or illegal foreclosure practices. Since 2010, Legal Aid has assisted 521 Collier County homeowners who were in foreclosure or at risk of losing their home in pre-foreclosure. Families Homeless 8

Over the next three (3) years, Legal Aid Service of Collier County has established the following goals: Leadership and Governance 1. Legal Aid Service of Collier County has the experience, capacity, community support and professional skill to meet its mission and the goals it has set for the program. Legal Aid Service of Collier County s parent organization, Legal Aid Service of Broward County, Inc., has been serving low income clients since Executive Director Anthony Karrat, Esq., has directed the program for 39 years. Legal Aid Service of Collier County s Managing Attorney, Carol O Callaghan, joined the organization in Ms. O Callaghan is a Past President of the Collier County Women s Bar Association and Past President of the Young Lawyers Division of the Collier County Bar Association. Legal Aid Service of Collier County s Director of Development and Pro Bono Coordinator, Jeffrey Ahren, joined Legal Aid in Mr. Ahren is the Co-Chairman of the Collier County Foreclosure Task Force, and Co-Chairman of the Collier County Economic Recovery Task Force. Since Legal Aid Service of Collier County was formed as a Division of Legal Aid Service of Broward County, Inc., in 2004, Legal Aid has represented well over 10,000 clients in its first decade of service to Collier County. The work of Legal Aid in Collier County has changed the lives of many and impacted the community greatly. 11 Diaz-Balart (March 25, 2013) Indicators What indicators do you use to measure progress? In 2014, Legal Aid Service of Collier County handled a record number of cases for the program 3,431. The program is growing rapidly, as in ,750 cases were handled, which at that time was record volume. The number of cases handled is only one way progress is measured. Where cases involve court appearances, outcomes are measured by the relief obtained from the Court. For example, in Family law matters, the relief obtained in Court can involve Injunctions for Protection Orders against the abuser, Child Support Orders, Temporary or Permanent Custody Orders, Dissolution of Marriage, and Orders establishing Guardianship. These outcomes are tracked in our database. For cases that involve or require advice and counsel only, the impact is furnished by providing critical legal advice to the client to meet the goals of the client. This is inherently subjective; however, detailed case notes are collected in our database. Finally, for cases that involve legal document production (such as Wills) or negotiations and resolutions prior to suit being filed, these activities are tracked and entered into the database with copies of the relevant materials retained in the files. Legal Aid evaluates all of our programs on a qualitative and quantitative basis. Quantitative measures involve objective outcomes which are tracked in each case including the number of case files opened, Court appearances and Orders, and the kind of relief granted in favor of the client by the Judges. Qualitative analysis includes reviewing whether the goals of the client or the scope of the representation has been met. These matters are set forth in the individual case files. Each Legal Aid Staff Attorney s performance is reviewed annually by Legal Aid Service of Collier County s Managing Attorney. The Managing Attorney reviews the work of all attorneys - through a review of case files and observation of them in Court or related proceedings. Legal Aid Service of Collier County prioritizes serving the most vulnerable - including children, the elderly, victims of violence and the disabled to maximize the impact of our services. Progress What have and haven t you accomplished so far? Since the economic downturn began in 2007, the demand for services from Legal Aid Service of Collier County by low income residents of Collier County has risen dramatically. Prior to 2012, Legal Aid Service of Collier County had never handled more than 2,200 cases annually. In the last two years, Legal Aid has handled 2,750 and 3,413 cases respectively. The recent local and national economic recovery has left many behind in Collier County. Per the last U.S. Census, in Collier County approximately 50,000 residents live at or below the Federal Poverty Level. Conservatively, over 70,000 residents in Collier County are eligible for Legal Aid under our program guidelines and grant terms. Legal Aid Service of Collier County has narrowed the justice gap for the poor, but a large gap remains as the need for our free legal services is still much greater than our current capacity to assist all who need counsel. Additional revenue and resources are needed to grow our program and meet this demand. 11
