2 Receive Comments On Dakota County Fiscal Year 2017 One-Year Action Plan For Community Development Block Grant, HOME Investment Partnerships, And Emergency Solutions Grant Programs Motion: Liz Workman Second: Joe Atkins WHEREAS, Dakota County is an Entitlement County for funds through the Community Development Block Grant (CDBG) Program and Emergency Solutions Grant (ESG) Program and a Participating Jurisdiction for the HOME Investment Partnerships (HOME) Program; and WHEREAS, the Dakota County Community Development Agency (CDA) administers the CDBG, ESG, and HOME programs on behalf of Dakota County, thereby requiring agreements between U.S. Department of Housing and Urban Development (HUD) and Dakota County for the CDBG, ESG, and HOME funds and between Dakota County and the Dakota County CDA for CDBG, ESG, and HOME program administration; and WHEREAS, HUD requires the development and submission of the 2017 Annual Action Plan that proposes allocation of the annual CDBG, HOME, and ESG funds to local governments and housing providers in the County; and WHEREAS, CDA staff has worked with participating communities to identify CDBG, HOME, and ESG activities for Fiscal Year (FY) 2017; and WHEREAS, the proposed activities for HUD funds meet the housing and community development priorities identified in the approved Five-Year Consolidated Plan ( ); and WHEREAS, HUD has not released the grant amounts for the three entitlement programs for FY 2017, and the draft 2017 Action Plan uses the FY 2016 approved budgets for the three programs for planning purposes; and WHEREAS, if there are changes to the budget amounts when HUD releases the final FY 2017 grant amount, the budgets will be amended as follows: the CDBG budget generally will be increased or decreased proportionally depending on any increase or decrease to the grant amount; the HOME budget will be increased or decreased proportionally depending on any increase or decrease to the grant amount, except the Community Housing Development Organization (CHDO) budget will remain at 15 percent; and the ESG budget will be adjusted as follows: an increase in funds will increase the rapid re-housing activity budget and a reduction will decrease the emergency shelter activity; and WHEREAS, the anticipated Dakota County CDBG allocation is $1,772,394; the anticipated Dakota County HOME allocation is estimated to be $631,725 (Consortium total of $1,778,761); and the anticipated Dakota County ESG allocation is $150,546 for FY 2017; and WHEREAS, CDA staff recommends funding 31 CDBG eligible activities for the 12 cities with populations of more than 10,000 with direct allocation funding; three CDBG eligible activities with competitive pool funds for cities and townships with populations of less than 10,000 and five countywide activities with FY 2017 CDBG funds; and WHEREAS, CDA staff recommends funding three HOME activities as follows: the CDA s proposed 40-unit Prestwick Place Townhomes affordable housing development in Rosemount (75 percent), unallocated CHDO project (15 percent), and administration (ten percent) with FY 2017 HOME funds; and WHEREAS, CDA staff recommends funding five ESG activities as follows: rapid re-housing activities (69 percent), emergency shelter operations (16.5 percent), costs related to the Homeless Management Information System (7 percent), and administration (7.5 percent) with FY 2017 ESG funds; and WHEREAS, HUD requires a public hearing be held to receive comments and inform the public on the 2017 One- Year Action Plan that outlines the strategies and objectives for the proposed allocation of 2017 CDBG, HOME, and ESG funds; and WHEREAS, the Notice of Public Hearing was published in the following publications on March 17, 2017: the Dakota County Tribune, the South-West Review, the Northfield News, and the Hastings Star Gazette; and the Notice was posted on the websites of the participating cities, the Dakota County CDA website at

Gaylord, the consent agenda was approved as follows: Approval Of Minutes Of Meeting Held On April 4, 2017 Items Recommended By Board Committee Authorization To Execute Contract With Hiawatha Broadband Communications To Extend Segments Of County Fiber Optic Backbone And Amend 2017 Data Networks Capital Improvement Program Budget WHEREAS, the Board of Commissioners approved an agreement to provide access to unused (dark) fiber to Dakota Electric Association for network connectivity between Dakota Electric Association headquarters and substations (Resolution No ); and WHEREAS, existing fiber segments owned by Hiawatha Broadband Communications and available to the County through contractual agreements (Resolution Nos , , and ) are needed to provide Dakota Electric Association with network connectivity between their headquarters and substations; and WHEREAS, due to Hiawatha Broadband Communications owning the fiber and Dakota County utilizing the fiber through previous agreements with Hiawatha Broadband Communications, this is a sole source situation and Dakota County must contract with Hiawatha Broadband Communications to extend these areas of the fiber optic network; and WHEREAS, Hiawatha Broadband Communications has submitted proposals to extend segments of the County s fiber optic backbone for this purpose; and WHEREAS, Dakota Electric Association will reimburse the County for construction costs and ongoing maintenance; and WHEREAS, funds for required costs are contained in the approved 2017 Data Networks Capital Improvement Program budget; and WHEREAS, Dakota Electric Association will pay $27.50 per pair, per mile, per month for an estimated $2,695 to offset the $300 monthly maintenance costs for use of an estimated 98 miles of fiber optic cable. Information Technology Director to execute a contract with Hiawatha Broadband Communications to extend segments of the County s fiber optic backbone to provide Dakota Electric Association with network connectivity between their headquarters and substations, for a total amount not to exceed $559,029, plus $300 a month for

5 Authorization To Purchase Microsoft Licensing For Client Software WHEREAS, Dakota County makes use of numerous Microsoft products in order to facilitate basic operations; and WHEREAS, Dakota County s standard computing platform is Microsoft Windows; and WHEREAS, the County s currently per-device licensing contract with Microsoft expires on April 30, 2017; and WHEREAS, it is more efficient and cost-effective to purchase licensing on Microsoft s new per-user model. Information Technology Director to execute a contract with Software House International (Minnesota State Contract #48196) for 2,012 Microsoft Secure Productive Enterprise licensing services at the G3 level for $556,515 a year for each of the next three years for a total contract amount not to exceed $1,669,545, subject to approval by the County Attorney s Office as to form Authorization To Add One Full-Time Equivalent Program Services Assistant To Support Gun Permit Duties At Western Service Center WHEREAS, the Sheriff is mandated by State Statute to process Permits to Carry for the entire County and to either issue the permit or deny it based on available evidence within a 30-day time frame; and WHEREAS, the number of applications for Permits to Carry has been increasing steadily each year, with a 19 percent increase in 2015 and a 38 percent increase in 2016; and WHEREAS, annual background checks must also be conducted on all active permit holders, which consisted of 17,759 individuals as of December 31, 2016; and WHEREAS, in an effort to maximize service to Dakota County residents, the Sheriff has been surveying individuals applying for Permits to Carry for the past ten months and they have increasingly requested Gun Permit services be made available at the Western Service Center; and WHEREAS, office space is available at the Western Service Center and the Sheriff wishes to hire an additional Level 104 Full-Time Program Services Assistant to process Gun Permit applications at the Western Service Center; and WHEREAS, funding needed to add the Gun Permit service at the Western Service Center and hiring one additional Program Services Assistant is available in its entirety from existing revenue in the Gun Permit account. NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners increases the Sheriff s Full-Time Equivalent complement by 1.0 Full-Time Equivalent for a Program Services Assistant effective April 1, 2017; and BE IT FURTHER RESOLVED, That the 2017 Sheriff s Office budget is amended as follows: Expense 1.0 FTE Program Services Assistant, Grade 104 (9 Months) $45,407 Total Expense $45,407 Revenue Use of Gun Permit Revenue Account $45,407 Total Revenue $45,407

6 Authorization To Execute 2017 Federal Transit Administration Annual List Of Certifications And Assurances WHEREAS, by Resolution No (June 21, 2016), the Dakota County Board of Commissioners authorized the County Manager to execute a Section 5310 Elderly and Disabled Assistance grant with the Minnesota Department of Transportation (MnDOT) to improve access to transportation service and public transportation alternatives to seniors, persons with disabilities, and individuals who are system involved and transportation dependent; and WHEREAS, before the Federal Transit Administration (FTA) may award federal assistance for public transportation in the form of a federal grant, cooperative agreement, loan, line of credit, or loan guarantee, certain pre-award Certifications and Assurances are required; and WHEREAS, the 2016 Certifications and Assurances were reviewed in depth by Community Services Administration contracts staff and the County Attorney s Office, and submitted to MnDOT; and WHEREAS, these Certifications and Assurances encompass a wide range of funding programs overseen by the FTA; and WHEREAS, all categories have been reviewed by staff in the Dakota County Attorney s Office and the Community Services Division Contracts Unit; and WHEREAS, it has been determined as a result of that review that Dakota County complies with the applicable terms set forth in the Certifications and Assurances. Dakota County Community Services Director and the Dakota County Attorney to execute the 2017 Annual List of Certifications and Assurances for Federal Transit Administration Grants and Cooperative Agreements in connection with federally funded projects and grants, upon the advice of the Dakota County Community Services Director and the Dakota County Attorney Authorization To Execute Restated Cooperative Agreement With Anoka, Chisago, Dakota, Hennepin, Isanti, Ramsey, Sherburne, Stearns, Washington, And Wright Counties To Add Benton And Mille Lacs Counties For Nonemergency Medical Access Transportation Services WHEREAS, in July 2004, the Department of Human Services (DHS) implemented the Minnesota Nonemergency Transportation (MNET) program to improve services and control costs; and WHEREAS, under MNET, DHS contracted with Medical Transportation Management, Inc. (MTM), a medical transportation management company (broker), to determine the appropriate level of transportation service for eligible publicly funded health care program enrollees statewide and make access transportation services (ATS) arrangements for fee-for-service enrollees in the eleven-county metropolitan area; and WHEREAS, in 2009, there was a cost shift from the state to the counties for nonemergency medical ATS, and 2009 Legislative action transferred the administration and coordination of ATS from the State to counties in the eleven county metropolitan area effective July 1, 2009; and WHEREAS, by Resolution Nos (June 22, 2010), (October 15, 2013), (October 20, 2015) and (December 13, 2016), the County Board authorized a Cooperative Agreement between Hennepin County and the other metropolitan counties choosing to participate in this arrangement that allowed Hennepin County to be reimbursed for the administrative services the broker provides for a period covering July 1, 2010 through December 31, 2020; and

7 WHEREAS, a Cooperative Agreement is required in order for the participating counties to reimburse Hennepin County for Dakota County s share of the administrative costs. Community Services Director to execute the Restated Cooperative Agreement with Anoka, Chisago, Dakota, Hennepin, Isanti, Ramsey, Sherburne, Stearns, Washington, and Wright Counties to add Benton and Mille Lacs Counties for the provision of nonemergency medical access transportation services for eligible Medical Assistance and MinnesotaCare recipients effective upon approval by all counties, and shall continue through December 31, 2020, unless extended by some or all of the Metropolitan Counties, subject to approval by the County Attorney's Office as to form Authorization To Accept Additional Family Support Grant Funds From Minnesota Department Of Human Services And Amend 2017 Adopted Budget WHEREAS, the State of Minnesota s Department of Human Services recognizes the additional care that families provide to meet the needs of their children with disabilities; and WHEREAS, the Family Support Grant program s goal is to prevent or delay out-of-home placement of children, and to promote family health and well-being by providing access to additional services and supports; and WHEREAS, the Minnesota Department of Human Services revised the allocations of Family Support Grant funds for lead agencies which resulted in Dakota County receiving $600,000, which is a percent increase (an additional $133,853) for the purpose of providing grants to families to pay for services or items that are directly related to caring for the child with a disability through December 31, 2017; and WHEREAS, staff has identified needs in Dakota County that could be supported with these additional grant dollars. NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioner authorizes the Community Services Director to accept the additional $133,853 in 2017 grant funds for a total of $600,000, from the Minnesota Department of Human Services; and BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners approves the acceptance of the additional grant funds and an amendment to the 2017 Adopted Budget as follows: EXPENSE Social Services Budget $133,853 TOTAL EXPENSE $133,853 REVENUE Grant Funding Source $133,853 TOTAL REVENUE $133, Authorization To Execute Memorandum Of Understanding Between People Incorporated, Suburban Metro Area Continuum Of Care, And Dakota County For Projects For Assistance In Transition From Homelessness Program And Amend 2017 Adopted Budget WHEREAS, homelessness for persons with Serious Mental Illness (SMI) in Minnesota remains a significant problem, and the State and local homeless counts identify a high prevalence of persons with SMI who are homeless; and

8 WHEREAS, the Projects for Assistance in Transition from Homelessness (PATH) program started in 1991 to support homeless outreach in Minnesota; and WHEREAS, starting in 2017, the Minnesota Department of Human Services (DHS) is granting funds directly to service providers; and WHEREAS, People Incorporated was selected by DHS as the service provider designated to receive funding to serve Dakota County residents for a grant period of January 1, 2017 through June 30, 2018; and WHEREAS, DHS requires a Memorandum of Understanding between the service provider (People Incorporated), the Local Mental Health Entity (Dakota County), and the Continuum of Care (CoC) for purposes of implementing the PATH program. Community Services Director to execute a Memorandum of Understanding with People Incorporated and the Suburban Metro Areas Continuum of Care, to implement the Projects for Assistance in Transition from Homelessness program effective upon date of execution through June 30, 2018, subject to approval by the County Attorney s Office as to form; and BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby approves an amendment to the 2017 Adopted Budget as follows: REVENUE PATH Grant ($49,900) TOTAL REVENUE ($49,900) EXPENSE PATH Grant ($49,000) TOTAL EXPENSE ($49,900) Authorization To Accept Additional Grant Funds From Minnesota Department Of Human Services, Execute An Amendment To Grant Contract For Respite Services For Individuals With Autism, Amend 2017 Adopted Budget, And Provide A Progress Update WHEREAS, there is a growing recognition of the need for a range of services including respite care that specifically address the needs of individuals with autism spectrum disorder (ASD) and related conditions; and WHERES, the Minnesota legislature approved a one-time appropriation of $2.5 million for the purpose of increasing in-home and out-of-home respite program development for adults and children with ASD through June 30, 2017; and WHEREAS, the Minnesota Department of Human Services (DHS) released a request for proposal (RFP) for qualified grantees to provide respite services for individuals with autism on November 16, 2015, with a due date of December 24, 2015; and WHEREAS, by Resolution No (January 19, 2016), the Dakota County Board of Commissioners ratified Dakota County s submission of a grant application to DHS in response to the RFP to develop respite services for individuals and families with ASD in the amount of $479,700 per year; and WHEREAS, by Resolution No (June 21, 2016), the Dakota County Board of Commissioners authorized adding 2.0 Full-Time Equivalents to the Social Services Department, contingent on availability of grant funds, acceptance of grant funds from DHS, and execution of the grant contract in an amount not to exceed $1,000,000 during the contract term of July 12, 2016 through June 30, 2018, or until all obligations set forth in the grant

9 contract have been satisfactorily fulfilled, whichever occurs first; and WHEREAS, the Social Services Department hired two Full-Time Equivalent in August 2016 to facilitate fulfilling grant contract deliverables; and WHEREAS, based on the grant activity progress to date, DHS has made available an additional $100,000 to Dakota County to support additional purchase of services to support individuals and families with ASD to access needed respite programs and support; and WHEREAS, Dakota County has identified needs in Dakota and Ramsey counties that could be supported with additional grant dollars. NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioner hereby authorizes the Community Services Director to accept the additional $100,000 in grant funds from the Minnesota Department of Human Services, and execute the grant contract amendment in an amount not to exceed $1,100,000 during the contract term, or until all obligations set forth in the grant contract have been satisfactorily fulfilled, whichever occurs first, approved by the County Attorney s Office as to form; and BE IT FURTHER RESOLVED, That the Community Services Director is hereby authorized to amend said grant contract, within the amount budgeted, to alter the types of services provided, grant contract term, and grant contract amount, consistent with County contracting policies, subject to approval by the County Attorney s Office as to form; and BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby approves the acceptance of the additional grant funds and an amendment to the 2017 Adopted Budget as follows: REVENUE Autism Spectrum Disorder Grant $100,000 TOTAL REVENUE $100,000 EXPENSE Autism Spectrum Disorder Grant Purchase of Services $100,000 TOTAL EXPENSE $100, Authorization To Amend 2017 Social Services Adopted Budget To Add Child Protection Performance Revenue And Provide Update On Child Protection Services WHEREAS, Dakota County received an allocation in 2016 of $1,139,200 for child protection staff and services; and WHEREAS, these child protection funds represented 80 percent of the potential allocation to Dakota County, the additional 20 percent retained contingent upon child protection staff meeting two performance thresholds; and WHEREAS, Dakota County child protection met both performance thresholds to receive the retained 20 percent of the County s child protection allocation for 2016; and WHEREAS, Dakota County received additional performance funds redistributed from the allocations to counties not achieving the performance measures; and WHEREAS, the additional performance allocation totaling $433,397 was received in February 2017 for the 2016 performance; NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby amends the 2017 Adopted Budget as follows:

10 REVENUE Child Protection Performance $433,397 TOTAL REVENUE $433,397 EXPENSE Child protection Performance, Program Expenses $433,397 TOTAL EXPENSE $433,397 April 18, Authorization To Accept Conservation Partners Legacy Grant And Execute Contract With State For Jensen Lake Phase II Oak Woodland And Savanna Enhancement Within Lebanon Hills Regional Park WHEREAS, the 2008 Minnesota Constitutional Legacy Amendment increased State sales tax and dedicated new revenue to natural resources, clean water, arts, cultural heritage, and parks and trails; and WHEREAS, the Conservation Partners Legacy (CPL) Grant Program was established to restore, enhance, or protect forests, wetlands, prairies, and habitat for fish, game, and wildlife; and WHEREAS, the Minnesota Department of Natural Resources (DNR) manages this program, and, in State fiscal year 2017, $6,850,000 was dedicated to habitat projects located within the seven-county metropolitan area; and WHEREAS, on January 24, 2017 (Resolution No ), the County Board authorized the Physical Development Director to submit CPL grant applications for natural resource projects in Lebanon Hills Regional Park; and WHEREAS, on March 15, 2017, the DNR selected the Jensen Phase II project within Lebanon Hills Regional Park for CPL funding totaling $257,400; and WHEREAS, this project consists of 112-acres of oak woodland and oak savanna restoration with an estimated total project cost of $300,300; and WHEREAS, staff recommends County Board approval to accept and execute the CPL grant funding for Lebanon Hills Regional Park. 11 WHEREAS, the 2008 Minnesota Constitutional Legacy Amendment increased State sales tax and dedicated new revenue to natural resources, clean water, arts, cultural heritage, and parks and trails; and WHEREAS, the Conservation Partners Legacy (CPL) Grant Program was established to restore, enhance, or protect forests, wetlands, prairies, and habitat for fish, game, and wildlife; and WHEREAS, the Minnesota Department of Natural Resources manages this program, and, in State fiscal year 2017, $6,850,000 was dedicated to habitat projects located within the seven-county metropolitan area; and WHEREAS, on January 24, 2017 (Resolution No ), the County Board authorized the Physical Development Director to submit CPL grant applications for natural resource projects in Lebanon Hills Regional Park; and WHEREAS, on March 15, 2017, the DNR selected the Dakota Lake project within Lebanon Hills Regional Park for CPL funding totaling $221,000; and WHEREAS, this project consists of 65 acres of oak woodland and oak savanna restoration with an estimated total project cost of $249,650; and WHEREAS, staff recommends County Board approval to accept and execute the CPL grant funding for Lebanon Hills Regional Park. 13 between regional greenways around Lebanon Hills Regional Park; and WHEREAS, the County Board authorized a contract by Resolution No (October 20, 2015), with Hoisington Koegler Group, Inc. to prepare the Central Greenway Connectivity Study; and WHEREAS, a technical advisory committee was formed consisting of staff from Dakota County and cities around Lebanon Hills Regional Park; and WHEREAS, on February 23, 2017, the Dakota County Planning Commission recommended that the draft Central Greenway Connectivity Study be released for public review. release of the draft Central Greenway Connectivity Study for a public review and comment period commencing March 21, Authorization To Execute Consultant Contract For Dakota County Pedestrian And Bicycle Plan WHEREAS, as part of the State Health Improvement Program (SHIP 4), one of Dakota County s strategies is creating healthy and active communities by increasing opportunities for non-motorized transportation (walking and biking); and WHEREAS, the SHIP 4 work plan, approved by Resolution No (August 25, 2015), allocates funding to Dakota County and cities within the county in the form of subgrants for projects that foster active living; and WHEREAS, by Resolution No (March 22, 2016), the County Board authorized direction of SHIP 4 funding for the Dakota County Pedestrian and Bicycle Plan; and WHEREAS, the Pedestrian and Bicycle Plan will guide the County s future investments in non-motorized transportation and recommend bicycling and walking policies, strategies, and best practices to be considered in the Dakota County 2040 Transportation Plan update; and WHEREAS, the plan will: position Dakota County for regional grant funding by identifying county priorities/routes for the Regional Bicycle Transportation Network; prioritize bike-walk improvements on county roads; ensure continuity of the pedestrian-bike network across municipal boundaries; and identify funding sources and partnership opportunities; and WHEREAS, the nine-month planning process will occur in in three phases: inventory and analysis; development of the pedestrian and bicycle system; and recommendation of supporting policies, strategies, and best practices; and WHEREAS, Dakota County s request for proposals received two responses which included firms with pedestrian and bicycle planning expertise; and WHEREAS, based on team qualifications, experience in preparing pedestrian and bicycle plans in communities similar to Dakota County, approach, and competitive fees, Alta Planning + Design s proposal was ranked the top proposal by the selection committee made up of representatives from County Staff and Dakota County Cities; and WHEREAS, Staff recommends the selection of Alta Planning+ Design for the Pedestrian and Bicycle Plan; and WHEREAS, the approved 2017 SHIP 4 Budget includes $45,000 appropriated to the Pedestrian and Bicycle Master Plan; and the adopted 2017 Transportation Capital Improvement Program Future Studies/Professional Services set aside contains $65,000 for the project; and the contract will be based on a not-to-exceed fee of $106,174.

County Attorney Authorize Execution Of Joint Powers Agreement With Metropolitan Library Service Agency WHEREAS, in 2005, Dakota County entered into an joint powers agreement (JPA) with the Metropolitan Library Service Agency (MELSA), pursuant to which Dakota County authorized MELSA employees to participate in Dakota County s benefits program and authorized MELSA to obtain employee relations, payroll, and legal services from Dakota County; and WHEREAS, the JPA between Dakota County and MELSA was extended in 2013; and WHEREAS, the JPA between Dakota County and MELSA expired on December 31, 2016, although Dakota County has continued to provide services to MELSA to the present time; and WHEREAS, Dakota County desires to continue providing these services and MELSA desires to receive them. Board Chair to execute a joint powers agreement with MELSA, for the period of January 1, 2017, through December 31, 2019, to provide employee benefits, payroll, employee relations, and legal services to Metropolitan Library Service Agency, substantially as presented on April 18, 2017, subject to approval of the County Attorney s Office as to form Authorization To Execute Agreement With Thomson Reuters For Electronic Legal Research Resources WHEREAS, ongoing access to electronic legal research resources is essential for County Attorney s Office staff to efficiently manage cases and provide legal advice to the County Board and County departments; and WHEREAS, in 2014, the County Board authorized the County Attorney s Office to execute a three-year contract with Thomson Reuters for electronic legal research resources and tools to meet the legal research needs of County Attorney s Office staff; and WHEREAS, the Thomson Reuters resources and tools have proven to be cost effective and provides the best value to the County Attorney s Office after taking into account discounts to the cost of all hard copy resources the Office purchases from Thomson Reuters during the term of the new contract; and WHEREAS, Thomson Reuters is willing to execute a new three-year agreement with the County Attorney s Office for its products and services, and apply a 50 percent discount to the cost of all hard copy books purchased by the County Attorney s Office from Thomson Reuters during the term of the contract. 15 Consulting And To Amend 2017 Information Technology Consulting Budget WHEREAS, the Information Technology (IT) Department has over 100 projects in its portfolio, but only three fulltime project managers on staff; and WHEREAS, IT entered into an initial contract with Talent Software Services, Inc. for Sajla Koul s project management services for $44,500 to manage key enterprise projects such as the OneSolution Easy Payment Request Form and Online Payment Portal projects; and WHEREAS, the County needs to implement a new release of the OneSolution Enterprise Resource Planning (ERP) system; and WHEREAS, the OneSolution 16.2 release is a large, complex project that requires a highly skilled project manager with financial background and experience in managing ERP implementations; and WHEREAS, Talent Software Services employee, Sajla Koul, has strong financial background and experience in managing ERP implementations; and WHEREAS, IT needs to extend the contract with Talent Software Services, Inc. for Sajla Koul s project management services through the end of December 2017 to complete the OneSolution 16.2 release; and WHEREAS, the contract amendment will cost an additional $189,000, to be billed at an hourly rate of $105, for a total contract amount not to exceed $233,500; and WHEREAS, funds in the amount of $78,972 are contained in the approved 2017 IT Consulting Budget and the remaining funds of $110,028 will be available within the 2017 Operations, Management and Budget (OMB) Division Budget Incentive Plan. 16 WHEREAS, the use of a Homeless Management Information System (HMIS) is required by HUD for all recipients of certain federal funds, including ESG; and WHEREAS, a limited number of staff from Dakota County and the Dakota County Community Development Agency (CDA) are currently licensed to use HMIS to collect client data and data on the provision of housing and services to homeless individuals and families and persons at risk of homelessness; and WHEREAS, the funding of HMIS through the ESG Program is currently not listed as an approved activity in the 2015 and 2016 Action Plans, though it is an eligible use of ESG funds; and WHEREAS, HUD requires all recipients of certain federal funds, including ESG, to use HMIS to collect client data and data on the provision of housing and services to homeless individuals and families and persons at risk of homelessness; and WHEREAS, HUD also requires the use of HMIS to manage the required Coordinated Entry system; and WHEREAS, the use of ESG funds to pay for the costs of purchasing HMIS user licenses will use a federal resource to pay for a federally mandated reporting process; and WHEREAS, Dakota County and CDA staff recommend creating the HMIS activity in the 2015 and 2016 ESG Programs and funding it with a budget of $10,511 ($5,256 from Fiscal Year (FY) 2015 and $5,255 from FY 2016); and WHEREAS, public notice of the substantial amendments was placed in the Dakota Tribune on March 10, 2017 and also on the Dakota County and CDA websites, in accordance with the approved Citizen Participation Plan process; and WHEREAS, no public comments were received on the proposed amendments. NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby approves the substantial amendments to the 2015 and 2016 Emergency Solutions Grant Programs Approval Of Amendments To 2015 HOME Investment Partnerships Program Year Budget WHEREAS, the Dakota County Community Development Agency (CDA) administers the HOME Investment Partnership Program (HOME) for Dakota County; and WHEREAS, three types of substantial amendments to the HOME Program are permissible by the U.S. Department of Housing and Urban Development (HUD): the creation of a new activity or cancellation of an existing activity with no funds expended; the increase or decrease of an activity budget by $100,000 at one time; and a change to the location and/or national objective or beneficiaries of an activity; and WHEREAS, the HOME Program requires that 15 percent of a jurisdiction s HOME allocation be used for eligible HOME activities by nonprofit organizations that qualify as a Community Housing Development Organization (CHDO); and WHEREAS, the CDA requests substantial amendments to the Program Budgets in the 2015 Action Plan for the allocation of $245, of HOME CHDO funds to the Community Action Partnership of Ramsey and Washington Counties activity; and WHEREAS, the Community Action Partnership of Ramsey and Washington Counties activity includes the acquisition and rehabilitation of two rental units in Forest Lake, Washington County; and

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby approves the substantial amendment to the HOME Program Budget in the 2015 Actions Plan for the allocation of $245, of available HOME Community Housing Development Organization funds to the Community Action Partnership of Ramsey and Washington Counties activity in Forest Lake, Washington County Authorization To Amend And Restate Joint Powers Agreement With City Of Inver Grove Heights For Right Of Way Acquisition, Construction, And Maintenance And Authorization To Amend Budget On County Project WHEREAS, Dakota County and the City of Inver Grove Heights are partnering on County Project (CP) 63-25; and WHEREAS, CP is the realignment and reconstruction of County State Aid Highway (CSAH) 28/63 (Argenta Trail) to a four-lane divided highway from its connection with CSAH 28 (Yankee Doodle Road) to Amana Trail, including the realignment of 77th Street West and the extension of Amana Trail; and WHEREAS, the County is the lead agency for CP right of way acquisition and construction; and WHEREAS, the Transportation Capital Improvement Program (CIP) budget includes $15,700,000 for the design, right of way acquisition, and construction of CP 63-25; and WHEREAS, on December 16, 2014 (Resolution No ), the County Board approved the application of CP for federal funding as part of the 2014 Metropolitan Council Regional Solicitation; and WHEREAS, CP was not awarded federal funding as part of the 2014 Metropolitan Council Regional Solicitation; and WHEREAS, on April 7, 2015 (Resolution No ), the County Board authorized execution of a joint powers agreement (JPA) for CP with the City of Inver Grove Heights for right of way acquisition, construction and maintenance; and WHEREAS, in 2016, the Metropolitan Council had additional funding available, and CP was awarded federal funding in the amount of $4,972,995; and WHEREAS, the Transportation CIP shall be amended to accept the federal funds and release the previously budgeted State aid funds; and WHEREAS, CP was awarded State funding of $425,000 for the signal upgrade at the intersection of Trunk Highway (TH) 55 and CSAH 28/63, and the funding required the execution of a cooperative agreement with the Minnesota Department of Transportation; and

18 WHEREAS, the cooperative agreement included language about the signal maintenance for the intersection of TH 55 and CSAH 28/63; and WHEREAS, amending and restating the JPA with the City of Inver Grove Heights is necessary to outline roles, responsibilities, and cost participation for CP Physical Development Director to execute an amended and restated joint powers agreement with the City of Inver Grove Heights for right of way acquisition, construction, and maintenance for County Project and for the reimbursement of costs by the City of Inver Grove Heights to Dakota County, in accordance with the cost sharing policies in the current Dakota County Transportation Plan, subject to approval by the County Attorney s Office as to form; and BE IT FURTHER RESOLVED, That the Transportation Capital Improvement Program budget is hereby amended as follows: Revenue State Aid Funding ($4,972,995) Federal Funding $4,972,995 Total Revenue $ Authorization To Execute Joint Powers Agreement With City Of Eagan For Eastbound Left Turn Lane Extension At County State Aid Highway 30 And Braddock Trail For County Project WHEREAS, to provide a safe and efficient transportation system, the County is the lead agency partnering with the City of Eagan on County Project (CP) 30-34; and WHEREAS, CP includes the extension of the eastbound left turn lane at the intersection of County State Aid Highway (CSAH) 30 (Diffley Road) and Braddock Trail; and WHEREAS, the extension of the eastbound left turn lane will provide approximately 350 feet of additional storage for traffic and will reduce the potential of rear-end collisions along this high speed roadway; and WHEREAS, CP is anticipated to be included in the County s overlay contract with construction scheduled for summer 2017; and WHEREAS, the adopted 2017 Transportation Capital Improvement Program includes funding for Safety and Management Projects; and WHEREAS, a budget amendment will be necessary, but will be deferred until contract award, to transfer funding from the Safety and Management Projects to CP and to account for the revenue from the City of Eagan; and WHEREAS, a joint powers agreement with the City of Eagan is recommended to outline cost participation and responsibilities for design, construction, and maintenance associated with CP Physical Development Director to execute a joint powers agreement with the City of Eagan for the design, construction, and maintenance responsibilities associated with the eastbound left turn lane extension for County Project and for the reimbursement of costs by the City of Eagan to Dakota County, in accordance with the adopted County cost sharing policies, subject to approval by the County Attorney s Office as to form.
