Govt reveals priority projects Implementation of the Standard Gauge Railway (SGR) project and procurement of four new airplanes are among priority areas highlighted by the 2017/18 budget proposal presented by Finance and Planning Minister Philip Mpango recently. Dr Mpango told members of parliament in Dodoma that implementation of the SGR project will start this fiscal year and that the Government has allocated 800 billion/- for it in this year s budget while procurement of the airplanes would cost million US dollars. He said the first of the four airplanes will be delivered in July 2017, two airplanes will be delivered in June, 2018 and the fourth airplane is due in the country in July, The priority projects are special as they are expected to have huge impact on the economy in line with the country s 2025 Development Vision, said the minister. He added that while implementation of the Dar to Morogoro portion of the SGR project would start this year, processes Procurement Opportunities 3 are going on to secure funds and contractors for construction of the SGR portions from Morogoro to Mwanza, namely Morogoro to Public Notices 5 Makutupora (336 km), Makutupora to Tabora (294 km), Tabora to Isaka (133 km) and Isaka to Mwanza ( 249 km). Finance and Planning Minister Philip Mpango Govt orders contractor to speed up Chalinze water project The Government has ordered the contractor undertaking a water supply project in Chalinze, Coast region, to speed up the work or face termination of his contract. The contractor, Overseas Infrastructure Alliance (OIA) Pvt, who had faced a severe reprimand from President Magufuli recently over delay of another water project in Lindi Region, has so far done only 23 percent of the work on a project which was supposed to be completed in February this year. Irked by the delay when he visited the project site recently, Prime Minister Kassim Majaliwa directed the minister responsible for water, Eng. Gerson Lwenge, saying: if [the contractor s] work is shoddy and he fails to complete at least 80 percent of the project by May 31, 2017, you will have to proceed with contract termination procedures so that a process to find a new contractor for the project is initiated. The Prime Minister reiterated that the Government would not entertain incompetent contractors and those who fail to meet contractual obligations. Earlier, Managing Director of Chalinze Water Supply and Sanitation Authority, Eng. Christer Mchomba, had told Mr. Majaliwa: The contractor has been given a 100-day notice to expedite implementation of the project, failure of which we will terminate the contract, adding that the Government had also charged the contractor liquidated damages for the delay in implementation of the project. According to Eng. Mchomba, the contractor had already been paid US dollars million or 38 percent of total contract sum for the project, expected to serve 68 villages upon completion. Uamuzi uliotolewa na PPAA ulieleza kuwa Geci Espanola, iliwasilisha malalamiko ikipinga uamuzi wa TCAA wa kuiengua katika hatua ya awali ya uchambuzi wa zabuni ya ununuzi wa rada na kwenye mchakato wa zabuni hiyo. Kampuni hiyo ilikuwa na madai manne mojawapo likiwa kwamba TCAA haikuipelekea maelekezo ya nyongeza yaliyowataka wazabuni kuongeza idadi ya wataalam zaidi ya wale waliokuwa wameainishwa kwenye nyaraka za awali, ambao wangefundishwa utumiaji wa rada katika kuongoza ndege. Aidha, Geci Espanola S.A iliilaumu TCAA kwa kutokutumia fursa iliyokuwa imetolewa kwenye nyaraka kuomba ufafanuzi juu ya mpangilio wa nafasi za waongoza ndege kama walishindwa kuelewa maelezo yaliyokuwa katika zabuni yake. Mlalamikaji pia alilalamikia kitendo cha TCAA kuzikataa screen za UHD alizotaka kuleta, bila kujali maelezo yake kwamba hizo TAARIFA KATIKA TARAKIMU zilikuwa bora kuliko za LCD zilizokuwa zinatakiwa na TCAA. Pamoja na mambo mengine, mrufani alilalamika kwamba TCAA ilikosea ilipokataa zabuni yake kwani ilikuwa imetoa bei ndogo kuliko zote zilizofunguliwa siku ya kufungua zabuni na kwamba uamuzi wa kupendekeza utoaji wa tuzo ya mkataba kwa kampuni iliyotoa bei kubwa kuliko yake ulikiuka matakwa ya sheria ya manunuzi ya umma na msingi wa thamani bora ya fedha. Ikijibu malalamiko, TCAA ilisema kuwa nyongeza ya maelekezo iliyodaiwa kutomfikia mrufani, ilitumwa kwake kupitia anwani za barua pepe za watumishi wake watatu. Anwani hizo pia zilitumika katika mawasiliano mengine yote yaliyofanyika kutuma na kupokea taarifa mbalimbali, TCAA iliongeza. Hivyo, TCAA ilidai, madai ya mrufani hayakuwa ya kweli na kwamba kitendo cha kutojumlisha idadi ya wataalam walioongezeka kutokana na nyaraka husika ilikuwa ni ukiukwaji wa maelekezo yaliyokuwamo kwenye nyaraka za zabuni. TCAA pia ilieleza kuwa maelezo ya mlalamikaji yalionesha wazi kuwa hakuelewa maelekezo ya nyaraka za zabuni kwani pamoja na kutoeleza mpangilio wa nafasi za waongoza ndege, alisema kuwa angetoa vifaa vinavyofanana kwa nafasi zao zote bila kutofautisha, kinyume na maelekezo. Aidha, TCAA ilisema kulikuwa hakuna sababu ya kuomba ufafanuzi kutoka kwa mrufani juu ya alichoandika kwani kilieleweka vizuri kwa kamati ya uchambuzi wa zabuni. Kuhusu screen, TCAA ilimjibu mrufani kwamba alitakiwa kuzingatia maelezo ya kitaalam katika nyaraka za zabuni ambayo yalihitaji screen za LCD na si vinginevyo na kwamba halikuwa suala la mzabuni kuleta chochote alichotaka hata kama aliamini kuwa kilikuwa bora. Hata hivyo, TCAA ilikuwa na sababu nyingi za kuhitaji screen za LCD pamoja na kwamba ilifahamu kuwa screen za UHDzipo sokoni. TCAA iliendelea kusema kuwa bei ndogo ya zabuni haikuwa kigezo cha kupewa tuzo ya mkataba na kwamba zabuni ambayo haikuzingatia maelekezo ya nyaraka za zabuni haiwezi kupewa tuzo. Baada ya kupitia maelezo ya pande zote mbili, PPAA iliridhika kuwa TCAA ilituma nyongeza ya maelekezo kupitia barua pepe za watumishi watatu ambao walifahamika kwa mrufani. Aidha, PPAA ilibaini kuwa, kwa nyakati tofauti wakati wa mchakato wa zabuni, watumishi hao waliwasiliana na TCAA na kwamba anwani hizo hizo zilitumika kumpatia mrufani taarifa za matokeo ya mchakato wa zabuni. PPAA iliamua kuwa malalamiko ya Geci Espanola S.A kutopata nyongeza ya maelekezo hayakuwa na ukweli. Kuhusu mpangilio wa nafasi za waongoza ndege, PPAA ilikubaliana na TCAA kuwa nafasi hizo hazifanani na kwamba mahitaji ya kila nafasi yalikuwa tofauti. PPAA ilibaini kuwa maelezo ya mrufani katika jambo hili yalipingana na matakwa ya nyaraka za zabuni. Kuhusu uwasilishaji wa screen za UHD badala ya zile za LCD, PPAA ilibaini kwamba nyaraka za zabuni zilielekeza kuwa screen za LCD ndizo zilizotakiwa na kwamba kitendo cha mrufani kutaka kuleta zile za UHD kilikuwa ni mbinu tu za biashara na hivyo ilikuwa sahihi kwa TCAA kuzikataa. Kuhusu bei, PPAA ilieleza kwamba madai ya mrufani yalikuwa mapya kwani hayakuwahi kuwasilishwa TCAA kabla, kinyume na matakwa ya sheria ya manunuzi ya umma. PPAA iliridhika pasi shaka na maamuzi yaliyotolewa na TCAA ya kumuengua mrufani katika mchakato wa zabuni yalikuwa sahihi. Hivyo, rufaa hiyo ilitupiliwa mbali kwa kukosa mashiko na PPAA iliamua kuwa kila upande ubebe gharama zake za rufani. 250,000 Kiasi cha fedha katika shilingi ambacho taasisi nunuzi inatakiwa kulipa kama gharama ya kuchapisha tangazo la fursa ya zabuni kwenye Procurement Journal? Contribution of research and training institutions in public procurement By Prof. Sylvia Temu, Board Member - PPRA 1. Introduction It is important to appreciate that research activities are a solid basis for developing future oriented interventions especially in training and skill provision processes. This commentary aims at subscribing to the famous idiom No research no right to speak. In the just ended 9th East African Procurement Forum (EAPF) held in Kigali Rwanda, the participants received a notable presentation of the paper that addressed the subject matter in the case of Uganda. Readers are advised to visit the PPRA website for the full version of the paper. 2. The Basis of Commentary The paper brought to light generic challenges to the education provision and research undertaking regarding public procurement especially issues surrounding a view that much effort is wasted on theory rather than practice. Areas such as little understanding of the public procurement legal framework including relevant acts and regulations, tender evaluations, contract management, due diligence conduct for contractors and suppliers, inadequate soft skills were brought to light. The paper also touched issues of ethics, public private partnership, post contract management and the promotion of local firms in public procurement. The paper did well in highlighting what needs to be done in Uganda and which other public procurement regulatory bodies in the region could emulate to address current and future education and skills needs in the profession. It is important to have inventory of who is doing what in terms of public procurement training to help the development of appropriate interventions. 3. Drivers of Impactful Contribution from Training Institutions on the Public Procurement In order for training institutions to have impactful contribution on the PP some issues must be addressed, in particular i. Who is to be trained? ii. What is the content? iii. Quality of trainers iv. Beyond the classroom Continuous professional development Readers are invited to enrich the following discussion on the four issues and to propose actionable points. 3.1 Training on public procurement for who? The general aim of training institutions is to create human capital in public procurement that will enable both the public and private sectors to discharge public procurement functions effectively and efficiently. Training institutions should therefore be able to honestly answer the fundamental question about the relevance of their training, namely are they addressing the needs? In particular, Are they preparing people in the best possible manner to meet the public procurement national and regional needs? Are the needs known? When last were the training needs in public procurement identified, consolidated and validated? Were all stakeholders consulted in determining needed knowledge and skills? The collaboration between training institutions and practitioners in public procurement sector cannot be underscored in this regard for the users know best what the deficiencies are as well as the future needs. 3.2 What are the Contents of Training Provision of knowledge and skills is about preparing a learner to manage better the future and its challenges. We all must recognize that training, if done well, prepares the learner to appreciate the need for solving immediate challenges but also to expound their horizons to appreciate the world with wider lens and deeper thinking so as to solve more complex challenges. In public procurement, the training curricular should as the minimum address the knowledge and skills mismatch that are currently being experienced and those possible in the future. Relevant questions to the professionals as well as to training institutions are: i. How are the contents determined? ii. To what extent are the professionals and practitioners, including the PP regulatory bodies, involved? iii. Are there benchmarked curricular in PP and if they are, are they being used in all training institutions that train on PP? iv.if there are no benchmarks isn t this the right time to do so at least for the East African region? Of course, one does appreciate that there are generic curricular which are most probably being adapted and thus approved by relevant bodied. But the context and nature of challenges in our East African Community region must be addressed and thus the criticality of having benchmarked curricular for the region on public procurement. My humble submission would be for the regulatory and professional bodies in PP to promulgate the minimum standard content that must be covered at different levels of training to serve as the point of entry into the profession and these to be adapted by all the training institutions running academic and professional training programes on public procurement. The mastery of the fundamental and the underpinning principles in public procurement together with the prevailing legal framework i.e. public procurement acts and regulations, exposure into the implementation tools and expose into the future contemporary issues in PP should be made mandatory for instance at bachelor s degree level. Accreditation and benchmarking of training programs should not be at national/regional level only but the aspiration should be international so that procurement experts become globally recognized. Furthermore, to make training practical and to enable trainees to resonate with the specific countries context, training materials need to be context specific as well. Herein I recommend the development of contextualized training materials and accumulation of home-grown case studies within EAC partner states for classroom teaching to facilitate simulated training. In the 9th Forum, the delegates were enriched by the case of a 50-km long Thika Road construction in Kenya as well as Kigamboni Brigde in. There are certainly many more successful but also flawed cases from which to draw insightful lessons, good scalable and replicable practices and mistakes to avoid. 3.3 Who are the Trainers Training processes and its eventual outcomes are greatly influenced by quality and not only technical qualifications of trainers, which is principally a function of the trainers have the tacit competencies to deliver the training packages. Competencies here mean knowledge, skills, attitude and behavior that one need to train a public procurement professional to get ready into actual delivery of the professional service as expected. The paper presented by the Ugandan researcher during the 9th EAPF identified several shortfalls on the side of the trainers specifically on the pedagogy, professional practice and exposure deficiencies on the trainers side as well as inadequate or virtually lack of hands-on experience for the trainers themselves. These inadequacies cannot be undermined or neglected in any professional training process and call for immediate interventions and the most feasible approach is synergetic and collaborative efforts in addressing the highlighted shortfalls. Furthermore it is not sufficient that one acquires one-time training, the regulators and professional need also consider the necessity of coming up with a mandatory continuing professional development (CPD) which will be monitored and both trainers as well as practitioners attend and clock in hours that provide evidence of CPD. In the same vein training institutions should open their doors to the practitioners to participate in different forms in the training processes such as providing public lectures, discussion of case studies, serving as examiners especially at post graduate level to mention only a few. A dialogue needs to be initiated by key players in the public procurement industry for the purpose achieving of effective training outcomes and thus impactful contribution on public procurement outputs. 4. Research In as far as research is concerned, I would be unfair if I do not underscore the criticality of carrying out research in this very important sector. Considering that substantial expenditure of the government budget every year takes place through public procurement, every serious researchers would really wish to conduct research in all the attendant issues that are being brought to light by the reports from regulatory authorities, Controller and Auditor General, media, citizens to actually find out the root causes of problems, good practices to emulate and upscale, replicate and horn the trainees on; all for the achievement of value for money in procurement. My quick thinking here is that researchers in our institutions of higher learning have a very fertile ground for research in this discipline. However for researches to deliver again value for money they would definitely need to be carried out collaboratively between researchers in universities and practitioners, for the focus is to resolve prevailing challenges but also future needs in the profession and emerging issues that as countries and the region we need to get prepared on. 5. Conclusion I must say that we all want to be part of success and not be counted as one of the odd in the development of the profession. I thus call for attention and debate of the few issues raised in this submission. In our discussions we should not forget that the most research (Inter- University Council of East Africa, 2014) on the quality of our university graduates in the region revealed shocking inadequacies in soft skills i.e. communication, work ethics and attitude, problem-solving and analytical skills, team work among others. These are skills that must be inculcated in preparing our young people in all levels of training in addition to the technical skills. Additional point for discussion paper; a) Mandatory engagement of lectures from higher learning institution as individual consultants during conduct of procurement compliance and value for money audits will enrich their practical knowledge of the industry hence assist them in delivering right knowledge; b) Support from the government in terms of financial resources to assist lecturers to conduct research and studies on PP.
