2 Dear Fundraiser, Thank you for your interest in fundraising for the Australian Paralympic Committee (APC). The APC relies heavily on the support of community groups and individuals like you to help us develop and nurture Paralympic sport in Australia. The countdown is now on until the London 2012 Paralympic Games and the Sochi Winter Games in 2014! Our Aussie athletes are training harder than ever and have their sights set on qualifying for the Paralympic Team. Your financial support is vital to the APC as we strive to raise funds to send our athletes to these upcoming Games. We need to raise more than $7 million to send the Australian Paralympic Team to London in 2012, and $3 million to send the Team to Sochi in Since the first Paralympic Games were held in Rome 1960, Australian Paralympic Teams have amassed a spectacular 987 medals and with your support our athletes will aim to increase this tally in London. The following Guidelines are designed to assist you in planning your fundraising activities in support of the APC. Please read the following guidelines and complete the fundraising application form, before returning it to the APC for approval. 3 Section One: About the Australian Paralympic Committee The APC is a not for profit organisation and is the principal sporting organisation in Australia for athletes with a disability. We help Australians with disabilities participate in sport and compete at the Paralympic Games through partnerships with governments, business, sporting bodies and the community. We are responsible for preparing the Australian Paralympic Summer and Winter Teams for the Paralympic Games, which we have done successfully since At the 2008 Beijing Paralympic Games, Australia was placed fourth on the overall medal tally with 23 gold, 29 silver and 27 bronze medals out of 147 countries. The APC develops and nurtures Paralympic Sport in Australia and delivers community programs in the area of sport, education, classification and rehabilitation. We help identify potential Paralympians through the Paralympic Talent Search Program and assist athletes to prepare for competition by providing funding for coaching, equipment and travel in the lead up to the Summer and Winter Paralympic Games. We believe participation in sport provides positive social and physical benefits to people with disabilities, and plays an important role in changing community perceptions of people with disabilities. Through the Paralympic Education Program powered by Telstra, we have educated over 320,000 Australian school children about Paralympic sport and the importance of inclusion of people with disabilities. 3 Paralympic athletes are elite athletes who are inspiring role models. The APC is a leader in Australian sport and its programs connect Australians through Paralympic Sport. At the heart of what we do is our athletes, who strive to compete at an elite level, upholding the ideals of the Paralympic movement.

4 Section Two: Fundraising for the Australian Paralympic Committee Thank you for your interest in fundraising for the Australian Paralympic Committee. These guidelines are designed to assist you with your fundraising efforts. They outline the approval process; your responsibilities as the Fundraiser; the APC s responsibilities as the nominated beneficiary of your fundraising; and provide a framework to ensure that both parties are complying with the relevant legislation. The Australian Government has developed legislation governing the conduct of fundraising. Under the Charitable Fundraising Acts in each state, anyone wishing to raise money for charitable purposes must hold an authority to fundraise. The process to obtain this permission is detailed in section three. The fundraising proposal, including fundraising, raffles, financial / record management and event management, must be conducted in your (the Fundraisers) name and is the Fundraisers sole responsibility. While we appreciate your support, we are unable to take on management coordination of a proposal, such as selling tickets or organising prizes. As an APC Fundraiser you must abide by all National/ State/Territory charities legislation and apply for permits that may be required. Copies of permits must be sent to the APC prior to your fundraising event. Please visit the Australian Government Website on Non-profit organisations for information page=1&h1 4 Fundraisers are not APC employees or representatives. Fundraisers undertake all fundraising activities on their own behalf and at their own risk. All aspects of financial and public liability and public safety are the responsibility of the Fundraiser. By applying to fundraise for the APC, the Fundraiser agrees to release the APC to the fullest extent permissible under law for all claims, except where such liability arises because of the negligence of the APC or its agents.

5 Section Three: The approval process All events that raise funds for the Australian Paralympic Team need to be authorised by the APC prior to the event being promoted or held. The process to be authorised as an APC Fundraiser is detailed below: 1. Read and ensure you understand these guidelines, if you have any questions please contact the APC fundraising team on Complete the APC Offer to Fundraise Form and send it back to the APC fundraising team using one of the following methods: Post: Australian Paralympic Committee PO Box 596 Sydney Markets NSW Fax: Our Fundraising team will then review your form and may contact you to discuss your application further before reaching an outcome. This process usually takes 5-10 days from the date we receive your application. 4. We will advise you in writing or over the phone with regards to the outcome of your application. If your fundraising event is approved we will issue you with a formal Authority to Fundraise letter. This constitutes an agreement, whereby the terms and conditions outlined in this document will be binding for you. Until you receive the formal Authority to Fundraise you are not an authorised APC Fundraiser and must not promote the APC as the beneficiary of your fundraising efforts. 5. The APC must be notified of any changes from the original proposal outlined in the Offer to Fundraise Form. Changes may affect the Authority to Fundraise that has been issued and a new Offer to Fundraise Form may need to be completed. The APC reserves the right to withdraw Authority to Fundraise at any time. 5 If your proposed fundraising event is of a physical endurance nature (e.g. hand cycling from Sydney to Melbourne), please include with your application a detailed event plan. This event plan should provide details on the timing, duration, route, support team, risk alleviation strategy, insurance, budget and experience. If your proposed fundraising has a Cause-Related Marketing aspect, please contact the APC Fundraising Coordinator on , prior to completing the offer to fundraise form. Please note: If you anticipate that your Cause-Related Marketing will exceed $20,000 per year, a licensing agreement must be entered into between your organisation and the APC.

6 Section Four: The use of APC s name and/or logo The Fundraiser must explain to supporters that funds are being raised for the APC as opposed to being raised by the APC, and this must be promoted clearly. The APC cannot be part of the title of your event for example Australian Paralympic Committee Bingo Night. Suggested wording for referring to the relationship between the fundraising event and the APC would be: Proudly supporting the Australian Paralympic Committee Funds raised are used in the preparation of Australian Paralympic Team for London 2012! This is a volunteer run event raising money for the Australian Paralympic Committee If you wish to use the APC s logo on any materials or products you must send copy of the logo usage to the APC and obtain prior written permission from the APC to use the logo prior to production. All printed materials and any usage of APC images and the terms Paralympic and Paralympian must be sent to the APC for written approval prior to production or distribution. Approval requests can be sent to the APC Fundraising Coordinator at fundraising@paralympic.org.au 6

7 Section Five: Financial aspects of your fundraising event It is a legislative requirement that Fundraisers keep a record in writing of the fundraising activity. The record must contain: a. The purpose of the activity b. The Fundraiser s full name and address and the authority under which the event was held; and c. An accurate statement showing full details of all income and expenditure associated with the activity and of the disposal of all such monies and property. The financial aspects, record keeping and management of the fundraising proposal are entirely the Fundraiser s responsibility. The Fundraiser must comply with any obligations imposed by their state legislation, rules or regulations. For more information on your state requirements please visit m&page=1&h1 Funds raised from the event must be returned to the APC within 14days from its conclusion unless otherwise agreed The Fundraiser must take all reasonable steps to ensure that expenses do not exceed 40% of the gross proceeds of the activity unless the APC agrees in writing that the expenses are a fair and reasonable proportion of the gross proceeds 7 The Fundraiser must not incur any expenses in the name of the APC. Individual receipts for tax deductions for supporters of the fundraising activity can be issued by the APC if a supporter makes a donation of $2.00 or more to the APC. If supporters would like a receipt, please record their details using the APC donation register available online. Please note: a tax-deductible receipt cannot be issued to a supporter when they have received goods or services for money (e.g. purchased a raffle ticket or a prize at auction). If you received donated goods and services for the fundraising activity, the APC requires correspondence from the company or individual stating the donated value of the goods or services. This assists the APC with financial reporting and issuing thank you letters.

8 Section Six: Sponsorship The APC has a number of corporate partners, sponsors, suppliers and supporters that support the organisation. These companies already provide generous contributions to the APC and we ask that you do not approach them for further support: Australian Sports Commission Telstra WorkCover NSW Toyota Qantas 2XU Clayton Utz Media Monitors Ernst & Young Allianz PwC R.M. Williams Speedo Scody Fundraisers that choose the APC as the beneficiary of their event are unable to engage in sponsor partnerships with any individuals/organisations that fall into any of the below categories due to ethical reasons and potential APC brand implications. Tobacco related sponsorship; Where the probability exists that the potential sponsor may seek to use the sponsorship agreement to gain undue influence; Events which duplicate or compete with existing APC sponsorship projects; Sponsorships that are projects which are likely to adversely affect the content or interpretation of the APC programs or services or may raise a conflict of interest; A political party or a religious event; Partnership with an organisation who does not meet community standards in regards to good taste. 8 Should you have any questions or require any further information, please contact the APC Fundraising Coordinator on or at fundraising@paralympic.org.au.
