4 CM /1579/1580 (FEDERAL Series) CM /1583/1584/1585 (STATE Series) RFP/SSE No Indefinite Quantity Staffing Services for Miscellaneous Projects Short Scope of Work MTA New York City Transit ("NYCT") for itself and on behalf of the other MTA Agencies, as required, (hereinafter the "Authority") is seeking to retain the services of approximately five (5) firms to provide staffing services on miscellaneous construction projects on an "as-needed" task order basis to supplement in-house staff. The work shall include various disciplines across a multitude of construction and related projects. Job Shoppers are typically assigned to work at various NYCT and other Metropolitan Transportation Authority ("MTA") facilities within the five boroughs ofnew York City. The primary purpose of this contract shall be to provide the NYCT Department of Capital Program Management ("CPM") and other participating MTA Agencies with professional and technical staff with specific skills, as described in a Work Order Request for Proposal, to fill vacancies and augment project staff on an as-needed basis

5 CM-1576, 1577, 1578, 1579, 1580 (FEDERAL Series) CM-1581, 1582, 1583, 1584, 1585 (STATE Series) RFP/SSE No Indefinite Quantity Staffing Services for Miscellaneous Projects PROPOSAL EVALVAnON CRITERIA Proposals shall be evaluated by a "Selection Committee" composed of NYCT and TBTA personnel experienced in the disciplines necessary to evaluate the proposal submissions. NYCT intends to make awards to approximately five firms. Two contracts, one federal and one State will be awarded to each firm. In addition to the evaluation criteria listed below, only a responsible Proposer will receive an award. To be considered responsible, the Proposer must demonstrate to the satisfaction ofnyct that it is in all respects a responsible party; this determination encompasses consideration of the Proposer's integrity, skill, experience, necessary facilities, and financial and other resources to do the work in accordance with the Contract Terms and Conditions. Committee members will base tbeir evaluation on tbe criteria listed below, wbicb are listed in their relative order of importance. CRITERION #1 - Overall Tecbnical Qualifications, to include such matters as: (a) Proposer's knowledge, experience, and demonstrated ability to satisfactorily perform the work associated with providing temporary professional and technical staff, as stated in the scope of work. Proposer must demonstrate that they have, or presently are, satisfactorily performing generally similar work and possess the capability to recruit, screen, conduct background checks and refer qualified candidates. Proposer should provide a minimum ofthree verifiable references. (b) Proposer's technical qualifications will include number of years providing temporary professional/technical staffing consultant services, as demonstrated by a list of major accounts serviced; and length oftime proposed key personnel have been with the Proposer. Proposer should state the number ofyears they have provided each resource type or service. (c) Proposer should demonstrate that they have a large Database of Resumes of qualified Professionall Technical Personnel available; and they have an ability to quickly provide qualified personnel in one or more Program Areas, whenever there is an emergency. (d) Proposer's management approach and the appropriateness and responsiveness ofthe proposal. (e) Recruitment method and the firm's policies to assure retainage of personnel

6 CRITERION #2 - Proposed Pricing for the Work - Mark-Ups, Renewal Fee and Finder's Fee The Cost Proposal must be submitted in a separate sealed envelope. CRITERION #3 - Other Relevant Matters as follows: Quality ofwritten proposal- Adequacy and completeness ofthe proposal with regard to the overall requirements ofthe work and all matters called for by the RFP. Quality of oral presentation, if any; Compliance with, and acceptance of, the terms and conditions or willingness to negotiate same in a timeframe consistent with the needs ofnyct and TBTA. NYCT reserves the right to: reject all proposals submitted; require revisions to, corrections of, other changes to any proposal submitted as a condition to its being given any further consideration; reject, without entertaining revisions, a proposal with major substantive deficiencies; negotiate with Proposers considered most qualified by the Selection Committee; negotiate with one Or more Proposers in any manner it deems fit. In making the determination as to which proposal offers the greatest value to the Authority, the Authority will review all factors that contribute to the total cost ofthe proposal, including costs which may be incurred by the Authority as a result ofthe proposal even ifthose costs are external to the proposed price. In making the determination as to which proposal is most advantageous and offers the best value to the Authority, the Authority will review the proposals in relation to all evaluation criteria. Accordingly, neither the Proposer with the highest technical ranking, nor the Proposer with the lowest priced proposal, will necessarily receive the award, which will be determined by assessment of the best value to the Authority based upon all the evaluation criteria. Although price is not the most important evaluation criterion for this solicitation, price may become the controlling factor when competing proposals are otherwise determined to be substantially equal
