2 ITLOS-(KFA): DOALOS is the implementing office Legal basis: UNGA resolution 55/7 & Agreement on Cooperation and Relationship between the UN and ITLOS of 18 December 1997 Who: Financial assistance to States parties to UNCLOS What: *For Expenses incurred in connection with cases submitted, or to be submitted, to ITLOS, including Seabed Disputes Chamber/other Chambers *Applications should describe the nature of the case and provide an estimate of the costs for which financial assistance is sought and contain a commitment to supply a final statement of account of expenditures made, to be certified by an auditor acceptable to the UN. ITLOS-(KFA) [Continued] How/When: *For cases proceeding on the merits/where jurisdiction is not an issue/exceptionally, any phase of the proceedings; *Panel of 3 experts, established by the UN S-G, to make recommendations on each application (examine application, recommend to the S-G the amount of financial assistance to be awarded, the phase/phases of the proceedings in respect of which assistance is to be given/types of expenses for which assistance may be used, e.g., pleadings, counsel fees, expenses and travel to ITLOS during phases of the case, etc.) CLCS Trust Funds [2] Legal basis: under UNGA resolutions 55/7 ( 30 October 2000) and 58/240 (23 December 2003) Who/What: *(i) CLCS members from developing States - for defraying the costs of participation in the meetings of CLCS *(ii) For States to prepare their submissions -to provide training for technical and administrative staff, and technical and scientific advice, as well as personnel, to assist developing States, in particular the least developed countries and small island developing States, for the purpose of desktop studies and project planning, and preparing and submitting information under article 76 and annex II to the Convention in accordance with the procedures of the Scientific and Technical Guidelines of the Commission on the Limits of the Continental Shelf. - How/When: (i) For CLCS meetings an internal matter with DOALOS (ii) Applications sent to DAOLOS and reviewed by a Panel of Experts 2

Importance of voluntary financial contributions (States, IGOs, national institutions, NGOs, and natural and juridical persons) Assistance Fund established under Part VII of the United Nations Fish Stocks Agreement Established under Part VII of the Agreement, pursuant to General Assembly resolution 58/14 Purpose: Provide financial assistance to developing States parties to the Agreement to assist in the implementation of the Agreement Administered by FAO, in cooperation with DOALOS Assistance Fund established under Part VII of the United Nations Fish Stocks Agreement Financial assistance may be sought for the following purposes (para. 14 of the Terms of Reference): Participation by developing States parties, in particular by LDCs and SIDs, in meetings of RFMO/As and relevant high seas fisheries-related meetings; Negotiations to establish new RFMO/As, renegotiate RFMO/A founding agreements, and strengthen existing RFMO/As Building capacity in key areas Facilitating exchange of information and experience Human resources development, technical training and technical assistance Meeting the costs of dispute settlement proceedings 3
