City of Pierz CALL TO ORDER AND INTRODUCTIONS Chair Kroll called the meeting to order at 9:30 a.m. and introductions were made. APPROVAL OF JANUARY 12, 2017 MEETING MINUTES Motion by Mr. Petersen, second by Mr. Heilman, to approve the January 12, 2017 meeting minutes with no changes or additions. The motion passed unanimously. FY 2017 FY 2020 LOCAL FEDERAL PROJECT UPDATE Mr. Howieson provided ATP-3 with an update of the Local Federal projects included in the FY 2017 FY 2020 State Transportation Improvement Program (STIP). o Local Federal program Projects are proceeding well. Most of the plans have been forwarded to MnDOT s Central Office (CO) and the remaining plans should be sent soon. There is a right of way issue on the St. Joseph s project (S.P ), which may cause a delay. If necessary, the Lake Wobegon Trail project (S.P ) will be swapped with the St. Joseph s project. 2 o Highway Safety Improvement Program (HSIP) A high majority of the plans have been forward to CO and some are out for bids. Several of the projects have been overestimated for the Federal funds resulting in $450,000 over the target amount. Mr. Howieson has identified projects that could be advanced to 2017 in order to use these funds. Motion by Mr. Kimman, second by Mr. Heilman, to authorize the District 3 State Aid Engineer to advance the identified HSIP projects to FY 2017 in order to use the remaining HSIP FY 2017 funds. The motion passed unanimously. o DEMO Plans for the project in Princeton (S.P ) have been forwarded to CO. The Cuyuna Lake Trail (S.P ) is continuing to move forward. The final materials plan has been approved by MnDOT. FY 2018 FY 2020 FEDERAL FUNDING INCREASE UPDATE At the January ATP-3 meeting, it was approved to have the District 3 State Aid Engineer work with local jurisdictions to review programmed projects in the STIP that would benefit from the additional funds targeted to ATP-3 to bring them up closer to the 80/20 percent ratio. Review of the ATP-3 projects to receive the additional funding for FY 2018 FY The funds were prorated from FY 2018 FY 2020 and split to each Region based on the sub-targets. FY 2019 the funds will be distributed to Baxter s Cypress Drive project (S.P ). All of the funds have been distributed. GREATER MN HIGHWAY SAFETY IMPROVEMENT PROGRAM (HSIP) FALL 2016 SOLICITATION ANNOUNCEMENTS Mr. Mason reported to ATP-3 members the Office of Traffic, Safety and Technology had announced the projects selected from the September 2016 solicitation for FY 2018 FY He noted ATP-3 received $5.7 million in funding for the Locals and District 3. The suggested awards for ATP-3 were: FY $1,243,951; FY $1,265,738; FY $781,650; and FY $2,408,818. Each Region had projects selected. The breakdown for the period included: 3 projects in the St. Cloud APO; 12 projects in Region 5; 2 projects in Region 7E; and 6 projects in Region 7W. District 3 had four projects selected from the September 2016 solicitation totaling $2,155,000. The suggested awards for the District were: FY $400,000; FY $1,125,000; and FY $630,000. These projects will be included in the upcoming STIP. REVIEW FY 2018 FY 2021 STATE TRANSPORTATION IMPROVEMENT PROGRAM (STIP) FUNDING GUIDANCE Mr. Voss reviewed the STIP Guidance for FY 2018 FY There are five principal programs in the guidance that directs the distribution of federal funds to MnDOT Districts and the ATPs for developing the Draft Area Transportation Improvement Programs (ATIP). They include: o Statewide Performance Program (SPP) MnDOT District funding used to meet pavement and bridge condition targets on the National Highway System (NHS). Needs determined in collaboration with MnDOT Specialty Offices. o District Risk Management Program (DRMP) MnDOT District funding. More flexible than SPP. District can fund projects on the non-nhs routes and provide funding for District setasides. o ATP Managed Program Federal Surface Transportation Block Grant Program (STBGP) funds provided under FAST Act for use on local system. Projects determined through ATP led project solicitation and selection process. o Highway Safety improvement Program (HSIP) Administered through MnDOT s Office of Traffic, Safety and Technology MnDOT Districts and Local Agencies. o Transportation Alternatives (TA) Program Local Federal funding for projects determined through ATP led project solicitation and selection process. Under the new FAST Act, TAP is now called the Surface Transportation Program Block Grant (STPBG) Setaside. Central MN Area Transportation Partnership 04/06/2017 Minutes Page 2

3 o Mr. Voss reiterated the local federal funding increases under the ATP Managed Program previously reported under the FY 2018 FY 2020 Federal Funding Increase Update agenda item. The ATP-3 increases were as follows by year: FY 2018 Increase of $600,00 - $8.6 million available; FY 2019 Increase of $900,000 - $9.1 million available; FY 2020 Increase of $1.4 million - $9.6 million available; FY 2021 No Increase - $9.6 million available. Transportation Alternative (TA) funds remained at $1.6 million/year. ATP-3 HSIP Funds were increased as shown below: o FY 2018 Increase of $200,000 - $2.8 million available; o FY 2019 Increase of $300,000 - $2.9 million available; o FY 2020 Increase of $400,000 - $3 million available; o FY 2021 No increase - $3 million available. MnDOT did not receive increases in their SPP and DRMP funding. The state funds received are less but additional federal funds are being received so the funding remains about the same. District 3 s HSIP funds were also increased. AREA TRANSPORTATION IMPROVEMENT PROGRAM (ATIP) DEVELOPMENT COMMITTEE DRAFT FY 2018 FY 2021 ATIP RECOMMENDATIONS Mr. Voss and Mr. Mason presented the ATIP Development Committee s funding recommendations for FY 2021: Draft FY 2021 Local ATP Managed Program FY 2021 Transit projects were not included in the recommendation based on MnDOT s decision that rural transit would be funded centrally. Review of the ATIP Development Committee recommendation to ATP-3 approving the FY 2021 Locally- Sponsored Transportation Projects by Region for ATP Managed Program funding as shown on Attachment 1. Draft FY 2021 Local Transportation Alternatives Program The 14-member TA Committee reviewed and scored the 16 TA applications. The Committee met on March 1 to review and technically score the applications to develop a recommendation to the ATIP Committee. The scores were averaged to determine a composite score. Regional significance points were added to each applicant s score and regional equity points were added to Region s 5 and 7E s No. 1 ranked projects. No other Region had regional equity points to award. Review of the TA Committee s FY 2021 TA funding recommendation to the ATIP Committee, which included the following two options. o Option 1: Award funding to the following projects: Rank #1 - ROCORI Trail Construction Board s project ($750,000); Rank #2 - City of Mora s project ($249,400); and Rank #3 - City of Pierz s project ($560,667). Recommend the remaining $39,933 be offered to the City of Big Lake (TA Committee s 5 th ranked project) because there was insufficient funding available to cover the minimum 30 percent federal funding requirement necessary for programming the City of St. Cloud s project, which is the TA Committee s 4 th ranked project. This recommendation is contingent upon the City of Big Lake s acceptance of the lower amount. o Option 2: Fund the top three ranked projects as listed above. In the event that the City of Big Lake does not accept the reduced amount, the remaining balance would be distributed to the ROCORI Trail Construction Board s project. o It was noted that the City of Big Lake was contacted and agreed to accept the reduced award under Option 1. o In preparation for the ATIP Committee meeting, an error was discovered on the spreadsheet used by the TA Committee for determining project awards. It was discovered that the total project cost amount ($560,667) for the City of Pierz s project was used instead of the City s requested federal TA funding Central MN Area Transportation Partnership 04/06/2017 Minutes Page 3

4 amount ($448,534). This change resulted in an additional $152,066 being available versus the $39,033 previously thought. o In taking steps to correct this error, staff reviewed the TA Committee s rankings to determine if the new funding amount of $152,066 was sufficient to consider the City of St. Cloud s project. To be eligible, the City of St. Cloud would need a minimum $177,000 (30 percent of $590,000) based on the project s total eligible cost. Since the project does not meet this threshold, staff recommended funding the City of Big Lake s project (Rank #5) at 80 percent ($89,796), leaving $62,270 available for other projects on the list. Staff reviewed the other projects on the list for their eligibility. It was determined none of the projects met the minimum 30 percent federal programming requirement or ATP-3 s minimum technical score of 60 points to qualify them for programming. The ATP-3 Operations and Policy Manual does not allow applicants to change the scope or termini for their project in order to receive remaining funding. o Discussion by the ATIP Committee took place on how to distribute the remaining $62,270. ATIP Committee members discussed the following options: Placing funding in a setaside to be used in next year s solicitation Recommending funding be used on FY 2020 TA funded projects if not already funded at the full 80/20 percent ratio. Adding additional funding to the TA Committee s recommended FY 2021 projects: Rank #1 ROCORI; Rank #2 City of Mora, and Rank #3 City of Pierz. o Recommended not allocating additional funding to projects already funded at the 80/20 percent ratio for fear that doing so could result in lost federal funds if the project comes in under budget. Instead, the ATIP Committee is recommending awarding the remaining funds to ROCORI since their project had a total cost of $1,663,863 and could have requested $800,000 vs. the $750,000 in the application. o The ATIP Committee also discussed whether there was a need for additional guidance in the ATP Operations and Policy Manual to allow the ATIP Committee broader discretion in dealing with situations when there is remaining TA funding and no other qualifying projects to be awarded the funding after applying various policies and practices in the ATP Operations and Policy Manual. As an example, this includes being able to fund applications for more than the applicant s requested amount or for carrying over the funding as a setaside to be used in future solicitations. The ATIP Development Committee s is recommending to ATP-3 to approve awarding the FY 2021 TA funds as shown on Attachment 2. MnDOT District 3 FY Trunk Highway Construction Program Mr. Voss reviewed MnDOT District 3 s FY FY 2021 trunk highway construction program as shown on Attachment 3. As a result of savings on projects due to low bids received, there were several projects that were advanced and/or upscoped. It was noted that the Legislature approved the request for additional budget authority so the $105 million in additional funds provided to Minnesota under the FAST Act can now be authorized. This affected four projects in District 3 s FY 2017 construction program. Projects in District 3 s FY program will be integrated into the Draft FY FY 2021 STIP document. Draft document to be submitted to MnDOT s Central Office by April 15. Motion by Mr. Cruikshank, second by Mr. Cochran to approve Attachments 1-3 subject to any technical changes that are needed as part of the finalization of the Draft ATP-3 FY 2018 FY 2021 ATIP. The motion passed unanimously. UPDATE ON FY 2021 TRANSIT CAPITAL FUNDING REQUESTS Office of Transit asked staff to present information back to the Regions. Mr. Voss reviewed the ATP-3 FY 2017 FY 2022 Transit requests that will be funded centrally but would have come through the Regions in the past. 5 Office of Transit is trying to be more aggressive on expansion and replacement. Discussion on the status of transit funding requests returning to the ATPs. ATP POLICY AND PROCESS REVIEW/ISSUES Mr. Mason presented proposed language changes to the ATP-3 Operations and Policy Manual. The revisions pertain to the TA Development section and would reflect changes to the FY 2021 solicitation. The ATIP Committee is recommending the following revision: o If TA funds remain available after following the previously established procedures and processes, the Committee has discretion in proposing alternatives involving the programming of remaining TA funds. Proposed alternatives are not to supersede the previously established procedures and processes set forth in the manual. Discussion on the proposed revision. The revision would not change: o Requirement to receive TA funding, a project application must receive a TA Committee average technical score of 60 or higher, which does not include equity or regional significance points; o Applicants being asked to accept a lesser federal share cannot re-scope the project to better fit the available funding amount. o The Committee s recommendation is being presented to ATP-3 for approval and potential revision. Motion by Mr. Backowski, second by Mr. Kimmel to approve the following revision to the ATP-3 Operations and Policy Manual, under the TA Development Section, beginning with the FY 2021 solicitation: If TA funds remain available after following the previously established procedures and processes, the Committee has discretion in proposing alternatives involving the programming of remaining TA funds. Proposed alternatives are not to supersede the previously established procedures and processes set forth in the manual. The motion passed unanimously. ATP-3 S TARGET FORMULA DATA/METHODOLOGY FOR REGIONAL DISTRIBUTION OF FEDERAL FUNDING UNDER MNDOT S ATP MANAGED PROGRAM ATP-3 is studying the ATP-3 s current distribution of the target formula, which was adopted in MnDOT s distribution formula has changed three times since Information was shared with ATP-3 members at the January meeting. The proposal was tabled for further discussion at the ATP-3 s April meeting to allow the information to be shared with the Regions. It was noted that further analysis was still needed to determine the split between Region 7W and the St. Cloud APO. The proposal was discussed by the ATP-3 members. Upon consensus, it was determined to not move forward with the proposal. ATP-3 members directed staff to update the policy manual removing the language that refers to the distribution of the funding based on system size/system use as the original data used in the formula is dated and no longer consistent with MnDOT s current distribution formula. ATIP Committee will be meeting over the summer to review scoring criteria, processes for the TA solicitation. Any proposed changes to the process would be presented to ATP-3 at the October meeting prior to the next TA solicitation period. It was determined that the total project cost amount ($560,667) for the City of Pierz's project was used instead of the City's requested Federal TA funding amount ($448,534). Under Option 2, the TA requested amount was used. This change resulted in the in an additional $152,066 being available versus the $39,033 previously thought. The new available amount was still insufficient to consider the City of St. Cloud's project, which needed $177,000 or minimum 30% federal funding to be eligible for programming. Since the St. Cloud project did not meet the programming threshold, the ATIP Committee is recommending to fund the City of Big Lake at its full TA requested amount ($89,796). The remaining balance of $62,270 would not meet the 30 percent Federal request for any of the other remaining projects so the ATIP Committee is recommending the balance be added to the ROCORI Trail Phase 3 project since this application did not request the full ATP-3 allowed requested amount and was overmatched locally. ** Remaining balance would not meet the 30% Federal request amount.
