1 One Gateway Plaza Los Angeles, CA C metro.net REGULAR BOARD MEETING SEPTEMBER 23,2010 SUBJECT: ACTION: "HOT SPOTS" FEASIBILITY STUDY AND PROJECT STUDY REPORTS (PSRs) APPROVE RECOMMENDATIONS RECOMMENDATIONS Authorize the Chief Executive Officer to: 1. Award and execute Contract No. PS , for professional services to prepare a Feasibility Study to RBF Consulting, for an amount not to exceed $7,162,058. In the event we cannot reach an agreement with the recommended proposer, we will proceed to the next highest evaluated proposer; 2. Approve and exercise up to three options for preparation of Project Study Reports (PSRs) for three selected projects following the successful performance of the Feasibility Study, in an amount not to exceed $6,300,000; and 3. Award and execute contract modifications for up to $1,200,000. RATIONALE At its June 24, 2010 meeting, the Board received a status report on the preparation of Scope of Work (SOW) and cost estimates for the Hot Spots Feasibility Study and PSRs. Staff released a Request for Proposals (RFP) for the preparation of a Feasibility Study and three optional PSRs on July 30,2010. On the August 30,2010 submittal deadline, staff received five proposals. The proposals were evaluated and teams were interviewed by LACMTA, Caltrans and Gateway Cities Council of Governments representatives. The evaluation team recommended RBF Consulting as the contractor who presented consistently strong credentials across all the disciplines requested in the RFP. With successful negotiation and execution of the Contract, the notice to proceed will be given to the selected team for the Feasibility Study.
2 BACKGROUND The Gateway Cities Council of Governments (GCCOG) completed an Initial Corridors Study in 2008 that identified several chronic traffic congestion areas, "Hot Spots", along the corridor; however the feasibility of proposed improvements has not been examined in detail. Pursuant to the findings of the Initial Corridors Study, Measure R designated $590 million (unescalated) for mainline, ramp and interchange improvements within the Gateway Cities/Southeast portion of the County. The purpose of this Feasibility Study is to further analyze congestion improvement alternatives for the various "Hot Spots" already identified in previous studies, in addition to others that may be identified through the analysis. The initial alternatives for congestion "Hot Spots" will include improvements to freeway to freeway interchanges, additional general purpose lanes, and arterial improvements. Conceptual geometric plans, costs estimates, and a preliminary environmental review will be prepared for each of the "Hot Spots" projects. The Feasibility Study is expected to be completed in one year. Based on the results of previous studies, it is expected that upon completion of the Feasibility Study up to three of the "Hot Spots" projects will be ready to advance to the next phase of project development. PSRs will be prepared for up to three highpriority projects selected from the identified "Hot Spot" locations. These PSRs will be executed as contract options, to be completed within a year of the completion of the Feasibility Study. FINANCIAL IMPACT Funding of $10.5 million is included in the FY11 budget in Cost Center 4710 (Highway Capital), Account (Services ProfessionallTechnical). Since this is a multi-year project, the cost center manager and the Executive Director of Highway Programs will be responsible for project budgeting in future years. Impact to Bus and Rail Operating and Capital Budget The source of funds for this project will be from Measure R 20% Highway Funds. No other sources of funds were considered as these have been identified for this project. These funds are not eligible for bus and rail operating and capital expenditures. ALTERNATIVES CONSIDERED Two alternatives were considered: (1) Utilizing LACMTA staff to conduct the study This alternative is not recommended because LACMTA does not have the freeway and roadway design expertise to conduct a study of this magnitude. (2) Not authorizing the CEO to negotiate, award and execute the consultant contract - Staff is not recommending this alternative because the Project is included in the 2009 Long Range Transportation Plan and reflects a broad-based consensus of local jurisdictions. Approval to proceed with the Feasibility Study and PSRs is consistent with the goals of Measure R "Hot Spots" Feasibility Study Page 2

Background on Contractor RBF Consulting Alton Parkway Irvine, CA RBF Consulting (RBF) is a full service planning, engineering, survey and construction management firm that has worked on behalfoflocal and regional agencies and directly for Caltrans for over 25 years. RBF has played a significant role in the development ofthe expansive transportation network in Southern California on projects such as the Riverside County-Orange County Major Investment Study; SR-91 Corridor Improvement project; design-build ofthe SR-241 toll road and the 1-5/1-405 Interchange at the El Toro "Y". RBF offers a comprehensive range ofprofessional planning, engineering, urban design, environmental and public outreach services for highways and transit networks. RBF has been servicing the transit industry since Currently based in Irvine, California, RBF will be opening a Los Angeles office in October This is the first time RBF has submitted a proposal in response to a Metro Request for Proposals. However, RBF, coupled with the expertise ofits core team ofurs Corporation, Iteris, Inc. and InfraConsult LLC, is qualified for this proj ect. The entire team is multidisciplinary with expertise in many fields oftransportation planning, modeling and design. RBF has also successfully served the Orange County Transportation Authority (OCTA) for the past 20 years through the entire duration ofocta's original Measure M Highway Capital Improvement Program on 20 separate projects and the launch ofthe Renewed Measure M2 Program. RBF is well-versed in the needs of a transportation authority client in getting a massive highway program initiated effectively and efficiently. B. Procurement Background The Request for Proposal (RFP) is a standard Architect & Engineering (A&E), qualifications based, negotiated competitive procurement; pursuant to the Brooks Act, where cost is not a factor. In the event we cannot reach an agreement with the recommended Proposer, we will proceed to the next highest evaluated Proposer and continue the process until an agreement is reached. Metro Board ofdirectors received a status report on the preparation ofthe scope ofwork and cost estimates for the project at its June 24,2010 meeting. The contract type will be Firm Fixed Price. 7 C. Evaluation ofproposals The proposal evaluation was conducted in accordance with Metro Procurement Policy and Procedures. The source selection committee conducted a comprehensive technical evaluation, including oral discussions. Each proposal is considered responsive to the project and submittal requirements. Based on the evaluation criteria stipulated within the RFP solicitation requirements, RBF Consulting received the highest ranking ofthe five responsive proposals received. D. Cost/Price Analysis Explanation ofvariances The recommended Not-To-Exceed price of$7,162, for the feasibility analysis will be determined fair and reasonable based upon the Management Audit Services pre-award audit, cost analysis, independent cost estimates, a fact find, negotiations and an extensive technical review.
