1 Architects Association of New Brunswick INFORMATION BULLETIN November 2013 It has been some time since the AANB has issued an Information Bulletin to the members regarding association activities. Some information was provided at the Annual Meeting however, not all members were present and additional progress has been made on some items since then. As always should any member wish to discuss any of the issues presented further, please do not hesitate to contact the AANB office at your convenience. AANB COUNCIL With the October 4 th, 2013 annual meeting, AANB Council for is comprised of: Denis Nadeau, AANB, MRAIC President Darroch M. White, AANB Vice President Brent V. Wuest, AANB Councillor Austin Durbin Intern Representative INTERNS BECOME NEW REGISTERED MEMBERS At the Annual Meeting three new Members, who successfully completed their Internship in Architecture Program, were presented their membership certificate and welcomed as Registered Members of the AANB. Welcome new registered members: J. Robertson Bateman Neil Bauman André Boudreau Moncton, NB Saint John, NB Moncton, NB NEW AANB WEBSITE! The AANB will soon be launching a new web site! Those who attended the annual meeting were given a sneak preview of what the new site will look like. One new feature is the Firm Profile option. Firms are able to provide a brief overview of their Firm and the services they offer. A link to their own Practice web site will also be offered. 2 Page 2 CONTINUING EDUCATION (CE) REMINDER Just a reminder that we are well into Cycle Six of our mandatory CE program. This two year Cycle, which began on July 1 st, 2012, will end on June 30 th, 2014 at which time all registered members are required to obtain: 15 CORE hours of learning 55 SELF DIRECTED hours of learning CORE activities must fall into the following categories in order to be eligible: National Building Code Heritage Buildings/Restoration LEED Workshops and Accreditations Practice Management Project Management Risk Management Starting Your Own Practice Sustainable Design/Green Architecture Architectural Culture In January, members will be receiving notification of their current CE status and advising them of the six month deadline to comply (June 30 th, 2014). MEMBERSHIP RENEWALS By now, members and would have received their 2014 membership and certificate of practice renewals (if applicable). Please ensure your completed renewal forms and payment, are received by the AANB office no later than December 31 st, Save trees! Submit your completed forms electronically to aanb2@nb.aibn.com and follow with your payment in the mail. Just a reminder that if you are opting not to renew you must: Submit a formal letter of resignation to the AANB for Council approval. If applicable, return your certificate of practice seal to the association office with written confirmation that your firm has no projects in New Brunswick in the one year substantial completion stage. If so, you are required to renew. JON OLIVER COMMUNITY LEADERSHIP AWARD In honour of the late Jon Oliver, a long serving dedicated member of the AANB, the association has established the Jon Oliver Community Leadership Award. It is intended that the Award be given to AANB members who have shown exceptional leadership and made a significant contribution to the improvement of our communities and greater society by means other than the practice of architecture. Potential Award recipients are nominated by an AANB member or any member of the public. Details on the Award are attached to this Information Bulletin. FOLLOW UP MEETING WITH THE DEPARTMENT OF PUBLIC SAFETY In May 2012, the AANB issued a Member Bulletin regarding professional submissions to authorities having jurisdiction specifically, the Office of the Fire Marshal. In 2012, the AANB agreed to follow up in a year or so with Public Safety to ensure that, as a result of our Bulletin, they were experiencing a noticeable improvement in their various areas of concern. It should be noted that in the past year, three complaints were filed with the AANB by the Department of Public Safety on various projects.
3 Page 3 We are pleased to report that on October 8 th, 2013, representatives of the AANB and ACEC NB met with DTI and DPS officials as a follow up to our spring 2012 meeting and subsequent Member Bulletin. At the meeting, officials noted a drastic improvement in their relationship with AANB members and the information provided to their offices for review. In addition, AANB members are responding to their request for additional information or follow up in a much more timely fashion. We wish to thank members for their prompt attention to this issue. We will continue to meet with DTI and DPS to ensure their relationship with our members remains positive and that any issues they may have are dealt with in a timely and professional manner. NAZAIRE DUGAS GRAVESTONE RESTORATION In August 2013, John Leroux was assisting the National Film Board on a film they are currently doing on the life of Nazaire Dugas, the first Acadian architect who was also a native of Caraquet, NB. When undertaking their filming, they discovered the terrible condition of his gravesite and AANB Council was approached regarding funding the restoration of his final resting place. Council approved the restoration and work is now underway LIEUTENANT GOVERNOR S AWARD OF EXCELLENCE IN ARCHITECTURE The next tri annual Lieutenant Governor s Award of Excellence in Architecture will be held in Submission information is attached to this . In summary: Completed Intent to Submit forms and the non refundable entry fee ($ including HST) must be submitted to the AANB office no later than March 31 st, Projects must be completed between May 1 st, 2009 and April 30 th, Submissions will only be accepted on Thursday, May 15 th, 2014 from 12:00 noon 3:00 p.m. at Old Government House, Fredericton. Winner(s) will be announced at a reception at Old Government House on Tuesday, June 10 th, 2014 beginning at 6:30 p.m. Please make sure to support this great initiative by submitting your projects for consideration for the Award(s). BROADLY EXPERIENCED FOREIGN ARCHITECT PROGRAM (BEFA) The BEFA program was officially launched on September 21, Any practitioners who have staff they feel would qualify for the BEFA process, should contact the association office. Details on the Program and criteria for candidates can be found on the AANB web site as well as the CACB s web site. Members are encouraged to familiarize themselves with the Program by reading the material available on line. The architectural profession in Canada is grateful to HRSDC for their support!
4 Page INDUSTRY FORUM (TRADE SHOW / INDUSTRY DAY) In cooperation with representatives of the Buildings Division at the Department of Transportation & Infrastructure (DTI), ACEC NB and CANB, the AANB will be hosting a two day Industry Forum on June 9 th /10 th, 2014 at the Delta Hotel, Fredericton, N.B. The preliminary schedule is as follows: Monday, June 9 th, :00 a.m. 10:00 a.m. Annual Meeting 10:00 a.m. 11:00 a.m. CE Session 11:00 a.m. 4:00 p.m. Buffet Lunch and Trade Show :30 p.m. Reception (hosted by DTI invited guests will include Ministers, MLA s etc.) Tuesday, June 10 th, :30 a.m. 9:00 a.m. Registration Industry Day 9:00 a.m. 4:30 p.m. Industry Day (DTI, AANB, CANB, ACEC NB) presentations/roundtable discussions/working groups/etc. 6:30 p.m. 8:30 p.m. Reception, Old Government House Lieutenant Governor s Award of Excellence in Architecture Stay tuned for more details as they unfold! The last Industry Forum was held in PROVINCIAL RELATIONS UPDATE As noted in the Annual Meeting Report of the Provincial Relations Committee, a number of items which were in discussion with the Buildings Division of DTI were going to be discussed further within a couple of weeks following the annual meeting. Follow up meetings were held on October 2 nd and October 16 th, The two meetings noted above were positive with the AANB obtaining a better understanding of the changes being undertaken by the Department and the resulting pressures on staff. In review of the document presented to Government in April 2013, a number of items have reached satisfactory resolution and they are summarized below. It should be noted that most of the items discussed will be incorporated in all new Client/Architect Agreements from this point forward. Schedule E Fee Distribution Will be amended to read: Schematic Design 15% (was 13%) Design Development 20% (unchanged) Construction Documents 34% (was 32%) Tendering 3% (was 5%) Construction Administration 25% (unchanged) Facility Start Up for Final Acceptance 3% (unchanged) One Year Warranty 0% (was 2%) F4 Services The Department has agreed, for the most part, to eliminate F4 Services and replace it with F2 Services or to be noted to be considered on a project by project basis. Items notably absent from the Schedules but requested during project development, etc. have been added and noted as F2 or to be considered on a project by project basis.
5 Page 5 Schedule F Copyright The following clause will be added to PNB Contracts and the AANB recommends that it be used by members as well: The Client agrees, to the fullest extent permitted by law, to indemnify and hold harmless the Architect from any damages, liabilities or costs, including reasonable attorney s fees and costs of defense, arising out of the use or modification by the Client to any reports, plans, specifications or other construction documents prepared by the Architect if such use or modification has not be explicitly approved in writing by the Architect and his/her consultant Engineers. This indemnification provision shall survive the termination of this Agreement. Schedule G Architect s Services and Client s Responsibilities A number of items have added to the Schedule and categorized as F2 or noted as to be considered on a project by project basis such as: Preparation of Room Data Storm Water Management Plan Evaluating Contractor s Proposed Substitutions Contractor Error Multiple Contractor Submissions Extended Construction Date Members are encouraged to review Schedule G carefully as modifications have been made. Issues such as Accelerated Schedule and its effect on Members is currently under review by the Department. Schedules H, I, J, K, L Submission Requirements The Department shall request submissions be uploaded to a designated DTI FTP Site rather than requesting the submission on CD s. The requirement for editable Floor Plans is to check areas for scope creep. The Department confirmed and agreed that written authorization to proceed should be received from Project Managers in a timely manner for all phases. Schedule K will be renamed 100% Construction Documents Pre Stamped The request for submission of an application for a wiring permit has been deleted. The issue of stamping of Addenda was discussed and the Department noted that until such time as it is no longer an AANB By Law requirement, the requirement will remain. Schedule O Government Rates Bob Daigle provided an overview of a calculation the Department is considering utilizing to calculate new hourly rates. Due to the nature of the relationship between consultants and Government in the Transportation sector, there is somewhat of a reluctance to put the hourly rates in the Buildings sector where they should be now that the Department has been merged. PNB representatives agreed to review the Hourly Rate issue further. With respect to reimbursable expenses, AANB was asked to provide data on an alternate approach for a sliding scale pending project budget.
6 Page 6 GENERAL DTI confirmed that Architects/Engineers are the authority on site. DTI noted that a template for Show Drawing stamps will be provided and will be required to be utilized on all of their projects. A decision is expected in the next month or so regarding the 5 year MRGNB Roof Warranty program. DTI noted that there are challenges with changing Project Managers between the design and construction phases but they are trying to address those issues. A comprehensive performance evaluation process is being developed and is expected to be implemented in the next construction season. NEXT STEPS The AANB and collateral organizations will continue to work on issues facing our members with Government representatives at DTI to move our respective issues forward in a collaborative manner.
