The subjects discussed and the decisions made under each of the agenda point are as follows: Confirmation of the proceedings of 125 th SEIAA Meeting held on 7 th November Proceedings of 125 th SEIAA Meeting held on 7 th November 2016 was read and as there were no comments the same was accepted Action Taken report on the proceedings of 125 th SEIAA Meeting held on 7 th November The Authority noted that the action is being taken on the proceedings of 125 th SEIAA Meeting held on 7 th November Deferred Projects: For Invite: Proposed expansion of residential apartment project at Sy. No. 25/2, 29/1, 29/2, 30/1 and 32 of Nallurahalli Village, K.R. Puram Hobli, Bangalore East Taluk, Bangalore of M/s. Maithri Developers, Sri. B.V.S. Reddy, No. 25/1, Sri Kote Ashirwad Towers, Outer Ring Road, Doddanekkundi, Marathahalli, Bangalore (SEIAA 112 CON 2016) This is a proposal seeking Environmental clearance for expansion of residential apartment from 350 to 396 units with B+G+11 UF, on a total Plot area of 16, Sq.mts and with total Built up area of 66, Sq.mts. Total water requirement is 267 KLD. The project had obtained Environmental Clearance from SEIAA vide letter No. SEIAA 104 CON 2012 dated 15 th September 2012 for a built up area of 66, Sqm with 350 units in B+G+8UF on a plot area of 16, Sqm.

2 The subject was discussed in the SEAC meeting held on 19 th August 2016 and 23 rd September The committee observed that as per the revenue survey map a nala is running away from the boundary of the project site. Since it is a outflow of the existing water body the committee opined that this has to be treated as primary nala (Raja Kaluve). However the said nala has now been shifted and brought adjacent to this project site. The proponent has left 15 m buffer from the centre of the existing nala considering it as tertiary nala and accordingly the proposal was appraised, EC was issued by the SEIAA and construction work also started. However as per the NGT order with respect to OA No. 222/2014 dated , 25 m buffer from the edge of the nala is to be provided if it is considered as teritiary nala otherwise 50 m buffer is to be left in case of primary nala. Since the building is already constructed and the expansion is only vertical it may not be possible to leave the buffer without demolishing the constructed building. The committee opined that the proposal cannot be taken up for appraisal unless the original alignment of the nala is to be restored as per the revenue records. The committee after discussion had decided to recall the proponent after submission of the following information: 1. The structural stability certificate of the building from third party agency to ascertain the load bearing capacity of the predesigned structure in view of the proposed construction above the already approved structure by the competent authorities. 2. In the earlier issued EC, the built up area is mentioned as 66, Sqm whereas the actual built up area as stated by the proponent is 42,277 Sqm. The discrepancy to be substantiated with supporting documents The proponent and Environmental Consultant attended the meeting of SEAC to provide required clarification/additional information. The proponent has submitted the replies during the meeting. The committee observed that as per the land conversion furnished by the proponent, there is no mention of any nala adjacent to the project site. However a nala has been shifted unauthorisedly and set back from original position of the nala ie. as reflected in the village survey map to the boundary of this property is 50 m. Also the proponent has left 50 m from the property boundary to the original alignment of the nala. The BBMP has approved the plan ignoring illegally shifted nala as stated by the proponent. The Committee has recommended to SEIAA for issue of Environmental Clearance. The Authority during the meeting held on 7 th November 2016 had perused the proposal and took note of the recommendation of SEAC. The Authority after discussion decided to get the following information for further consideration: 2

3 1) Details of original alignment of the nala and the shifted alignment with respect to the project site and the relevant orders thereof. 2) Compliance on the earlier E.C. 3) Comparison of the footprint of the buildings approved as per the earlier Environmental Clearance and the proposed. 4) Details of Recreational Ground area. The Authority also decided to invite the proponent. The Authority perused the reply submitted by the proponent vide letter dated The proponent appeared before the Authority and explained the proposal in brief. The proponent while clarifying the distance from the nearest nala, submitted that as per the village map a nala is flowing across Sy. No. 25, which is 50 m from the proposed project site. The proponent however submitted that the nala has been unauthorizedly diverted from its original alignment to the boundary of the Sy.No. 25 by the concerned landlord even before possession of the project site from the present owner. The Authority therefore decided to consider the distance from the original alignment as the competent authority would restore the alignment of the nala to its original position. While replying to the query, the proponent clarified that there is no change in original footprint of the building for which Environmental Clearance has been granted on 15 th September 2012, The Authority after discussion decided to clear the proposal for issue of Environmental Clearance subject to submission of the following information: 1) Revised scaled layout plan clearly indicating entry/exit, STP/MSW treatment facility, internal circulation roads and location of all other infrastructural facility. 2) Details of Recreation Ground area of at least 15% of the plot area with at least 50% of the RG area on the mother earth in the form of a table. 3) Specific source of treated water for the construction with an undertaking/mou with the prospective supplier of such treated water and with water quality analysis report to establish that such treated water is fit for construction purpose. 4) Specific social commitment plan with activity, budget and time frame as part of corporate / entrepreneur social responsibility in accordance with O.M. No.J-11013/25/2014-IA.I dated 11 th August,

Ltd..(SEIAA 120 CON 2016) This is a proposal seeking Environmental clearance for Development expansion and modification of mixed use development, on a total Plot area of 2,38, Sq.mts and with total Built up area of 6,22,745 Sq.mts. Total water requirement is 1861 KLD. The project has obtained Environmental clearance from SEIAA vide SEIAA 81 CON 2011 dated for construction of Divyasree Technopolis, mixed use development project on a plot area of 2,38, Sqm and for a built up area of 6,05,331.1 Sqm. The proponent requested the committee to 6

7 consider the proposal as B1 and exempt from the preparation of EIA report since there is only a marginal increase in the built up area of 17,414 Sqm. The committee asked the proponent to submit the following information for further consideration. 1. Implications on the proposed project site to be explained with respect to NGT order OA 222/2014 dated As per the order required buffer from the edge of the nala is to be provided depending upon the type of nala 2. Buffer zone area adjacent to the nala is to be calculated. It shall be maintained as No Development Zone and not to be considered for the green belt area 3. Quantification of the terrace area available for harnessing solar energy and an appropriate plan thereof with due calculations. 4. Scheme for utilisation of entire Rain Water harvested in the project site (both from the roof top and from the surface runoff) within the Project premises. 5. Details of excavated earth utilization management plan within the project site 6. Hydrological study of the area influencing the surface water flow considering the micro water shed network of the region. The proponent has not submitted the replies. The Committee appraised the proposal during the meeting held on 24 th September As observed from the Development Plan approved by the BDA for the entire extent of land area, following points are observed as regarding nala crossing in the land area. 1. Nala 1: Nala 1 which is passing along the western boundary of the project site, BDA has approved the construction driveway, parking space etc without leaving any clear buffer zone. 2. Nala 2: as per nala 2 is concerned it cuts across the land area in NS direction. Though BDA has reserved certain area as buffer zone, they approved for the construction of approach road connecting western portion with eastern portion. 3. As per the revenue village survey map, there is another nala running from east to west cutting across the eastern portion of the site and joining the nala running in north to south direction. However while approving the Development Plan for the entire area the BDA has approved the construction of 18 m wide road way all along this nala leaving no buffer zone. 4. As regarding classification of the project, the proponent has obtained EC earlier for the total built up area of 6,05,331 Sqm under B1 category. Now the total built up area after this modification and expansion comes to 6,22,745 Sqm. Hence there is an addition of 17,414 Sqm Built up area which works out about 2.5% of the increase in built up area. Also the water consumption gets increased by about 12.5% more than the earlier requirement. 7

8 In view of the above small increase in the usage of natural resources the Committee has appraised the proposal as B2 and decided to recommend the proposal to SEIAA for issue of Environmental Clearance. The Authority during the meeting held on 7 th November 2016 had perused the proposal and took note of the recommendation of SEAC. The Authority observed that there is an increase in the nala area when compared to the earlier Environmental Clearance. The Authority after discussion decided to get the following information for further consideration: 1) Details of buffer area to be maintained as per the orders of the Hon'ble NGT. 2) Details of the proposed development super imposing on the layout plan approved as per the earlier EC. 3) Horizontal section of one of the residential block. 4) Quantification of water requirement, MSW and parking for both residential and commercial developments separately. 5) Details of Recreational Ground area in the form of a table. The Authority also decided to invite the proponent. The Authority perused the reply submitted by the proponent vide letter dated The proponent appeared before the Authority and explained the proposal in brief. The proponent submitted that there are two nalas passing through the project site, one in the centre of the project site which is primary nala and another at the western boundary of the project site. The proponent submitted that no additional construction or modification is proposed in the buffer area of nala 01 which is at the eastern boundary of the project site and a buffer of 50 m provided on either side of nala 02 which is located at the centre of the project site and the entire buffer zone is maintained as no construction zone as per the orders of the Hon'ble NGT. The proponent further submitted that the area earmarked for commercial building-7 as per the earlier E.C. is now proposed to be used for construction of a residential building-3 with 2 Basement+Ground+14 Upper Floors. The Residential Buildings which were cleared for 2 Basement + Ground+ 9 Upper Floors are now proposed to be 2 Basement+Ground+14 Upper Floors. The proponent explained the changes that are proposed in the drawing approved as per the earlier E.C. The Authority after discussion decided to clear the proposal for issue of Environmental Clearance subject to submission of the following information for clarity and for the sake of documentation: 1) Layout plan clearly indicating entry /exit, STP/MSW treatment facility, RG area, internal circulation roads and location of all other infrastructural facility. 2) Details of residential building No.3. 8

9 3) Site plan superimposing the proposed buildings over the buildings that have been cleared as per earlier E.C. 4) Details of the towers that have been reduced / dropped 5) Details of club house wherein an area of Sqm has been added. 6) Separate table of occupancy in commercial and residential buildings. 7) Total area of commercial building and percentage of open space provided as per NBC norms. 8) Recalculation of water requirement based on occupancy load for residential and commercial separately. 9) Revised parking calculations for residential as per MoEF, BHK and BBMP norms providing for the maximum of the above requirements and consequential parking plan along with parking requirement for the commercial as per NBC norms with consequential parking plan. 10) Details of Recreation Ground area of at least 15% of the plot area with at least 50% of the RG area on the mother earth in the form of a table. 11) Details of green belt with at least 33% of the plot area. 12) Details of villas approved as per the earlier E.C. and the details of construction. 13) Compliance on the earlier E.C. 14) Specific source of treated water for the construction with an undertaking/mou with the prospective supplier of such treated water and with water quality analysis report to establish that such treated water is fit for construction purpose. 15) Specific social commitment plan with activity, budget and time frame as part of corporate / entrepreneur social responsibility in accordance with O.M. No.J-11013/25/2014-IA.I dated 11 th August, For Further Consideration: "Surbacon Cedar" Residential Apartment Project at Sy.No.51/5 of Kammasandra Village, Attibele Hobli, Bangalore Urban District of M/s. Surbacon Development Pvt. Ltd., #301, The Hibiscus, No.11, 1 st Main Road, 1 st Block, Koramangala, Bangalore (SEIAA 206 CON 2015) This is a proposal seeking Environmental clearance for Development of "Surbacon Cedar", Residential apartment of 159 units with B + GF + 3 UF + terrace, on a total Plot area of Sq.mts and with total Built up area of 25, Sq.mts. Total water requirement is 119 KLD. The subject was discussed in the SEAC meeting held on 28 th January 2016, 22 nd February 2016, 28 th March 2016, 11 th May 2016, 17 th June 2016 and 2 nd August

10 The committee reviewed the reply submitted by the proponent during the 166 th meeting of SEAC held on 17 th and 18 th June As verified from the village map, it is found that, the distance from the edge of the lake to the site boundary is about 30m and as per latest NGT order, minimum 75 m buffer has to be left between lake boundary to the site boundary, and for this the proponent has to give clarification. In the earlier proceedings, a nala is passing by the side of the project site for which clarification is sought from the proponent, and it was mentioned as cart track in the village map and the reply for this is accepted by the committee. The committee after discussion had decided to reconsider the proposal after the submission of the above clarification. The proponent has submitted a letter dated requesting the committee to consider the project for Environmental Clearance as the project site falls under Hebbagodi Gram Panchayat, now upgraded to Hebbagodi Town Municipality, which does not come under the BBMP limits and not attracting the NGT order. The Committee has recommended to SEIAA for issue of Environmental Clearance subject to condition that the required buffer from the lake boundary is to be maintained as per the norms. The Authority during the meeting held on 7 th September 2016 had perused the proposal and took note of the recommendation of SEAC. The Authority after discussion decided to get the following information for further consideration: (1) Location of the project site duly marking on the original village map along with details of lakes, Rajakaluve, nala and such other water bodies. (2) Details of lake adjacent to the project site, nala passing through the project site and the provision for the buffer provided from the periphery of the lake and the nala in accordance with the orders of the Hon'ble NGT dated 4 th May 2016 in Original Application No. 222 of (3) Specific source of treated water for the construction with an undertaking/mou with the prospective supplier of such treated water and with water quality analysis report to establish that such treated water is fit for construction purpose. (4) Revised scaled map clearly indicating entry/exit, building blocks, internal roads and other infrastructure facility along with buffer maintained from the lakes/rajakaluve as per the NGT order. (5) Enhance the internal circulation roads to a minimum of 6m and entry/exit to a minimum of 12m. (6) Details of green belt with at least 33% of the plot area. (7) Enhance Recreational Ground area to at least 15%. (8) Map showing indoor air circulation to prevent indoor pollution. (9) Revised quantification of water with consequential water balance chart, 10

11 (10) Revised parking calculations based on the requirement as per MoEF and BHK norms providing for the maximum of the above requirements and consequential parking plan. The Authority during the meeting held on 7 th November 2016 had perused the reply submitted by the proponent vide letter dated The Authority noted that the village map provided is not legible. The Authority after discussion decided to get the following information for further consideration: 1) Original village map duly marking the project site. 2) Revised scaled layout plan duly indicating entry, exit with at least 12 m wide, internal circulation roads with at least 6m width, STP/MSW treatment facility location and all other infrastructural facility. 3) Details of Recreation Ground area of at least 15% of the plot area with at least 50% on the mother earth. 4) Details of green belt with at least 33% of the plot area. The Authority perused the reply submitted by the proponent vide letter dated The Authority after discussion decided to clear the proposal for issue of Environmental Clearance subject to submission of the following information: 1) Revised scaled layout plan clearly indicating entry/exit, STP/MSW treatment facility, RG area, internal circulation roads and location of all other infrastructural facility. 2) Distance of the proposed construction from the lake and the nala duly marking on the layout plan. 3) Specific source of treated water for the construction with an undertaking/mou with the prospective supplier of such treated water and with water quality analysis report to establish that such treated water is fit for construction purpose. 4) Specific social commitment plan with activity, budget and time frame as part of corporate / entrepreneur social responsibility in accordance with O.M. No.J-11013/25/2014-IA.I dated 11 th August, Expansion of Residential Apartment Project at Sy.Nos.73/1, 73/2, 74 (P) & 81 of Bommenahalli Village, Bidarahalli Hobli, Bangalore East Taluk, Bangalore Urban District of M/s. Shrivision Towers Pvt. Ltd. (SEIAA 9 CON 2016) This is a proposal seeking Environmental clearance for expansion of Residential apartment of 935 units to 1645 units, consisting of building 1 with 6 towers having 2B + GF + 19 UF (as per earlier EC) & building 2 consists of 3 towers having 2B+G+19UF 11

12 (expansion). The total Plot area is 78, Sq.mts and the total Built up area is 2,34, Sq.mts. It is noted that the proposal had earlier obtained Environmental Clearance vide letter No. SEIAA 123 CON 2014 dated for 935 flats with built up area of 1,46, Sqm in favour of M/s Gardencity Realty Pvt. Ltd. Now, the proponent informs that, they have taken General Power of Attorney (GPA) & Development Agreement (DA) from M/s Gardencity Realty Pvt. Ltd, for construction of the project. Now, application for EC is submitted for an addition of 710 flats with a built up area of 88, Sqm and the total no. of flats if 1645 units with built up area of 2,34, Sqm. Compliance to earlier EC submitted. The Authority noted that the SEAC during the 159 th SEAC meeting held on 23 rd February 2016 have decided to issue standard ToRs along with the additional ToRs for the preparation of EIA by the project proponent. Accordingly the ToR was issued on The proponents have submitted the EIA report vide letter dated The subject was discussed in the SEAC meeting held on 24 th September The Committee had observed that as seen in the village map pertaining to Bendaganahalli, there is a lake in the Sy. No. 55 and it is lying adjacent to the Sy. No. 73 and 74 of the Bommenahalli village for which the proposal is applied. However there is no mention of lake in the boundaries in land conversion order. Also Hoskote Development Authority which is the planning authority for this area has also approved the Development Plan leaving 30 m from this property. However this is also located in BMRDA limits and outside the BBMP limits. Keeping all this in view, the project has been appraised. The Committee has recommended for issue of environmental clearance, after appraising the proposal along with the EIA report, subject to submission of the original reports of the baseline data analysis. The Authority during the meeting held on 7 th November 2016 had perused the proposal and took note of the recommendation of SEAC along with the reply submitted by the proponent vide letter dated The Authority after discussion decided to get the following information for further consideration: 1) Revised layout plan clearly indicating internal circulation. 2) Revised plan of building 2 following NBC norms. 3) Horizontal cross section drawing of one of the floor. 4) Details of Recreation Ground area of at least 15% of the plot area with at least 50% of the RG area on the mother earth. 5) Details of barrier free environment with facilities for specially abled. 6) Revised quantification of water as per norms and consequential water balance chart 12

13 7) Revised parking calculations based on the requirement as per MoEF, BHK norms and BBMP norms providing for the maximum of the above requirements and consequential parking plan. The Authority perused the reply submitted by the proponent vide letter dated The Authority after discussion decided to clear the proposal for issue of Environmental Clearance subject to submission of the following information: 1) Details of Recreation Ground area of at least 15% of the plot area with at least 50% of the RG area on the mother earth in the form of a table. 2) Details of barrier free environment for the benefit of specially abled. 3) Revised parking calculations based on the requirement as per MoEF, BHK norms and BBMP norms providing for the maximum of the above requirements with a comparison statement and consequential parking plan. 4) Location of the project site duly marking on the original village map along with details of lakes, Rajakaluve, nala and such other water bodies. 5) Details of lakes / Rajakaluve at the vicinity of the project site with buffer maintained along the boundary of such water bodies, as per NGT order dated 4 th May 2016, if applicable. 6) Specific source of treated water for the construction with an undertaking/mou with the prospective supplier of such treated water and with water quality analysis report to establish that such treated water is fit for construction purpose. 7) Specific social commitment plan with activity, budget and time frame as part of corporate / entrepreneur social responsibility in accordance with O.M. No.J-11013/25/2014-IA.I dated 11 th August, Proposed Commercial Development at Sy.no.l74/1. Hunsamaranahalli Village, Yelahanka Hobli. Total water requirement is 203 KLD. The subject was discussed in the SEAC meeting held on The proponent informed that, there is a tertiary nala passing nearby and as per latest NGT order, they have left a buffer of 25m from the edge of the nala. The committee directed the proponent to develop this buffer zone as green belt in addition to 33% green belt to be left as per norms within the site. 13

14 The Committee has recommended to SEIAA for issue of Environmental Clearance, subject to submission of scientific assessment of availability of water for quality and quantity and an approval from the ground water authority. Muppalla Bhaskar Reddy, Flat No. 207, Vars Fantasy, 1st Main Road, Kodihalli, Bangalore (SEIAA 99 CON 2016) This is a proposal seeking Environmental clearance for Development of Residential apartment of 208 units in 2 blocks with Basement+Ground+4 Upper Floor, on a total Plot area of Sq.mts (As Kharab land is Sqm, the Net site area is Sqm) and with total Built up area of Sq.mts. Total water requirement is 140 KLD. The proposal was considered by the SEAC earlier in the 154 th meeting of SEAC held on in File No. SEIAA 64 CON 2015 and had decided to recommend the proposal to SEIAA for closure since the proponent was remained absent repeatedly to provide required clarification. Accordingly the Authority was closed the file. 14

15 Subsequently the proponent has submitted a letter dated requesting the Authority to reopen the file and to give opportunity to present before the SEAC. The proponent has also paid the requisite processing fee. The Authority had considered the request made by the proponent during the 116 th meeting of SEIAA held on 31 st March 2016 and had decided to reopen the file and forward the same to SEAC for appraisal following the due procedure of law. The subject was discussed in the SEAC meeting held on 18 th July The committee had observed that the construction is already started without obtaining the Environmental clearance which is a violation of EIA Notification The Committee has decided to recommend to SEIAA for issue of Environmental Clearance subject to submission of the village map for verifying the existence of nala. The committee also decided to report the violation of EIA Notification 2006 to the Authority to take credible action against the proponent. The Authority during the meeting held on 17 th July 2016 had perused the proposal and took note of the recommendation of SEAC. The Authority noted that it is a case of violation of EIA Notification, The Authority after discussion took the following decisions: (1) Issue the following directions under section 5 of the Environment (Protection) Act, 1986 to the proponent: 1) To suspend the construction activity of the above said project with immediate effect at the existing level till the Environmental Clearance is obtained. 2) To submit details regarding present level of construction along with latest dated photographs. 3) To show cause why action should not be initiated against you for the violation (2) Get the mahazar of the project site done to establish the violation if any. (3) Filing a complaint before the jurisdictional court for the violation if prima facie established under section 19 of the Environment (Protection) Act, The Scientific Officer, SEIAA is authorized for filing complaint on behalf of the Authority. (4) To consider the proposal after filing of the complaint and receipt of the information sought by SEAC and the Authority. Accordingly, the direction was issued under section 5 of the E(P) Act, 1986 vide letter dated to suspend the construction activity with immediate effect. Spot mahazar of the proposed project site was conducted on and found that the construction activity has been undertaken without prior Environmental Clearance. A 15

16 complaint has therefore been filed before Hon'ble Jurisdictional Court of law under section 19 of the E (P) Act as per the decision of the Authority. The Authority considered the proposal as credible action has already been initiated. The Authority took note of the recommendation of SEAC made during the meeting held on 18 th July 2016 and decided to clear the proposal for issue of Environmental Clearance subject to submission of the following information: 1) Location of the project site duly marking on the original village map along with details of lakes, Rajakaluve, nala and such other water bodies. 2) Details of lakes / Rajakaluve at the vicinity of the project site with buffer maintained along the boundary of such water bodies, as per NGT order dated 4 th May 2016, if applicable. 3) Details of Recreation Ground area of at least 15% of the plot area with at least 50% of the RG area on the mother earth in the form of a table. 4) Specific source of treated water for the construction with an undertaking/mou with the prospective supplier of such treated water and with water quality analysis report to establish that such treated water is fit for construction purpose. 5) Specific social commitment plan with activity, budget and time frame as part of corporate / entrepreneur social responsibility in accordance with O.M. 20 The proposal was discussed in the SEAC meeting held on 26 th & 27 th April The Committee had decided to categorize the project under B1 category with exemption from conducting public hearing and decided to issue model ToR for the preparation of the EIA report. Accordingly, ToR was issued vide letter dated The proponent has submitted final EIA vide their letter dated The Committee during the meeting held on 9 th June 2014 has recommended the proposal for issue of environmental clearance with the following conditions: 1. The proponent should ensure adequate protection system to prevent the dust generation at the source itself. 2. There should be a provision for continuous on line work environment monitoring and recording. 3. There should a provision for health surveillance of all the industrial workers as stipulated under the Factories Act 1948 and the Rules. 4. The medical surveillance shall be specific towards identification of Silicosis to all those workmen exposed to dust. The Authority during the meeting held on had perused the proposal and took note of the recommendation of the SEAC. The Authority while going through the proposal observed that after having classified the proposal as B1, the decision taken by the SEAC during the meeting held on 26th & 27th April 2013 to exempt public hearing is not in accordance with the provisions of EIA Notification, 2006 and therefore, EIA report prepared without public consultation cannot be considered as a valid document. In view of the above observations, the Authority decided to refer the file back to SEAC to get the EIA report prepared as per the statutory guidelines in force for the time being and appraise the proposal in accordance with the provisions of EIA Notification, The SEAC observed that the EIA prepared by project proponent is based on the TOR issued in the 102 nd meeting of SEAC held on As per the OM dated of MoEF, the TOR is valid for a period of two years for submission of EIA reports after public consultation wherever so required.
