1 2014 CST CONFERENCE County Transportation Infrastructure Fund Grant Program
2 Applicable Laws Senate Bill 1747 created a grant program for county roads in the energy development areas and authorized TxDOT to administer the program. House Bill 1025 allocated $450 million to be divided between state roads and county roads damaged in the energy development areas: $225 million allocated to TxDOT projects; and $225 million distributed to counties through grants. 2
3 Applicable Regulations Texas Transportation Code Chapter 256, Subchapter C The department shall administer a grant program to make grants to counties for transportation infrastructure projects located in areas of the state affected by increased oil and gas production. The department may adopt rules to implement this subchapter. 3
4 Applicable Regulations Texas Administrative Code, Title 34, Part 1, Chapter 20, Subchapter I - Uniform Grant Management Standards (UGMS) State agencies are required to adhere to UGMS when administering grants and other financial assistance agreements with cities, counties, etc. Texas Administrative Code Title 43, Part 1, Chapter 15, Subchapter 0 Rules adopted by the Commission to administer the County Transportation Infrastructure Fund. 4
5 Requirements for a county be awarded grant funds? Created a County Energy Transportation Reinvestment Zone Submitted applications between March 7 and March 14 Application submittal included required information Road condition report, list and scope of transportation infrastructure projects All 254 counties in TX were eligible to submit an application 5
6 The department will award a grant from the fund to each eligible county that submits a valid application Award Criteria The department will determine the amount of the award based upon: 20% weight tolerance permits ratio 20% oil and gas production taxes ratio 50% well completion ratio 10% volume of oil and gas waste injected ratio 6
7 Applications received from 191 counties during application period 7
8 Next Steps in Award Process TxDOT has until March 21 to perform preliminary review and notify any county if information is missing from its application Each county has 14 days after receipt of notice of deficiency to provide required information to TxDOT Final TxDOT review of all applications including previously missing information by April 7 (potential for ED to extend through May 5) Upon final review, TxDOT notifies each county of award amount or reasons for denying grant to individual counties 8

11 Implementation Procedures Project List and Schedule County selected projects from its application based upon actual award amount o Project description o Estimated cost o Anticipated month and year to start construction and complete construction May be updated by counties to change project priority, limits or to add/remove projects 11
12 Implementation Procedures Standard certification forms to simplify county reporting Intent is to allow the counties to certify to TxDOT they are in compliance with the required laws, rules and regulations Defined certification requirements for county-performed work and for contracted work Rather than TxDOT performing interim reviews of project records and documentation of each individual project All county cost records and accounts are still subject to audit by representatives of state for a period of three years 12
13 Implementation Procedures Standardized invoicing forms and procedures Invoices to be submitted monthly when charges occur To be submitted in defined time period each month Attach copies of all paid consultant or contractor invoices and/or force account documentation by project for all allowable work performed during billing period County certification on invoice form Signature line for TxDOT to acknowledge review of invoice and approve invoice for payment 13
