1 Substitute House Bill 49 Omnibus Amendment HC Creates legislative guardrails around the Group VIII Medicaid spending through Controlling Board (CB). Transfers the state share to the Health and Human Services Fund. The Controlling Board can release the funds upon request from the Medicaid Director once every six months. Specifies conditions that must be met for the release including obtaining waivers from CMS for an innovative waiver regarding health insurance coverage and the Healthy Ohio Program, and enforcing the law regarding cost estimates for patients. HC Restores current law in regards to cost estimates for patients. HC2640 Changes, beginning in FY 20, the phase-down for reimbursement payments to school districts for their tangible personal property (TPP) tax losses from an amount equal to 5/8 of a mill of the district s average property valuation to 1/4 of a mill per year. HC2666 Provides, for school districts who are on the gain cap and see a reduction in the reimbursement of TPP, an offset that equals the lesser of their total formula amount or the net decrease in funding from foundation aid and TPP reimbursement in FY 17 & FY 18. HC2872 Specifies that a district s ADM in FY 11 is the lesser of 1) the count used for funding in FY 11 (FY 10), unless the district s ADM grew by more than 2% in which case it was based on FY 11 or 2) the October 2010 student count. Restores the transportation supplement under the gain cap. Reduces the Education Service Center (ESC) earmark by $1,050,000 per year. HC2401 Removes changes to the application of the sales tax on hotel intermediaries. HC Increase funding for nursing facilities (NFs) by $60.5 M in FY 18 and $40.0 M in FY 19. HC & HC2483 Increases , ICF/IID and Waiver Match, by $15,356,318 and , Medicaid Services, by $25, in FY 19 and removes prohibitions on the Department of Developmental Disabilities (DDD) from increasing reimbursement rates or the number of waivers currently available. HC2920 Sets the appropriation ceiling for aggregate hospital payments at $6.9 B per year. HC2366 Corrects the intent of the hospital rates included in the substitute bill to clarify the rates in effect for the biennium are the rates in effect on January 1, 2017 unless total appropriations exceed the aggregate ceiling. HC2236 Strikes provisions related to a probate court s jurisdiction over a park district. HC2644 Eliminates changes to the earned income tax base for the school district income tax. HC Creates a system through the Attorney General s (AG) office where someone getting a record sealed or expunged can volunteer and have private entities notified. HC2570 Narrows the application in the substitute bill that withholds Local Government Funds (LGF) payments in regards to water and sewer services to a city with a population greater than 700,000 (Columbus). HC2494 Eliminates the creation of the straight-razor license. HC2550 Prohibits the Department of Taxation (TAX) from taking any action to subject something to taxation that TAX had not considered part of the tax within three years of the effective date of the tax. HC2915 Requires the Department of Rehabilitation and Correction land conveyances to be subject to a competitive process. HC2364 Extends through July 1, 2019 the ability to apply the historic rehabilitation tax credit against the commercial activities tax (CAT). 1

2 HC2459 Permits a district with a segmented School Facilities plan, to recalculate their local share for each segment. HC2643 Deletes the fee related to filing municipal income tax returns through the Ohio Business Gateway. HC2774 Maintains language in the bill regarding the repeal of the throwback rule, but maintains the current apportionment of sales to a municipality. HC2608 Revises the language in the sub-bill that allows the Ohio State University to enter into a utility agreement: 1) permits OSU to contract with a special purpose vehicle, not entity, 2) limits the agreement to apply only to the Columbus campus, 3) defines the campus to include buildings structures and facilities behind the meter, and 4) prohibits the vehicle from taking ownership of utility services delivered by a public utility. HC Creates , Pay for Success Contracting, and appropriates $500,000 per year for the program under the Department of Administrative Services to issue social impact bonds. HC Establishes a $1 M capital appropriation to reimburse counties for the cost of voting machines. HC2883 Requires the collection and publication of CAUV values by school district. HC2278 Allows a county with a population between 300,000 and 350,000 that levies a 3% lodging tax (Lorain) to increase the municipal lodging tax up to an additional 3%. HC Authorizes Warren County, which has a 1% lodging tax in addition to the general 3% lodging tax, to use the proceeds of the 1% tax to pay for the construction and maintenance costs of a sports complex owned by a port authority and that any portion of the lodging tax can pay for bonds on such a facility. HC2320 Permits a county with a population between 190,000 and 200,000 that levies a 3% lodging tax (Clermont) to increase the rate up to an additional 1% for the construction and maintenance of a sports and recreation facility and to promote tourism. HC2399 Allows notaries to set their own fees. HC2628 Sanctions a notary to take electronic signatures via teleconference. HC2654 Removes language creating the Retail Food Safety Advisory Council. HC2340 Provides $37,500 for the University of Tiffin to host a national maritime convention. HC2812 Requires the Department of Education (ODE) to request fingerprints from licensed educators and license applicants not enrolled in the Retained Applicant Fingerprint Database and to inactivate a license or reject an application for noncompliance. HC2243 Extends the provisions of S.B. 9 from the 130 th G.A. through January 1, 2022, which suspend Ohio s Open Enrollment Program, the Health Reinsurance Program and conversion options under and the existing health insuring corporation contract. HC Restores funding to Education Technology Centers. Reduces the earmark in , Foundation Funding for ESCs. HC2760 Strikes provisions in the introduced version of the bill that require ODE to establish new criteria and guidelines for ESCs. HC2566 Permits the University of Akron to sell the university-owned residence. HC2258 Allows a county to raise its piggyback sales tax rate in increments of 0.05% instead of 0.25%. HC2245 Specifies that home health care is an in-demand industry sector. HC2416 Eliminates the requirement that a new community district be over 1000 acres. 2

3 HC Removes the requirement that all financial institutions (FIs) that hold public money pay a certain interest rate. Requires the State Treasurer (TOS) to adopt rules regarding credit unions (CUs) participation in linked deposit. No CUs may participate until rules are adopted. Allows TOS to impose reasonable fees. Permits the TOS to adopt rules for the Pooled Collateral Program. HC Requires state pharmacy board, upon request, to provide a peer review committee of any health care entity with information from OARRS relating to a health care professional, if it is for evaluation, supervision, or disciplinary purposes. HC Establishes a $500,000 capital appropriation for the Wayne County Regional Training Facility. HC Expands the language related to , Federal Research Network, to include all non-profit institutions of higher education in the state and federal installations in Ohio. HC2408 Authorizes deposits from a financial transaction device for online foreclosure sales. Changes the requirement from stating if the foreclosure purchaser will live at the property, to if they intend to rent it, and exempts the purchaser from submitting contact info if they are the plaintiff or lienholder. HC2457 Creates the DataOhio program. HC2839 Removes the behavioral health pilot program in Lucas County created in the sub-bill. HC Directs the Lottery Commission to establish an incentive-based compensation program for lottery agents and requires all prizes under $5,000 to be redeemed at a retail location. HC2226 Specifies that Facilities Construction Commission (FCC) powers do not extend to letting or administering contracts that fall under DAS. Clarifies DAS contracts supersede FCC contracts. HC Authorizes an auto insurer to send a cancellation of notice due to nonpayment along with the bill. HC Removes a requirement that FQHC Primary Care Workforce Initiative assist FQHCs with developing recruitment and retention practices for health professional designations. HC2614 Strikes the elimination of the Clark County Municipal Clerk of Courts. HC2695 Moves the earmarks of $8.8 M to provide $100,000 to each county department of job and family services from , Child, Family and Community Protection Services, to , Family and Children Services. HC2783 Relocates the $10 M earmark for kinship care from , TANF MOE, to , TANF Block Grant. HC2641 Technical changes to the sub-bill provisions regarding H liquor permit holders. HC2213 Expands the types of liquor permit holders that may offer tasting samples of beer, wine, or spirituous liquor to casinos and restaurants in casinos. HC2573 Re-appropriates $7,989,174 in unspent capital appropriations for the Community School Classroom Facilities Grant Program to provide grants to high performing community schools. HC Extends a Medicaid demonstration project in Lucas Co. under which recipients receive NF services instead of hospital services in a free-standing long-term care hospital. Adds facilities in Brown and Seneca counties. Allows facilities built after January 1, 2010 to be eligible. HC2433 Creates a pilot program in Franklin County to develop a software program to help Medicaid recipients to remember appointments and locate transportation. HC Requires the Department of Job and Family Services (JFS) to develop a registry for suspected elder abuse, create an obligation for some financial professionals to protect the elderly from financial crimes and establishes the Ohio Elder Abuse Commission. 3

4 HC2921 Revises the DRC notification of sheriffs regarding the release of felons contained in the sub-bill to model existing notifications. HC2757 Retains the provisions of the substitute bill prohibiting a career college from charging a student success fee and requiring transferability of credits. Removes all other provisions of the substitute bill related to career colleges. HC Provides a $300,000 capital appropriation for the purchase of MARCS radios. HC Modifies the make-up of the Vision Professionals Board by removing one member of the public and adding an additional optometrist. HC Requires a property tax resolution to include the following information, 1) whether it is a renewal or replacement or an increase or decrease of a tax, 2) the term, 3) the subdivision s territory upon which the tax will be levied, 4) the date of the election, 5) the first year on which the tax will apply, 6) each county in which the subdivision has territory HC2388 Directs each chartered nonpublic school to publish on its website the number of enrolled students and its policy regarding employee and volunteer background checks. They must also publish on the website and make available to parents the curricula and reading list for each grade. HC2708 Adds consulting services to the definition of computer services that require competitive selection and CB approval under the sub-bill. Also requires a comparative analysis be prepared by the agency that makes the purchase. HC2323- Extends the deadline for manufactured and mobile home owners to apply for the homestead exemption by 18 months, from 6 months, before the year begins to December 31 of the year they are seeking the exemption. HC Increases , Education Program Support, by $50,000 per year and earmarks the money for the Ohio ProStart school restaurant program. HC Makes permissive an ADAMHS board s ability in the bill to authorize an involuntary commitment for MH reasons. Makes technical and corrective changes. HC Creates an expedited certificate of need review process. The Department of Health (DOH) has to comment within 14 days instead of 45 and reduces response time from 60 days after notice is mailed to 30 days. HC2828 Buries changes to the sub-bill regarding the auditing of cemeteries. HC Expands the class of permanent improvements a tourism development district (TDD) may use revenue for. Clarifies money can only be spent inside the TDD area. Requires lodging taxes inside the TDD to be used to promote tourism in the TDD only if approved by the convention and visitor s bureau. HC2473 States that only data available through the Higher Education Information System may be included in the biennial College Credit Plus (CCP) report. HC2234 Earmarks $500,000 per year from the Straight A Fund for the Bright New Leaders of Ohio program. HC2409 Corrects typographical errors in the Civil Rights Law housing mediation and civil penalty provisions of H.B. 463 from the 131 st G.A. HC Permits the Supervisor of Agricultural Education in ODE to serves as the Chairman of the Ohio FFA Association. Prohibits ODE employees from receiving compensation from the Association. HC Requires the rules the Medical and Nursing Boards adopt for medication-assisted treatment (MAT) drugs be consistent across all prescribers. Removes language that explicitly requires prescribers to make patient medical records open to inspection by the boards and the Department of Mental Health and Addiction Services (DMH). HC Earmarks $250,000 per year from , Small Business and Export Assistance, to provide funding for Lumos. HC2919 Increases the appropriation , Ohio College Opportunity Grant, by $1 M in FY 18 and $2 M in FY 19 and revises the internal earmark. 4

5 HC Raises the appropriations for , Ohio Agricultural and Research Development Center by $500,000 per year. HC2601 Modifies the language relating to public official ethics changes in the sub-bill to clarify that the changes do not apply to the Casino Control Commission. HC Adds the ANSI-ASQ National Accreditation Board to the list of accreditations that a crime lab may have to be eligible for the grants created in the sub-bill. HC Re-establishes , Ohio Military Facilities Commission. Transfers $1 M per year in GRF for this purpose. HC Earmarks $750,000 per year for the Star House Drop-In Center from , Family and Children s Programs. HC2519 Requires ODH set new eligibility requirements for services provided through the Ohio Breast and Cervical Cancer Project. ODH must adopt rules specifying the cost sharing limit for each screening and diagnostic service. HC Makes several changes to the T-CAP program contained in the bill including clarification of the treatment of multiple and concurrent offenses and creates a local confinement waiver. HC2516 Allows , Education Technology Resources, to be used to support assistance with compliance reporting for federal E-rate funds and a program of study for K-8 related to online safety skills. HC Provides that a NF does not need to be inspected to receive new beds before DOH increases its licensed beds if the beds are in an area that was part of the most recent inspection. HC Requires LSC to report on state programs that address individual identifiable risk factors for poor physical or behavioral health. HC Removes a requirement for JMOC to review DOH programs. HC2424 Specifies that the earmark for food banks unaffiliated with the Ohio Association of Food Banks can be provided to food pantries as well. HC Provides that a change in the owner of a long-term care facility for which a CON was granted occurs within the 5 year monitoring window and is not a reviewable activity unless there is a violation of law. HC Re-appropriates unencumbered Lakes in Distress Fund to fund engineering and construction of storm water facilities in Millersport and Buckeye Lake and the unencumbered balance of the Travel Tourism item previously allocated for grants to assist businesses and other entities adversely affected by lakes in distress to the same purpose in FY 18. HC2750 Transfers $10,000 in GRF per year for the Ohio Legal Assistance Foundation to provide legal services. HC2577 Permits the Banking Commission to hold meetings via teleconference. HC2602 Defines Edison Center Network and allows the Director of the Development Services Agency to waiver the contribution requirement for the Edison Grant Program. HC Includes dental benefits under a health insurance plan from the exemption from prior authorization. HC2228 Authorizes the TOS to create a new STARS-like investment program to allow local governments with excess reserves to access longer-term investments. HC Removes executive provision prohibiting applicant for licensure as a wholesale distributor, manufacturer, and specified others in the chain of production from withdrawing a submitted application without approval of the Pharmacy Board. HC Requires a township to get the approval of a school district before extending the term of a TIF originally granted before 1995, unless the district waived the requirement. 5

6 HC Directs the Superintendent of Public Instruction to establish a workgroup on related services personnel, for the purposes of improving coordination of state, school and provider efforts to address the related services needs of students with disabilities. HC2331 Strikes provisions from the bill that changes the determination of licensure of purchasers and sellers of wholesale-level dangerous drug transactions. HC2682 Increases , Adaptive Sports Program, by $50,000 per year. HC2558 Diverts $36,000 in FY 18 and $72,000 in FY 19 of state GRF CAT receipts to make payments to joint fire departments located in a township with a nuclear power plant. HC2241 Gives appointing authority of the Oil and Gas Leasing Commission to the Senate President and Speaker of the House. HC2493 Increases , Airport Improvements State, by $227,500 and increases the earmark currently in the line to $455,000 in FY 18. HC2370 Extends the term of the Inspector General until January 1, HC2286 Revokes the license of a park or park-camp operator if three or more nuisance activities have occurred in the park in a 6-month period. HC2290 Mandates the Director of Veterans Services to establish a peer counseling network. HC Restores reductions to , Arts Council Operating Expenses, from the sub-bill. HC2922 Corrects the reductions in the sub-bill in HC by reducing , Medicaid/Health Care Services by $138,704,772 ($51,792,362 state share) in FY 19. HC Requires a warden to send information regarding a prisoner before the Parole Board concerning participation in programs, rule compliance and ability to gain employment. HC Tweaks language accepted in the sub-bill related to aquatic invasive species. Requires a policy, instead of rules, to be adopted, and deletes some requirements placed on the Department of Natural Resources. HC Eliminates provision of executive bill regarding (1) issuance of waiver by DMH to an ADAMHS board regarding location of ambulatory detoxification treatment (2) putting time limits on such waivers (3) director discretion to disapprove ADAMHS's board budget in whole or part (4) eliminating director's authority to issue a time-limited waiver of a requirement an ADAMHS board. HC2619 Directs JMOC to contract with a third party to conduct studies on (1) high risk pools for uninsured residents and (2) feasibility of implementing plan that is similar to Healthy Indiana Plan and a high-risk pool in Ohio. HC2216 States that if state pharmacy board enters into agreement with another state or federal entity to exchange information concerning the licensing and inspection of manufacturers, wholesale distributors, and other parties in the chain of production, the information received is subject to confidentiality and disclosure provisions that are applicable to Board's investigations.
