3 PART 1 GENERAL HOUSING DEVELOPMENT CORPORATION LTD INVITATION TO SUBMIT EXPRESSION OF INTEREST (EOI) Housing Development Corporation Ltd invites Expression of Interest (EOI) from eligible Contractors in the field of Road Works. The proposals duly completed as per prescribed format, shall be submitted in sealed envelope super scribing Application for Listing of Road Work with EOI Number as per Clause 2.2 of Information to Applicants on or before 13 th July 2015 at 1300 hrs to the office of The Managing Director, Housing Development Corporation Ltd., 3rd Floor, HDC Building., Hulhumale, Republic of Maldives. 4 1. PREAMBLE 1.1 Housing Development Corporation is seeking Expressions of Interest from eligible parties to construct roads in Hulhumale Phase 2 area. The intent of this document is to provide interested firms with sufficient information to enable them to prepare and submit their expression of interest to demonstrate the experience and skills for implementation of the said project. 1.2 Housing Development Corporation Ltd (HDC), hereinafter referred as Employer, is fully owned by the Government of Maldives and office located at 3rd Floor, HDC Building, Hulhumale, Republic of Maldives. 1.3 HDC intends to receive EOI from eligible and competent firms in order to prequalify those firms for the upcoming Hulhumale Phase-2 stage 1 Road Development, including proposing possible funding options, engineering designs, supply of materials and labor and the overall execution of the project under the technical supervision of HDC. 1.4 In this context, HDC would like to Invite Interested Parties to submit their EOI in accordance to the Section 3 (Instructions). A submittal of EOI serves and will be treated as a notice to The Managing Director, Housing Development Corporation (HDC), of the party s interest to participate in Hulhumale Phase- 2 stage 1 Road Development project. 1.5 Qualified Responses will be registered as eligible parties to receive Invitations to Bid or Requests for a Project Proposal for the funding, engineering and construction activities for the project. However, submittal of an Expression of Interest does not guarantee that the Interested Party will be selected and contacted to obtain the services or to perform any services of the Project. 1.6 The information provided in this document does not purport comprehensive and does not contain all the information that the Interested Parties and their advisors would desire or require in reaching a decision as to the submission of the EOI and the activities that are listed in Section 9 are illustrative only. 1.7 The project and the construction duration is estimated to be phased out over a period of 3 years with contractor finance model with not more than 15% projects equity contributed by HDC with any further details in support of the submission. 1.8 The envisaged Road works to be undertaken are as mentioned below: 4 P a g e

INFORMATION TO APPLICANTS: 2.1 The documents related to this EOI are available for download from HDC s website All submittals must be prepared in the English language. The EOI must be submitted in sealed envelopes. Three (3) hard copies one original and two copies must be included in the envelope. Each submittal must be clearly marked with the following Information; - EOI number HDC/EOI/2015/001 at the right hand top corner of the envelope. - The complete legal name and contact information of the responder s organization. - The delivery address as given below. - Name of the EOI. All documents must be submitted in person to the following address on or before 13 th July 2015 at 1300 HRS and responses by or any other form of communication will not be accepted. The EOI must be submitted only as per the enclosed format (s) along with Annexure I to XI. Self-attested documentary proof(s) in respect of the details 5 P a g e

6 furnished in the application form shall be submitted along with the application. The intending applicants shall also submit the list of such projects where due to any disputes, litigation/arbitration was invoked and services were abandoned/suspended by the Client. Suppression of any information in this regard may lead to cancellation of listing of the Contractor concerned, if such information comes to the notice of HDC. Incomplete applications will be summarily rejected. 2.3 The EOI shall be signed by the authorized person (s) of the firm. All pages of the documents shall be signed / stamped. 2.4 Upon submission of EOI, respondent will be issued a stamped receipt confirming timely submission or a confirmation . It is the responsibility of the respondent to assure timely and complete submission of the EOI and any supporting materials. 2.5 Each respondent may submit only one EOI per technical area, either individually or as a partner in a joint venture or as consortium. A respondent who submits or participates in more than one EOI per technical area shall cause all EOIs in that area with that respondent s participation to be disqualified. 2.6 All questions and/or clarifications regarding this EOI must be submitted via to pidc@hdc.com.mv before 7 th July hrs. All correspondence and/or inquiries regarding this solicitation must reference the EOI number. No phone calls or in-person inquiries will be entertained; all questions and inquiries must be in writing. Only the written answers will be considered legal and official. Any personnel or verbal information received from any employee of Housing Development Corporation, or Project employees, or other entity, should not be considered as an official or legal with regard to any questions in this EOI. 2.7 Clarifications, if necessary, will be sought from the applicants before selection. All Information submitted by the applicants during the process of listing will be the property of HDC and will not be returned. 2.8 Successful listed contractors have to pay a Tender Security Deposit in the form of Bank Guarantee while participating in the main tender. Security Deposit/ Performance Bank Guarantee will be paid only if the tenderer is successful. The amount for Tender Security and Performance Bank Guarantee will be as per the tender document. 6 P a g e

7 3. INSTRUCTION TO APPLICANTS: 3.1 GENERAL a) All information requested for in the enclosed forms shall be furnished against the respective columns in the format(s). Non- submission of complete information as per the required formats or making any change in the prescribed forms may result in their application being summarily rejected. b) The application form shall be type written. Bidders are not authorized to make any changes in the format of prescribed forms. The applicant s name, signature and stamp shall appear on each page of the application form. c) The application form downloaded from the web address only shall be submitted after filling. d) Interested Parties should describe in detail and prove with documentary evidence of their qualifications, technical categories, machinery & equipment s availability, skills and past experience on road constructions and the locations such constructions are carried out and any details that are not listed in the annexure I to XI, for which they would like to be considered. This could be verified by the Employer, when and where required. e) The applicants are advised to attach any additional information which they think fit and necessary in regard to proving his capabilities and capabilities. No further information will be entertained after submission of the application unless it is called for by the Employer. f) The cost incurred by the applicants in preparation & submission of this application, providing clarifications or attending discussions in connection with due process of empanelment shall be borne by the applicant and the employer in no case will be responsible or liable for these costs regardless of the outcome of the process. 7 P a g e

8 3.2 DEFINITIONS a) In the document, the following words and expressions shall have the meaning hereby assigned to them except where the context otherwise requires: "Employer/Client" means Housing Development Corporation Ltd (HDC), 3rd Floor HDC Building, Hulhumale. Applicant means proprietary firm, Partnership firm, Private Limited b) Company, Limited Company or Public Limited Company whose application has been received by the employer and includes the applicant s personnel, representatives, and successors and permitted assigns. 3.3 METHOD OF APPLYING a) If the application is made by a firm in partnership, it shall be signed by all the partners of the firm above their full typewritten names and current addresses or alternatively by a partner holding Power of Attorney for signing the application, in which case a certified copy of Partnership Deed shall accompany the application. b) If the application is made by a Limited Company, it shall be signed by a duly authorized person holding the Power of Attorney for signing the application, in which case a certified copy of the Power of Attorney issued by the Board of Directors shall accompany the application. 3.4 FINAL DECISION MAKING AUTHORITY The Employer reserves the right to reject or accept any one or all applications and to annul the process and reject all the applications at any time without assigning any reason(s) thereof and without thereby incurring any liability to the affected applicant or without informing the applicants for the grounds of the Employer s action. 3.5 MODE OF FINANCE Contractor Finance model as preferred option. During the Evaluation the score will be given based on the interest rate, period and proportion of contractor finance. 3.6 COMPANY STRUCTURE The bidder may submit the EOI as a single entity or may choose to submit as a JV. 8 P a g e

ELIGIBILITY CRITERIA: 4.1 DETAIL a) Bidder should be well established and professionally organized Road works Contractor with experience in the field of construction of Roads, flexible/rigid pavements, along with the allied drainage lines/ service corridors, footpath etc. b) The following Statements shall be submitted; 1. Is not debarred, suspended, nominated or proposed for debarment, by any of the client or who proposes to do business with firms or firms principals who are debarred, suspended, or proposed for debarment by the Client in the performance of the requirement of this activity. 2. Is legally registered and recognized under the laws of the country in which the firm is headquartered, is in compliance with all applicable civil, fiscal, and other applicable regulations, Such a company or organization could include a private firm, non-profit, civil society organization, or university. 3. Agree to work under rules and regulations of the Republic of Maldives applicable to future Invitations to Bid or Requests for Proposals. 5. EVALUATION OF APPLICATIONS: 5.1 The applications will be examined by a designated Evaluation Team appointed by the Employer, which may call for clarifications/ additional information from the bidders which must be furnished to the Evaluation Team within the stipulated time. 5.2 The evaluation will be carried out based on the evaluation framework in annexure-xii. 5.3 Bidders should satisfy the eligibility criteria on their own merits. 5.4 All submittals conforming to the EOI requirements will be evaluated based on the submitted documents where evaluations will look into the financial, technical capability, experience and other resources. 5.5 Successful submittals will be selected and invited to submit detailed proposals at the sole discretion of HDC. 5.6 Any document submitted with this EOI, need not to be resubmit along with the final proposal. 6. LITIGATION HISTORY The Applicant should provide accurate information on any litigation or arbitration resulting from contracts completed or under its execution over the last three (3) 9 P a g e

10 years ending A consistent history of litigations against the Applicant or any member of the Consortium may result in failure of the application at the desertion of the Employer. 7. JURISDICTION OF COURT IN CASE OF DISPUTE OR DIFFERENCES ARISING ON ACCOUNT OF THIS EOI Any suit or application, arising out of any dispute or difference on account of this pre-qualification tender shall be filed in a court in the Maldives only. 8. BANNED OR DE-LISTED TENDERER/ FIRMS / VENDORS: The Bidder declares that they being Proprietors / Directors / Partners have not been any time individually or collectively blacklisted or banned or de-listed by any Government or Government agencies/companies or Private Sector Companies/Organizations. If a Tenderer s entities as stated above have been blacklisted or banned or de-listed by Government or Government agencies/companies or Private Sector Companies/Organizations, this fact must be clearly stated in the prescribed format at Annexure IX and it may not necessarily be a cause for disqualification. If Tenderer has not been banned or Delisted by any, Tenderer shall mention as `Not Applicable (NA) in the format. Filling of this form is Mandatory for every Bidder. 9. Conditions of Contract Comprises the General conditions which from part of the Conditions of contract for construction first edition 1999 published by the FIDIC. C. Standards All work shall be carried out to the standards quoted in the specifications set to the construction. If no particular standard is quoted then the appropriate British Standard shall apply. D. Works Specification All works to be constructed in accordance with accepted Standard Specification set for Roads and Drainage Works in Land Developments which consists of three parts The first two parts, General Clauses and Project Special Clauses set out the intent of the specification, requirements and roles / responsibilities of developers (and their representatives). The third part is the technical specifications set for roads in the particular project and drainage works and is based on standard specification modified to suit needs. E. The drawings and designs All the designs and construction drawings are supplied by the Housing Development Corporation. General lay out drawing for road network and relevant sectional drawings are provided for the convenience of responses to prepare the Expression of Interest (refer to Annexure XII). F. The methodology statement The applicant should give a briefed method statement with EOI subjected to submittal of a comprehensive method statement at the award of constructions of the project. During the construction phase of each infrastructure activity, the Contractor/Subcontractor shall support construction supervision of the 12 P a g e

13 construction firm selected by competitive procurement. Construction supervision will be continuous during the construction phase of each infrastructure activity, through project handover, with construction schedules to be determined for each activity. Supervision will include compliance with all design specifications, drawings, condition of contract and compliance with requirements of the Maldives Environmental Protection Agency (EPA) that apply o n to the infrastructure construction activity. The Contractor/Subcontractor also shall provide site inspectors to monitor day-today construction by the construction firm for each activity. The Subcontractor shall provide on-site inspectors who will be present on the construction site during working hours each day throughout the construction process, concluding with project handover. The site inspectors will monitor construction quality, bills of quantity and other parameters against the requirements of the construction contract. Precise monitoring requirements will be specified for each infrastructure activity. The on-site inspectors will be supported by senior technical staff based in the Subcontractor s central office, as needed. 13 P a g e
