SECTION 408 PUBLIC NOTICE/FILE NUMBER: ; Jefferson Parish Government, Boat Launch Ramp into Mississippi River, Gretna, Louisiana Interested parties are hereby notified that a request for permission to alter a U.S. Army Corps of Engineers (USACE) project pursuant to Section 14 of the Rivers and Harbors Act of 1899 (33 U.S.C. Section 408) has been received and will be evaluated by the New Orleans District. Written comments, including any objections to the proposed alteration, stating reasons therefor, are being solicited from anyone having an interest in the requested alteration. Comments must be mailed or ed by or before the last day of the comment period and must reference the file number of this public notice. Comments will become part of the record and will be considered in the decision on the request. See below for contact information and address. COMMENT PERIOD EXPIRES: June 21, 2016 REQUESTED ALTERATION: The proposed project will involve the construction of a concrete boat launch ramp. The boat launch ramp will provide layered security to maritime facilities, Port of New Orleans, docks, wharfs, intake systems and other critical infrastructure on the Mississippi River and connected canals. The boat launch ramp will be used by local, state and Federal public safety agencies to prevent, deter, and respond to incidents on those navigable waterways. The boat launch is designed to accomplish strategic placement along the bank to provide quick boat access to the river, reducing the gap in security and response time. The boat launch ramp will be built on the west bank of the Mississippi River, at River Mile 97.1, in Gretna, Louisiana (Latitude: , Longitude: ), across the river from the Port of New Orleans on the east bank. The majority of the site proposed for the boat launch is an open gravel lot in an area previously disturbed during construction of a ferry landing and amphitheater. The top of the boat launch ramp will connect to an existing drive thru/parking lot and will extend down the river bank into the Mississippi River. A debris barrier shall be provided to protect the boat launch during high river stages when the ramp is submerged. New fencing and security gate, bollards, floodlights, and security cameras will be provided to provide secure access to the boat launch.

2 -2- The attached figures 1-4 provide the details of the proposed project. REQUESTER: Jefferson Parish Government, Jefferson Parish, Louisiana PERMISSION AUTHORITY: The authority to grant permission for temporary or permanent use, occupation or alteration of any USACE civil works project is contained in Section 14 of the Rivers and Harbors Act of 1899, as amended, codified at 33 USC 408 ( Section 408 ). Section 408 authorizes the Secretary of the Army to grant permission for the alteration or occupation or use of a USACE project if the Secretary determines that the activity will not be injurious to the public interest and will not impair the usefulness of the project. ADDITIONAL INFORMATION: The Federal Emergency Management Agency (FEMA) has evaluated the proposed boat launch ramp for potential construction funding under their Port Security Grant Program [FEMA Project Number 2014-PU (20073)]. The proposed project may affect the following USACE projects: Mississippi River Levees, Mississippi River Channel Improvement (revetment), and Mississippi River Ship Channel. FEMA has prepared a tiered site-specific environmental assessment under their regulations implementing the National Environmental Policy Act (NEPA) and signed a finding of no significant impact, dated December 11, Jefferson Parish Government, working through their contractor, BCG Engineering and Consulting, Inc., has submitted a Clean Water Act Section 404 and Rivers and Harbors Act Section 10 permit application to USACE requesting authorization for those portions of the project within USACE Section 404/10 jurisdictional areas. The USACE Regulatory Branch is evaluating the proposed action as a Programmatic General Permit request which does not require a project specific public notice. The evaluation of the Section 404/10 permit application is a separate process from the evaluation of the request for permission to alter a USACE project. This Public Notice solicits comments only on the proposed alteration of the USACE project. EVALUATION: This request will be reviewed pursuant to Section 408 and USACE Engineering Circular (EC) , which provides policy and procedural guidance for processing requests to alter USACE civil works projects. The decision whether to grant permission for the requested alteration will be based on several factors. The benefits that reasonably may be expected to accrue from the proposal will be balanced against its reasonably foreseeable detriments. Review of the requests for modification will be reviewed by a USACE technical review team considering the following factors: 1) Potential to Impair the Usefulness of the Project. Proposed alterations will be reviewed to determine whether the alteration would limit the ability of the USACE project to function as authorized, or would compromise or change any authorized project conditions, purposes or outputs. If USACE determines that the usefulness of the authorized project would be impaired, the request will be denied. 2) Potential to be Injurious to the Public Interest. Proposed alterations will be reviewed to determine the probable impacts, including cumulative impacts, on the public interest. Factors that may be relevant to the public interest depend upon the type of USACE project being altered and may include, but are not limited to, such things as conservation, economic development, historic properties, cultural resources, environmental impacts, water supply, water quality, flood hazards, floodplains, residual risk, induced damages, navigation, shore erosion or accretion, and recreation. This evaluation will consider information received from the interested parties, including tribes, agencies, and the public. The decision whether to approve an alteration will be determined by the consideration of whether benefits are commensurate with risks. If the potential detriments are found to outweigh the potential benefits, then it may be determined that the proposed alteration is injurious to the public interest. 3) Environmental Compliance. A decision on a Section 408 request is a Federal action, and therefore subject to the National Environmental Policy Act (NEPA) and other environmental compliance requirements. Ensuring compliance is typically the responsibility of USACE. However, in this case, Jefferson Parish Government has requested funding through FEMA, and FEMA is acting as the lead Federal agency responsible for NEPA compliance under 40 CFR The Corps acknowledges that FEMA is the lead agency (and has already prepared an environmental assessment) and that it will act as the lead Federal agency on all environmental coordination. Should the Corps Section 408

4 -4- review (including comments from this public notice) concur with the FEMA findings, the Corps findings would be based on the December, 2015 FEMA environmental assessment. To the extent the Section 408 review requires analysis of impacts not covered by FEMA s environmental assessment, the Corps will conduct that analysis. The environmental assessment will not be published for public comment as this notice fulfills NEPA requirements of public participation. Specific environmental compliance findings requirements which will be considered in the Section 408 evaluation include, but are not limited to, the following: a. A review of the proposed action under Section 7 of the Endangered Species Act indicated the proposed action would not affect listed species or any designated critical habitat. b. The proposed action has been found to be consistent with the Coastal Zone Management Act to the maximum extent practicable. The requester has provided proof of a coastal use permit (C ). c. The requester will be required to provide proof of compliance with Section 401 of the Clean Water Act from the Department of Environmental Quality. d. The proposed action would not adversely impact essential fish habitat. e. Compliance with Clean Air Act of 1970 was documented in the December 2015 FEMA environmental assessment. The proposed action would be located in areas currently classified by the EPA as being in attainment for all criteria pollutants under national ambient air quality standards (NAAQS). f. Compliance with Clean Water Act, Section 404(b)(1) guidelines, as well as Section 10 of the Rivers and Harbors Act will be evaluated through a separate USACE permit review process. EC specifies that the Section 408 request must be evaluated independent of the above referenced USACE permit evaluations. g. FEMA is the Federal lead agency and is responsible for compliance with Section 106 of the National Historic Preservation Act. The Corps acknowledges that FEMA is the lead agency and that it will act as the lead Federal agency on the Corps behalf, fulfilling both agencies collective responsibilities under Section 106. FEMA followed its own internal procedures to meet its 106 compliance responsibilities. All factors that may be relevant to the proposal will be considered, including the potential cumulative effects associated with the proposed project. The review will consider the potential impact to the usefulness of the Federal project and whether the proposed alteration would be injurious to the public interest. Policy and legal compliance will also be considered. USACE is soliciting comments from interested parties to evaluate the potential impacts of the proposed alteration. Comments will be considered to assess impacts on the public interest factors listed above, as well as endangered species, historic properties, water quality, and general environmental effects. Comments will be used for environmental compliance coordination as required by NEPA.

This includes a pre-existing parking lot that can be used for backing the trucks, trailer, and respective boats from the parking lot unto the boat launch. The pre-existing ferry landing building can be used as a Unified Incident Command Post, while the loading and unloading docks can be used for fueling trucks to refuel boats for incidents for numerous operational periods. The graphic also illustrates preexisting ingress and egress locations for the respective equipment and the existing pedestrian bridge. The stage in the photograph is a temporary structure that was captured at the time of this aerial photography.

The picture highlights the aerial overview of the main ground disturbances. The majority of the site impacted is primarily an open gravel lot in an area previously disturbed during construction of the ferry landing and amphitheater. The top of the boat launch will connect to an existing drive thru/parking lot and will extend down the batture into the Mississippi River. The launch will be a pile supported bridge span to connect to the existing drive thru bridge. Since the boat launch will be supported upon piles the primary ground disturbance activity will the area immediately surrounding the piles, approximately 100 square feet compared to the approximately 5,000 square feet comprised of the boat launch. A debris barrier shall be provided to protect the boat launch during high river stages when ramp is submerged. New fencing and security gate, bollards, floodlights, and security cameras will be provided to provide secure access to the boat launch. Conduit will be run on new light poles that will be installed and tap into existing utilities for lighting and security cameras.
