Items on the agenda may be taken out of order. The Board may combine two or more items for consideration. 3 MEMORANDUM Date: January 18, 2019 To: From: Subject: Tahoe Transportation District (TTD) Board of Directors TTD Staff Adopt Resolution Authorizing the District Manager to Execute a Revised Claim for the California State Transit Assistance Funds for the El Dorado County Portion of Lake Tahoe, Including the City of South Lake Tahoe for Transit Operations for Fiscal Year Action Requested: It is requested the Board adopt Resolution for Fiscal Year (FY19) State Transit Assistance (STA) funds for the El Dorado County portion of Lake Tahoe, including the City of South Lake Tahoe, for transit operations administered by the District. Fiscal Analysis: The STA funds are included as part of the Transportation Development Act (TDA) revenue sources in FY19 s budget and used as non-federal match for federal operating grant funds. Work Program Analysis: The work load associated with this action will be accounted for in the Work Program under Work Element 4. Background: The State of California TDA funds are an annual budget source of transit operating revenue that can be used to match federal transit operating grant funds. There are two sources of funds the District is eligible to receive as a transit operator: State Transit Assistance (STA) funds and Local Transportation Funds (LTF). LOCAL TRANSPORTATION FUND (LTF) TDA legislation (SB325) provides a source of financial support for public transportation by allowing counties to impose a one-quarter percent sales tax. The revenue collected from the tax is returned to the county of origin to be redistributed on a population basis. These funds are deposited in a LTF. The funds are allocated by the Regional Transportation Planning Agency (RTPA) for use in the counties based upon the priorities set by the TDA. 4 STATE TRANSIT ASSISTANCE (STA) The STA fund program was established under Chapter 161 of the Statutes of 1979 (SB 620). Funds from the program are derived from the statewide sales tax on gasoline and diesel fuel. STA funding is appropriated to the State Controller for allocation by formula to each RTPA. STA funds are allocated for public transportation purposes. STATE TRANSIT ASSISTANCE (STA) STATE OF GOOD REPAIR On April 28, 2017, Governor Brown signed Senate Bill 1 (SB1) (Chapter 5, Statutes of 2017), known as the Road Repair and Accountability Act of SB1 will provide over 50 billion in new transportation funding over the next decade to repair highways, bridges and local roads, to make strategic investments in congested commute and freight corridors, and to improve transit service. These guidelines address the portion of SB1 that will provide approximately 105 million annually to transit operators in California for eligible transit maintenance, rehabilitation and capital projects. This investment in public transit will be referred to as State of Good Repair Program (SGR Program). The SGR Program is funded from a portion of a new Transportation Improvement Fee on vehicles registrations due on or after January 1, A portion of this fee will be transferred to the State Controller s Office (SCO) for the SGR Program. In collaboration with the SCO, the California Department of Transportation (Caltrans) is tasked with the management and administration of the SGR Program. The funds will be allocated under the STA Program formula to eligible agencies pursuant to Public Utilities Code (PUC) section Fifty percent of the funding is allocated according to population and 5 according to transit operator revenues. TDA funds are processed on an annual basis through a claims process. In the Tahoe Region, claims for these funds are submitted by eligible recipients to the TRPA, as the RTPA. TRPA will evaluate the claims and present them for approval. Once approved, the allocation instructions for the funds are forwarded to the appropriate County Auditor-Controller s Office. The Auditor- Controller will then release the funds to the claimant at regular intervals throughout the fiscal year. As a transit operator, TTD is eligible to receive LTF and STA funds to fund public transit services. Discussion: TTD was notified by TRPA that they received the revised final estimate for STA funds for FY19 from the California State Controller s office. TTD s original allocation was 531,789 and the final estimate raised the allocation to 588,239. TTD is entitled to request the additional 56,450 for use within the El Dorado County portion of the Tahoe Region, including the City of South Lake Tahoe. TTD was also notified that the STA SGR funds had been reduced by 7,695 from 100,786 to 93,091.. At this time, TTD is proposing to submit a revised claim for FY19 STA funds in the amount of 588,239, along with SGR funds for 93,091. Upon Board approval, the claim will be submitted to the TRPA Governing Board, acting as the RTPA. Staff recommends approval of the resolution. JS/ja AGENDA ITEM: IV.A. 6 ATTACHMENT A TAHOE TRANSPORTATION DISTRICT RESOLUTION NO A RESOLUTION AUTHORIZING THE DISTRICT MANAGER TO EXECUTE THE REVISED CLAIM FOR FISCAL YEAR 2018/2019 TO THE TAHOE REGIONAL PLANNING AGENCY, SITTING AS THE REGIONAL TRANSPORTATION PLANNING AGENCY, FOR STATE TRANSIT ASSISTANCE FUNDS WHEREAS, the Tahoe Transportation District (TTD) is eligible to apply for and receive funds from the California State Transit Assistance Fund (STA) for transit capital, transit operations; and WHEREAS, the Tahoe Regional Planning Agency (TRPA), sitting as the Regional Transportation Planning Agency (RTPA), has been allocated a revised estimated amount of 681,330, of which 93,091 is designated for the State of Good Repair Program (SGR) and 588,239 designated for transit operations for the Lake Tahoe portion of El Dorado County, including the City of South Lake Tahoe, for operating and capital assistance for the south shore transit system for Fiscal Year 2018/2019. NOW, THEREFORE, BE IT RESOLVED that the TTD Board of Directors hereby authorizes the District Manager to execute the 2018/2019 Transportation claim to the TRPA, sitting as the RTPA, in the amount of 681,330 in STA funds. 7 MEMORANDUM Date: January 18, 2019 To: From: Subject: Tahoe Transportation District (TTD) Board of Directors TTD Staff Approve Task Order #2 for the Recreation Travel Regional Revenue Action Plan Contract - Morse Associates Consulting, LLC for 375,425 Actions Requested: Staff requests the Board approve the second task order in the amount of 375,425 for professional consulting services (Morse Associates Consulting, LLC) related to the development of regional revenue sources for capital projects, transit services, and operations needed to support recreation travel and the Regional Transportation Plan goals and policies as articulated through local governments and TTD s capital implementation planning. Fiscal Analysis: The full contract award to Morse Associates Consulting, LLC is for an amount not to exceed million. The contract amount reflects an estimate of more than 4,600 consultant hours over a period of fifteen months. Of that amount, TTD has 700,000 currently available. Staff is proposing to reprogram other existing funds from projects as part of a reprogramming exercise to focus the work program and adequately address this project s funding needs, the next phase of the SR 28 multi-use path project, the US 50 East Corridor planning project, and the next phase of the US 50 South Shore Community Revitalization Project. Staff will bring the capital reprogramming item to the Board next month. The reprogramming will require a Federal Transportation Improvement Program (FTIP) amendment. Task Order #2 (375,425) fits within the secured budget amount of 700,000 in Surface Transportation Block Grant (STBG) funds. Task Order #1 was authorized for 332,000, but was finalized at 324,485. Once approved, the expenditures associated with this item for the fiscal year will also amend the FY19 budget. The grand total of the two task orders rounds out to 699,910. Current expenditures associated with the consulting services will be funded through STBG funds, with TTD general funds supplying the match. Work Program Impact: All work associated with this effort is captured under respective elements of the approved FY19 Work Program and corresponding allotted staff time. Background: At the September 2018 meeting, the TTD Board awarded a contract to Morse Associates Consulting, LLC and approved the first task order for up to 332,000. This was after receiving a response to a statement of qualifications and approach request (SOQ) made by Staff on June 29 where it was posted on TTD s website and with the national American Planning Association CH/ja AGENDA ITEM: V.A. 8 service. Several inquiries were received by Staff in response, but only one submission was received at the deadline. The Board heard the work progress on that first task order at the December 2018 meeting and approved the funding gap target, as well as evaluation and selection criteria to be used to determine the proposed funding gap source(s) in the next rounds of work. Discussion: The work in the first task order is nearing completion. So as not to interrupt continuity in the schedule, Staff is proposing to approve the use of funds for the second set of tasks. This work will involve consultations with stakeholders, the collections of ideas, and application of the selection criteria to begin the winnowing process (See Attachment A).
