2 Foreword Avans University of Applied Sciences has been part of the European Union s Erasmus+ programme for education, training, youth and sport activities since The programme aims to promote cooperation in higher education, including student exchanges in the form of a traineeship or period of study abroad. As part of this, there is the opportunity to provide a grant to students undertaking a traineeship or a period of study within Europe. This is known as the Erasmus+ grant. Each year, the Erasmus+ Agency issues a subsidy to Avans, part of which is aimed at facilitating student mobility. In line with the terms and conditions of the Erasmus+ programme, Avans also invests in student mobility itself to encourage its students to undertake a traineeship or study abroad. This makes the opportunity of gaining international experience available to all students at Avans. On that basis and due to the limited resources available, Avans has decided to distribute the resources evenly amongst students who apply for an Erasmus+ grant. These regulations outline the terms and conditions under which a student may apply for a grant. They also contain the procedure that students must follow. In addition, these regulations explain the principle of distributing resources evenly amongst applicants. If a student requires disability-related educational support, they can apply for additional Erasmus+ funding. Note that such students are only eligible if the additional costs for this support cannot be financed from other sources. 5 1 Definitions 1. School: The organisational component (division) within Avans University of Applied Sciences that provides 1 or several study programmes. 2. Erasmus+ Agency: The Erasmus+ Agency, part of Nuffic, is the designated national authority for the Erasmus+ programme. Its responsibilities include establishing the general rules for allocating grants. 3. Avans University of Applied Sciences: The institution (university of applied sciences) based on Avans Foundation that upholds it. 4. Tuition fee obligation: The obligation as referred to in Article 7.37 of the Wet op het Hoger onderwijs en Wetenschappelijk Onderzoek (Dutch Higher Education and Research Act). This obligation remains in force during the period of study or traineeship abroad. 5. Participating countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Macedonia, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey and the United Kingdom MCSR management: Responsible for determining the grant amount and the percentage of the grant to be paid based on the number of days. 7. MCSR: The Marketing, Communication and Student Relations Unit ('Diensteenheid Marketing, Communicatie en Studentenzaken', DMCS). The International Office is part of MCSR and is responsible for enforcing these implementation regulations. 8. Double Degree student: A student following a study programme at Avans University of Applied Sciences, with part of this undertaken at an institution abroad as part of a coordinated programme. 2 degrees are subsequently awarded upon graduation. 9. Erasmus+ programme: The European Union s programme to promote student mobility. 10. Host country: The country in which the student undertakes a traineeship or period of study. 11. Higher education: Academic education and higher professional education. 12. International Office: The team within the Marketing, Communication and Student Relations Unit that is responsible for enforcing these implementation regulations. 13. Learning agreement: The agreement available at studentinfo.avans.nl/international which students must fill in with details of their traineeship of period of study abroad. 14. Second instalment: The payment made once the definitive grant amount has been determined. 15. Ineligible days: The number of days that a student stays in a host country which are not covered by the grant. 1 Different rules apply to Switzerland (See Article ) 5

6 16. OLS: Online Linguistic Support. A programme that measures the student s language development through a test taken before and after the student s time abroad. 17. Participant report: An online evaluation report that the student is required to submit after returning from the host country at the request of Erasmus Partner institution: The educational institution in one of the participating countries with which an inter-institutional agreement has been concluded. 19. Traineeship: A period of vocational training which forms an essential part of the curriculum. 20. Traineeship company: The organisation providing the traineeship. 21. Student: A person registered as a student with Avans University of Applied Sciences. 22. Inter-institutional agreement: A contract between Avans University of Applied Sciences and a partner institution containing agreements made concerning the exchange of students. 23. Payment in kind: A traineeship salary which is not paid in cash, but has an equivalent value. The definition of taxable salary under Dutch law applies. This does not include travel expenses (unless taxable) but it does include the provision of accommodation or meal allowances free of charge or at a reduced price. 24. Advance: The amount that the student receives in their account after their application. This does not count as a provisional allocation of the grant; the amount which the student may claim is only calculated once the definitive grant amount has been determined. 6

7 2 Purpose and scope 2.1 Purpose The Erasmus+ grant is meant as an allowance to cover additional expenses that a student incurs when during a traineeship or period of study abroad under the Erasmus+ programme. These may include costs for insurance, visa application and the cost of living in the host country. The grant is intended as a contribution towards such costs and is not intended to cover all the costs that a student incurs during their stay abroad. 2.2 Scope These regulations apply to students registered with Avans University of Applied Sciences. The terms and conditions that apply in order to qualify for an Erasmus+ grant are described in detail in these regulations For students registered for the Bachelor of Laws study programme with the University of Law Avans-Fontys, these regulations apply only if the student first enrolled with Avans University of Applied Sciences. This means that these regulations do not apply to students who first enrolled with Fontys University of Applied Sciences For students registered for an Associate degree programme with the Avans-HZ University of Applied Sciences Associate degrees Academy in Roosendaal, these regulations apply only if the student first enrolled with Avans University of Applied Sciences. This means that these regulations do not apply to students who first enrolled with HZ University of Applied Sciences These regulations do not apply to students and course participants of Avans+ and those undertaking contracted work for prep courses, language courses and otherwise unfunded education These implementation regulations do not apply to traineeships or study undertaken in Switzerland. If a student wishes to undertake a traineeship in Switzerland, this traineeship must be coordinated by a Swiss educational institution in order to be eligible for a grant. The Swiss educational institution will decide whether a grant will be allocated for a traineeship or period of study. 7

8 3 Terms and conditions 3.1 General The following terms and conditions apply to all applications for an Erasmus+ grant: - Students must be registered with Avans University of Applied Sciences. - Students must be enrolled for a study programme for which a recognised higher education diploma is awarded. - Students must continue to be registered with Avans University of Applied Sciences during their stay in the host country and must meet their tuition fee obligation. - Students must spend their period of study or traineeship in a participating country, not in the Netherlands or their usual country of residence. - The application may only be submitted for semester 1 or semester 2. - Students must remain in the host country for the entire period of study or traineeship to which the application relates. - Students must have permission from their school; additional requirements may apply. 3.2 Studying If the grant application covers a period of study, then the following additional terms and conditions apply: - The student is studying full time in the host country. - An inter-institutional agreement must be concluded with the partner institution in the host country. 2 - The student must study in the host country for at least 3 consecutive months but no longer than 12 months. 3.3 Traineeship If the grant application covers a traineeship, then the following additional terms and conditions apply: - The traineeship must be undertaken for at least 36 hours per week, for at least 2 consecutive months but no longer than 12 months. - The traineeship salary (whether in kind or not) must not exceed 299 gross. 3.4 Reasons for rejection An application may be rejected if: - the student intentionally provides false information - the maximum study duration of 12 months exceeds 12 months in total - the student s application does not comply with the applicable deadline in Article 4.1 or 4.2, in so far as the deadline cannot be moved - permission has not been granted or has been revoked by the school - the student has submitted multiple applications which cover the same period, either in whole or part. The rejection of an application will not be upheld if this causes serious unfairness, in the International Office coordinator s opinion. 2 The student should ask the school whether this is the case. 8

9 4 Deadline for application Grant applications may be submitted for semester 1 and/or semester 2. Applications must be submitted by the deadline. 4.1 Semester 1 - The period between: 1 August to 31 January - Grant application deadline: 30 June in the prior semester - Deadline for school approval of the application: 15 June (See Article 4.3) 4.2 Semester 2 - The period between: 1 January to 31 July - Grant application deadline: 30 November in the prior semester - Deadline for school approval of the application: 15 November (See Article 4.3) 4.3 School approval for working/studying abroad Before a grant application may be submitted, the school must give its permission in Osiris for the student to undertake a traineeship or period of study abroad (See Article 3.1). If the student submits their application for consideration by the school by 15 June or 15 November (whichever applies) but the school fails to issue a decision by the grant application deadline, then the deadline may be moved. If a student is late in submitting their application for consideration by the school, for whatever reason, then this will be at the student s own risk. Please note that once the school has given permission, the student must submit their application in Osiris, as explained in section Extending the stay abroad If the student wishes to extend their stay abroad once the grant period comes to an end and wishes to receive an Erasmus+ grant for the additional stay, then a new application must be submitted for the additional period. All requirements that applied to the original application also apply to the new application, especially the deadlines referred to in Articles 4.1 and Double Degree students Only double Degree students may submit a single application that covers semesters 1 and 2. All other students must submit a separate application for semester 1 and semester 2. 9

10 5 Application content and pre-departure obligations The application must be complete before submission and approved by the International Office. The student will then be asked to take the OLS test. The advance will only be paid once all predeparture obligations have been fulfilled. 5.1 Submitting the application in Osiris The grant application must be submitted in its entirety in Osiris. The before section of the learning agreement must be completed and signed by all parties, specifically the student, school and partner institution/traineeship company. This must be uploaded in PDF format before the deadline. Before a grant application can be submitted in Osiris, the school must approve the stay abroad. Please note that the application is only submitted if all the required sections have been filled in and Submit has been clicked. If you have any questions, please contact the International Office. 5.2 Filling in contact details Before a student may commence their period of study or traineeship abroad, they must provide their contact details for their stay abroad. If the student does not yet have an address abroad, then the details of the traineeship company/partner institution must be entered instead. Please note that the student must provide their details in good time. If the contact details for the host country are still unknown at the time of departure, permission for the stay abroad will be revoked by school, in line with the Regulations on trips and stays abroad ('reglement internationale reizen en verblijven'). 5.3 Completing the Online Linguistic Support assessment A link is sent from Erasmus+ Online Linguistic Support (OLS) to the student s Avans address for the student to take the test. The link will only be sent once the completed application has been submitted and approved by the International Office. Pursuant to EU requirements, the test must be taken both prior to departure and upon return, in order to assess the student s language development. The test must be taken within 5 days of receipt. The grant advance will only be paid once the test has been taken and all other terms and conditions have been met. 10

11 6 Determining the grant amount and payments Annotation: The Erasmus+ Agency determines daily and monthly allowances 3 per category of country and depending on whether the grant is related to a traineeship or to studying. The grant amount is determined based on the length of the student's stay abroad. A maximum budget is made available, consisting of the grant from the Agency and a contribution by Avans University of Applied Sciences. This budget must be divided to ensure that each student who wishes to go abroad to study or for a traineeship can apply for a grant. If the total budget is not exceeded, each student will be allocated the complete grant to which they are entitled. If there are more applications than money available, the budget will be divided between the applications. This means that the final grant amount might not yet be known upon departure. Students are assured that they will have at least 70% of their application granted. The student receives this amount prior to departure. If it has been ascertained that the budget will be or is expected to be exceeded, a percentage of the number of days eligible for a grant will be determined. This percentage will be announced by no later than 1 January of the current academic year on studentinfo.avans.nl/international Studying abroad Grant options Erasmus Determining the advance The student indicates the period of their stay abroad on their application. The maximum grant amount allocated to the student is determined using the period of the stay and the daily and monthly allowances paid by the Erasmus+ Agency. 70% of this amount will be paid to the student as an advance. The student is only entitled to the complete grant amount if they have met all the obligations during and after their stay abroad, as described in chapters 7 and 8. Example: If, using the calculations indicated, the student is entitled to a maximum grant amounting to 1,000, the student will be paid an advance of 700. This advance may be reclaimed if the student appears not to be entitled to the grant The advance is paid no later than on the date of the departure of the student. Generally, the advances are paid on or around 1 September or 1 February or later if the file has been completed by the student before departure. 6.2 Determination of the definitive grant amount in case of no budget overrun If the maximum budget is not exceeded, the management of the Marketing, Communication and Student Relations Unit (MCRS) will fix the percentage to be paid at 100% of the number of days The grant amount is determined once it is ascertained that the student has met all the requirements for being awarded the grant. Subject to a change in the length of the stay abroad, the grant amount equals the maximum grant amount as defined in article The second instalment After the definitive grant amount has been determined, a final settlement is calculated If the definitive grant amount is higher than the advance, a second instalment is granted. If the definitive grant amount is lower than the advance, which can only occur if the student stays abroad for a shorter length of time than indicated on their application 4, then the student must pay back the difference The second instalment or invoice for the repayment follows no later than 8 weeks after the 3 The amounts are published on studentinfo.avans.nl/international 4 The calculation method applies a guaranteed 70%, which ensures that the student will receive the advance as the minimum definitive grant amount unless they return sooner. This is on the condition that the student meets all the obligations of the regulations. Otherwise the student has to repay the advance. 11

12 definitive grant amount has been determined. Example 1: Using the definitive period of the stay abroad, the determined percentage and the published amounts for the calculation, the student is entitled to a definitive grant amount of 945. The student has already received 700 as an advance. Thus, the student will receive a second instalment of 245. Example 2: The student returns several weeks earlier from their stay abroad. As a result, the definitive grant amount is fixed at 600. The student will then receive an invoice for Determination of the definitive grant amount in case of budget overrun If the budget is exceeded, a percentage will be calculated for the number of allocated days. This will be between 70% and 100%. The specific percentage will be determined by the MCSR management before deciding on the grant amount, following the return of the student When calculating the percentage that is eligible for allocation, the total number of applications will be divided by the maximum budget (and then multiplied by 100 to arrive at a percentage). This calculation will result in less than 100%. Even if the result is a percentage below 70%, it will be fixed at 70% The Board will determine the percentage by no later than 1 January of the current academic year and will publish this on studentinfo.avans.nl/international Studying abroad Grant options Erasmus+. Converting percentages to number of grant days Once the percentage is known, it has to be converted into the number of grant days The maximum allocated percentage is converted to the number of days that the student is entitled to the grant. These days are always rounded off to full days. This means that 0.5 to 0.99 days are rounded off to a full day and anything below 0.5 days is rounded off to 0 and does not count as a grant day. The percentage of days which are not eligible for a grant are referred to as ineligible days. In this case, the last days of the application count as ineligible days. Calculation example The student is going abroad for 120 days and is eligible for an Erasmus+ grant. The percentage has been defined at 93% in accordance with article x120=111.6 days, which is rounded off to 112 days. The student is eligible for the grant on these 112 days. The student will not receive a grant for the remaining 8 study or traineeship days. These days are calculated as ineligible days. Definitive amount of the grant is determined The grant is calculated using the same system as referred to in article and is based on the number of days that the student is eligible to receive a grant. First, the full months are allocated using the applicable monthly payments. The remaining days are multiplied with the applicable daily payments. These amounts are published on studentinfo.avans.nl/international Studying abroad Grant options Erasmus+. The second instalment After the definitive grant amount has been determined, a final settlement is calculated If the definitive grant amount is higher than the advance, a second instalment is granted. 12

13 If the definitive grant amount is lower than the advance, which can only occur if the student stays abroad for a shorter length of time than indicated on their application 5, then the student must pay back the difference The second instalment or invoice for the repayment follows no later than 8 weeks after the definitive grant amount has been determined. Example 1: Using the definitive period of the stay abroad, the determined percentage and the published amounts, the student is entitled to a definitive grant amount of 945. The student has already received 700 as an advance. Thus, the student will receive a second instalment of 245. Example 2: The student returns several weeks earlier from their stay abroad. As a result, the definitive grant amount is fixed at 600. The percentage will be applied to these days if applicable. 5 The calculation method applies a guaranteed 70%, which ensures that the student will receive the advance as the minimum definitive grant amount unless they return sooner. This is on the condition that the student meets all the obligations of the regulations. Otherwise the student has to repay the advance. 13

14 7 Obligations during the stay 7.1 Changes to the study or traineeship Students have to report all significant changes to their study or traineeship to the International Office. If these changes relate to the study or traineeship, the section during of the learning agreement must be amended. The amended learning agreement must then be signed by all parties involved. The amended learning agreement can be uploaded to Osiris after the student has requested permission from the International Office at 7.2 Changes to contact details If the contact details of the student change during their stay abroad, the student must immediately register this in Osiris. 14

15 8 Obligations following return from abroad Only once all the steps referred to below have been completed, will the definitive grant amount be determined. The student must have met all the obligations of the grant application by no later than the deadline stated in article 8.1. If the student does not meet the obligations outlined in the regulations, this will result in a recovery of the advance or grant that has been paid out as described in Chapter Deadline for completing the file For semester 1, which ends on 31 January, the file must be completed upon return by no later than 1 April. For semester 2, which ends on 31 July, the file must be completed upon return by no later than 1 October. Students will receive 2 reminders which will be sent to their Avans address. The first reminder will be sent 4 weeks before the deadline and the second reminder 2 weeks beforehand General Participant report The participant report must be filled in by the student after their grant period has ended. The student will receive an invitation from Erasmus+ on their Avans address, which must be completed within 30 days. OLS language assessment Following their return, the student is required to take the OLS language assessment to measure their language progress. The student will receive an invitation for the assessment on their Avans address. If the student scored at the C2 level (the highest level) before the start of their period abroad, they do not need to take the test again after their return. The test must be completed within 10 days of the invitation being sent. 8.3 Additional provisions for the study The following provisions apply if the student returns after having studied abroad. Transcript of records The student must submit a transcript of records from the partner institution, which states the start date and end date of the study. If the start and/or end date of the study are not listed on the transcript of records, a statement of home/host must be submitted. These documents must be uploaded to Osiris If no transcript of records from the partner institute is available, the section after of the learning agreement must be completed as an addition to the learning agreement, including the start date and end date and the marks achieved. This must then be signed by all parties involved, namely the student, the school and the partner institute. 8.4 Additional provisions for the traineeship The following provisions apply if the student returns after having completed a traineeship abroad. Learning agreement, section after The student must ensure that a completed and signed version of the learning agreement, including the section after, is uploaded to Osiris. For the practical details of how to work in Osiris in order to meet these obligations, please see the relevant information published on studentinfo.avans.nl/international. If the student does not receive an invitation for completing the participant report and/or the OSL language assessment, 15

16 the student must contact the International Office as soon as possible. It is the responsibility of the student to meet all the obligations of the regulations on time. 9 Recovery Recovery applies when a student is entitled to an amount that is less than what was paid as an advance. This might apply if the student has not completed all the obligations of the regulation before the deadline. Recovery might also apply if the student decided to return from abroad earlier or if it turns out that student was not entitled to receive an advance. Recovery can apply up to 5 years after the definitive determination of the grant amount. 9.1 Recovery of the complete grant amount or advance If it turns out afterwards that the student has submitted incorrect information, based on which they were granted an advance payment or a complete grant, the student is obliged to pay back the full amount to Avans University of Applied Sciences following a decision to that effect. If the student, for which reason whatsoever, decided not to go abroad for their study or traineeship they are obliged to pay back the full amount of the advance. A student who fails to hand in the transcript of records or the after section of the learning agreement and statement home/host within the set term and in the stated manner, is obliged to repay the advance in full. 9.2 Non-payment of remaining grant amount/recovery of advance The remaining grant amount will not be paid if the student does not submit the OLS language assessment and the participant report before the deadline and in the correct manner. If, for this reason, the Erasmus+ Agency decides to recover the grant paid to Avans University of Applied Sciences, Avans University of Applied Sciences reserves the right to recover the advance from the student. 9.3 Recovering part of the advance If the determined grant amount is less than the advance, the student is obliged to pay back the difference. 10 Hardship clause The coordinator of the International Office is authorised to respond to cases of extreme unfairness that may arise in the application of this regulation, as well as to take decisions that are not provided for by these regulations.
