Recor, ICMA-CM, City Manager RE: Department Activity Report DATE: December 15, 2011 The information that follows is intended to keep the Commission abreast of the on-going activities, issues, programs and services within the City. City Manager s Office City Manager City Manager met with specific department heads to discuss issues, activities and follow-up status reports. The City Manager met with the City Attorney, Public Works Director and Administrative Services Director to discuss the public records request from BGA, Inc., a ConEdison Solutions Company. The City Manager met with Commissioner Perona to discuss city issues. City Manager participated in a conference call with the City Attorney to discuss the Sunrise Theatre. The City Manager met with Commissioner Alexander and the City Attorney to discuss the bid protest filed by ConEdison. The City Manager met with the City Attorney, Interim Planning Director and Interim Assistant Planning Director to discuss personnel issues. City Manager met with the City Attorney, Assistant City Attorney and Director of Public Works to discuss the revised proposed Waste Management agreement. The City Manager, Mayor, Communications & Marketing Manager and Urban Redevelopment Director participated in a conference call with Brian Sullivan to discuss advertisement in a segment called Communities of History and Distinction. The City Manager, City Attorney, Assistant City Attorney and Public Works Director met with representatives, Jeff Sabin and Dennis Corrick of Waste Management to discuss the revised proposed Solid Waste agreement. City Manager attended the PAL Park/Center opening on Thursday, December 8, City Manager met with the MIS Director to discuss leasing new computers through CSI Leasing. City Manager, Mayor and Code Compliance Manager met with Susan Parry and Janice Dickinson with United Way 4 Animal to discuss Animal Control issues. City Manager met with the Building Official to discuss a dock dispute. City Manager met with the Marina Director and staff to discuss Marina issues.

City Manager held the Conference Agenda Meeting on Monday, December 12, City Manager, Commissioner Sessions and the City Attorney participated in a conference call with Jeff Weidner from the Florida Department of Transportation to discuss the Port Master Plan agenda item. Communications & Marketing Manager Participated in a conference call with the Mayor, City Manager, and FPRA Director regarding an advertising opportunity for the City in the Today in America series. Conference call with St. Lucie County Assistant Administrator Lee Ann Lowery and FPRA Director to discuss public art maintenance and transference of sculpture to City within city limits. Secondly, discussed the City s River Walk Center programming, rental and facility amenities. Lunch presentation to the Fort Pierce Kiwanis and Rotary groups on holiday happenings in the City. Participated in the monthly Fort Pierce update WCCI Channel 10 Vero Beach. Attended the December 12, 2011 Conference Agenda. Held a successful PAL Park/Center Ribbon Cutting on December 8, 10:00 a.m. Approximately 100 attended the event. Reviewing annual contractor/instructor agreements for River Walk Center with staff. Attended the December Tourist Development Board meeting.

3 December 19, 2011 City Commission Meeting Page 3 City Clerk s Office Gave assistance and answered questions to the walk-in public on various aspects of Business Tax Receipts which include but is not limited to: New Applications: 11 Renewals: 66 Transfers: 2 Gave assistance and answered questions to the walk-in contractors on various aspects of Contractor s Licensing which include but is not limited to: New Applications: 4 Renewals: 7 Gave assistance and answered questions from the public who have contacted office by phone: 503 Assisted public with questions received via through the City s web-page. Assisted the public by researching and providing copies of various public records. Assisted public by providing DVD copies of City Commission Meetings. Assisted the public by processing paperwork and payment associated with animal registration. Prepared monthly animal registration report and submitted to Code Enforcement Manager. On-going updating of contractors records for current Liability Insurance, Workman Compensation Insurance, and State License information. Prepared legal advertisements, letters, resolutions, & ordinances for various departments for upcoming City Commission agenda items. Prepared several Proclamations. Attended, recorded and transcribed minutes of the City Commission Meeting on December 5, Daily balancing process of cash receipts and submittal to Finance Department for bank deposit. Revenue Recovery working with Code Enforcement on new businesses that have not applied for a Business Tax Receipt. Licensing/Permit Clerk gave courtesy calls to businesses that received renewal notices for the 2012 year and have not renewed. On-going implementation of scanning City Commission Agenda Packets onto DVD s. On-going implementation of computerization of annexation records. Assisted MIS Department in correcting and adding unit numbers to existing address data base. On-going implementation of scanning City Commission Meeting minutes, ordinances, resolutions, and the Fort Pierce Redevelopment Meeting minutes into the Optiview system. Prepared and delivered various paperwork to SLC Courthouse Recording Division to be recorded. Assisted Code Enforcement by providing certified copies of code liens to be filed by Code Enforcement with the St. Lucie County Clerk of Court.

Assisted Finance Department with invoices received from Scripps Newspaper for advertisements and invoices received from St. Lucie County Clerk of Court for recordings, to determine which departments are to be billed. Assisted Finance Department by signing and affixing the City Seal to necessary paperwork associated with release of liens. Assisted Planning Department by answering questions pertaining to business tax applications. Assisted Planning Department by providing copies of ordinances on rezoning and conditional uses. Assisted City Attorney s Office by researching and providing copies pertaining to various city issues. Assisted the Executive Assistant for the City Manager by researching and providing a copy of a resolution for back ground material for the Agenda Conference Meeting on 12/12/11. Established in computer system two Business Tax classifications and the associated fees, pertaining to Arcades, approved by City Commission at the City Commission Meeting on 12/5/11. License/Permit Clerk participated in decorating the Christmas tree in lobby of City Hall. Finance Department Met with City Manager, City Attorney and Public Works Director. Met with Building Official and Staff. Prepared Financials for Month End. Prepared for FY 2011 Audit. Prepared Budget Award Document.

Met with Marty Petlock to discuss catering RFP. 3. Met with City Attorney, City Manager and Public Works Director to discuss Energy Performance Contracting protest. 4. Met with an employee to discuss hostile work environment complaint. 5. Met with an employee to discuss grievance procedures. 6. Met with HR Manager to discuss Civil Service Appeals. Procurement 1. Opened two bids for FPRA for CBDG Housing Rehabilitation Projects. 2. Opened one bid for FPUA for Janitorial Services. 3. Prepared one solicitation for formal bid process for the FPUA. 4. Processed and/or completed awards to vendors/contractors approved by Commission/FPUA Board and processed FY 2012 annual contracts/fpua & City. Risk Management 1. Implemented New Wellness Program with a Point System. 2. On-site Health Fair with Blue Cross/Blue Shield - January 30, Collaborating with vendors for on-site Health Fair. 4. Attended Post Accident Review Meeting - Public Works Department. 5. Collaborated with Florida League of Cities to close WC claims. 6. Filed subrogation against several insurance companies. 7. Processed new WC claims. 8. Processed day to day Risk management duties. Human Resources 1. Coordinated pre-employment physicals and background checks. 2. Created several Personnel Action forms for employees. 3. Distributed monthly reports to each department such as accrual register, time sheets and payroll register to Police Department. 4. Processed purchase orders and requisitions. 5. Verified payroll. 6. December 2011 employee monthly evaluations. 7. Completed Verification of Employment/Loss of Income forms.

6 December 19, 2011 City Commission Meeting Page 6 Police Department PAL Center On December 8, 2011, the City held a grand opening for the new PAL Center located at the site of the old YMCA. Public Works is continuing to make improvements to the building and park areas, but PAL will start moving into the facility over the next few weeks. Murder Investigation Detectives are investigating the murder of Verdell Sloan, an elderly female that was found in her residence at 808 Orange Avenue on December 8. Crime Watch The Police Department has completed certification training for the Edgartown Crime Watch. Parks Ordinance Chief Baldwin has revised the draft ordinance to address issues pointed out by the City Attorney s Office. The draft is being circulated for a final staff review and targeted for presentation to the City Commission in January. MIS Department Working with ATT & State of Florida for new telephone systems citywide. Completed work with FPUA on PW/SW internal network. Urgent need to secure funding for additional routers citywide or connectivity problems will escalate. Working currently in parallel mode with regular manual agenda and the NovusAgenda (paperless agenda package) still having user issues. Working on Blade Center servers and remote site servers and continued dialog with SunGard HTE technical staff to complete setup of the Blade Center. Working with Delta Petroleum, Public Works/Fleet Maintenance and Finance on a resolution to our fuel system updated fuel controller and the fuel usage conversion to the City s mainframe. Software integrations citywide (on-going). Working with Diebold and HR on security issues, including activating new employees or replacing lost security cards. Working with State of Florida DMS, GSI Hosting & SunGard HTE on Click2Gov Building Permits (ongoing). Working with AT&T and State of Florida on the fiber optic installation preparation for Public Works/Solid Waste (ongoing). Lotus Notes IQsuite spam, and archiving (ongoing). Processing the firewall upgrades for all sites to enhance network security (ongoing). Updating MIS documentation and procedural policies (on-going). Received sixty five (65) new work orders and completed seventy six (76) work orders.

7 December 19, 2011 City Commission Meeting Page 7 Building Department Developments 1. Cortez Blvd: This project is nearing completion. The road is being prepared for paving. 2. SLC Clerk of Courts Project: A conditional Certificate of Occupancy was issued for the third and fourth floors of this building. 3. Lawnwood PICU: Final inspections for this project are being scheduled. 4. Waste Pro: The applications for building permits were received in the Building Department on 11/23/11 & 11/29/11. They have been routed. 5. McDonalds: This project is progressing well. Public Works Department PAL Park Project Complete. Energy Efficiency & Conservation Public Works Department staff has only one energy conservation measure remaining for City Hall as part of the U.S. Energy Department Energy Efficiency & Conservation Block Grant (EECBG) Program. The lighting retrofit project is approximately 60% complete and currently being performed within City hall by Facilities Maintenance personnel on an interim basis as time permits. The City Commission decided to table all issues with respect to RFQ 6052 Energy Savings Performance Contracting at their December 5, 2011 meeting. A presentation of the progress of the Energy Efficiency & Conservation Team will be presented to the City Commission on December 19, Beach Erosion The Public Works Department has initiated the restoration of the rock revetment along the concrete cap of the south jetty at South Jetty Park. This project is anticipated to be completed within the next 30 calendar days. St. Lucie County has placed another 200 cubic yards of beach grade sand on the dune near the severely eroded beach. This process will continue until the United States Army Corps of Engineers project begins in Solid Waste Disposal Options Contract negotiations are continuing at this time with Waste Management. Downtown Exotic Vegetation Removal Several tons of vegetative debris were removed from the area just south of the Boston Avenue right-of-way in a collaborative effort between the Fort Pierce Police Department and Public Works Department. The vegetation was removed as a public safety initiative following several complaints about vagrant activity in the area immediately adjacent to the nearby private school.

8 December 19, 2011 City Commission Meeting Page 8 Engineering Department A1A Phase I 1. Paving of the southbound travel lane from Gulfstream to Avalon is scheduled for 12/9/11. Once this is complete, the contractor will open up South Ocean Drive to two-way traffic between Seaway and Avalon while maintaining one-way traffic between Avalon and Gulfstream. 2. Street lights, irrigation, and Royal Palm trees are currently being installed along South Ocean Drive. 3. All the storm drainage along South Ocean has been installed. 4. The underground electric construction and potable water installation is on-going along Seaway. 5. The Bayshore Drive drainage outfall construction is underway. 13th Street (Orange Ave to south of Ave D) In process of preparing FDOT final reimbursement. Preparing FDOT/FHWA final closeout documents. 29 th Street (Orange Ave to Ave Q) Construction underway. Oleander Ave./Sunrise Blvd. Sidewalk and Bike Paths Staff is reviewing the 100% design plans. Comments are due back to FDOT on Roadway construction commencement is slated to begin January Development Reviews Intake of five Building Permits, Site Plans, and Certificate of Occupancy reviews. 10th Street Reconstruction SLC conducted the bid opening on 11/16/11. The bids are currently being reviewed. The proposed work includes the reconstruction of 10 th Street from Citrus Avenue to Moore s Creek. The 10 th Street improvements include the undergrounding of electric, infrastructure replacement, sidewalks, curb & gutter, street lighting, and landscaping in accordance with the $1.9 million CDBG Grant. Jetty Park Reconstruction FDOT has provided preliminary comments and the plans are being revised in accordance with said comments. Awaiting receipt of our permit modifications from SFWMD and FDEP prior to final acceptance by FDOT. City Marina Reconstruction - Phase I City and Tetra Tech are completing a value engineering analysis and revised drawings that should be presented with the Lucas Marine LLC contract for Commission approval 1/3/12. The proposed value engineering proposal will provide enough cost savings to keep the project within FEMA s budget constraints. Engineering and Tetra Tech are finalizing specific authorizations for construction services, regulatory monitoring and required mitigation work for permit compliance. Street Resurfacing One of the City s Policy Agenda Action Items, Roadway Resurfacing and Reconstruction ; Staff has divided the City into maintenance sections, listing poor condition roadways. We are currently working on one section, re-evaluating street conditions, providing maps, spreadsheets, and cost estimates to enable a true and equitable methodology of cost assessment. Field investigation continues rating condition of roadway, curb, and sidewalk. Report shall also include estimated construction costs for underground electric conversion, street lighting and landscaping. Anticipate presentation to City Commission in January. Pinecrest Subdivision Drainage Improvements SLC has awarded the construction contract to the low bidder, Guettler and Sons Construction. The project is a CDBG Disaster Fund project being done through a joint partnership with St. Lucie County. Project entails canal widening, bank stabilization and drainage infrastructure improvements. Construction commencement scheduled for the beginning of January. Avenue E at Snake Ditch Plans have been forwarded to Public Works and FPUA for review. Frances Avenue Storm Drainage Replacement Plans have been forwarded to Public Works and FPUA for review. The bid document preparation is underway.

Atlantic Avenue Storm Drainage Replacement Preparation of design plans for the retrofit of the existing decrepit storm drainage system along Atlantic Avenue from 5 th Street to 7 th Street. Avenue F and 6th Street Drainage Improvements Plans have been forwarded to Public Works and FPUA for review. Bid plans and cost estimate are 100% complete. Stormwater Division Kimley Horn has begun research and evaluation of storm water user fees collected by the city s SMU. Update meeting scheduled for 12/16/11 with consultant. The school board has determined it will no longer pay their storm water user fees totaling $ 63,102 per year, but reduce the amount to $30,472. The school districts rationale is the same as Westside Baptist Church that they should be exempt if their storm runoff does not drain directly into a City owned facility. Coordination continues with City Attorney s office reviewing existing methodologies for collection of user fees in response to filed law suit. Traffic Control We continue to work with FDOT for a $245,000 JPA to upgrade the computerized traffic control system. FDOT is preparing the JPA documents for submission to the City for execution. We should be ready to submit to Commission the revised JPA agreement by the beginning of the year. S. 21st Street / Havana Ave. Sidewalk Project A Project Kick-off meeting was held at FDOT District IV offices on Funding has been approved by FDOT for FY Garden Avenue Sidewalk and Pedestrian Bridge A Project Kick-off meeting was held at FDOT District IV offices on This project is being funded by a Transportation Enhancement grant through the St. Lucie County TPO. The project entails sidewalk on both sides of Garden Avenue from Oleander Avenue to the Mayflower Canal and a pedestrian bridge crossing Mayflower Canal connecting the neighborhood with Sabal Palm Shopping Plaza. The consultant is currently gathering the required field information as deemed necessary for design purposes. Funding has been approved by FDOT for FY st Street Sidewalks from Okeechobee Road to Tennessee Avenue A Project Kick-off meeting was held at FDOT District IV offices on This project is being funded by a Transportation Enhancement grant through the St. Lucie County TPO. The project entails the installation of approximately 1,850 LF of sidewalks along 31 st Street from Okeechobee Road to Tennessee Avenue. Funding has been approved by FDOT for FY 2014.

Writing new FHWA grant application to fund pedestrian crossing and intersection improvements at US Hwy 1 and Orange Ave. ($280k project) 2. Held first development committee meeting for Highwaymen Trail grant application to Florida Humanities Council ($15k grant plus $15k match from CDBG, if CWC approves.) 3. Researched grant opportunity to NEH for development of interactive website commemorating the WW2 amphib base on S. Hutchinson Island. 4. Preparing to write EPA application to fund Urban Waters grant for water quality grant for Moore s Creek. 5. Researched NEA grant for creation of Arts District in Fort Pierce. Grant will assist creative class in renovating structures for mixed use residence/studio uses. 6. Second meeting with TCRPC re: EPA brownfield coalition grant. Listed potential project sites. 7. Met with County/Heathcote and City reps to iron out City s role in Heathcote development, including requirements for FCT grant management. CDBG/SHIP 1. Construction rehab bid openings held for 710 N. 23 rd St. and 1909 Juanita. 2. McMillon project had final inspection, Brown job in progress. 3. Enterprise Zone annual report completed and mailed to State. 4. Drafted Subrecipient agreements for CDBG non-profit agency grants. 5. Purchase offer for property east of Kings Inn verbally accepted by seller. 6. Continue responding to potential purchase calls for NSP houses. 7. Finalized CDBG CAPER report, forwarded to HUD FPRA/NSP Activities 1. Received bond info for Orange Avenue Apartments project. Application for building permits submitted. Vagrant issues in buildings re-addressed, new board-up. 2. Prepared reports for re-hearing from Historic Preservation Board for 827 Atlantic rehab. 3. Met with DEP for King Plant submission to State brownfield program. Subsequent meeting with DEP staff in Tallahassee. King Plant approved for program, FPRA accepted as applicant and OK for three separate BSRAs for project. 4. Meetings held with potential lessees for portions of Fisherman s Wharf building. Administrative/Financial 1. Continue to handle daily financial activities of Sunrise Theatre. Assigned project codes for new shows, finalized P.O.s for current year, evaluated cost savings measures re: invoice payment by credit card, process all charges for vendors, process payroll. 2. Florida Hardest Hit program: 78 cases handled to date. 3. File NSP monthly financial report, reconcile CDBG as of 9/30, made revisions to CDBG policies and procedures per HUD guidance. 4. Served as consultant to City of Pompano Beach on committee to select architect for new library. 5. Attended State Attorney s presentation on public records in Vero. 6. Held December FPAT meeting.

Animal Control Hearing Next Hearing December 12, 2011 Code Enforcement 1. Received 28 complaints. 2. Initiated 43 new cases. a) 11 general violations. b) 32 lot clearing violations. 3. Conducted 221 follow-up inspections. 4. Closed 62 cases. 5. Continued investigation of businesses without current Business Tax Receipts in conjunction with the City Clerk s office. Animal Control 1. Responded to 109 dispatched calls. 2. Conducted 166 self-initiated calls. 3. Conducted 46 follow-up investigations. Income and Expenses 1. Processed 22 lien / title search requests. 2. All lien & fine case folders are being manually reviewed and updated to address past due accounts (on-going). Miscellaneous 1. Most parcels on the main corridors have been put out to bid and lot clearing work should commence next week. Due to legal requirements some lots will be completed in a 2 nd bid list. 2. Met with City Manager Recor, Mayor Benton and United for Animals representative to discuss complaints regarding the Humane Society. New procedures are put in place requiring the Animal Control Officers to report any event they feel violates the law or are inhumane to the Code Compliance Manager immediately and it will be forwarded to the Humane Society Management for follow up. 3. Animal Control Officer Blue was injured while investigating a dog bite report. The dog owner deliberately released the dog, which charged ACO Blue, knocked him to the ground and inflicted 3 bites on his right forearm. ACO Blue will return to full duty on Monday, December 12, Met with City Manager Recor for a drive through of the community identifying areas to be addressed by Code Enforcement. 5. Attended PAL Park ribbon cutting. 6. Updating Naviline System to close inactive / old case files (on-going). 7. Updating Naviline System to correct errors that occurred when cases transferred from the old system to the new system (on-going).

The City Public Works Department has closed off all beach access points from the Jetty Park boardwalk. This sand placement will continue once every 30 days until the Federal spring 2012 ACOE beach sand replacement project starts in January 1, Also, I attended the ACOE pre construction meeting for Federal sand placement with SLC on December 6, Inlet Linear Park: Working on updating the specifications of work required for phase II of the project. 6. Jetty Park: Now under Engineering Project management. 7. Heathcote Botanical Gardens / Park: New Director for the Botanical Gardens has been selected and will be introduced after all paper work is completed. Continuing to work on the Botanical Park master plan with the Heathcote Planning team. Engineering Department and Public Works coordinating the SFWMD stormwater grant application and work associated with new park and construction of the Phase I elements. 8. IDI Conservation Area: Working on presentation to the City Commission to accept ownership and management responsibility for IDI s SFWMD s Conservation Easement since SLC declined ownership. 9. Everglades Restoration Project: Monitoring the developments with the SFWMD 10 mile creek 5000 acre water treatment and holding area and the ACOE retro fit and dike stabilization project that is located adjacent to the City limits on Gordy Road. 10. Planning GIS work: Scheduling data collection time for billboards in the city, historic live oak trees, beach erosion and multipurpose trails, with Trimble GIS recorder. 11. Greenways and trails: Developing a property ownership list of specific sections of the proposed trail so as to maintain connectivity with the East Coast (Key West to Canada) bike trail, Heathcote Botanical Park and environmental land preserves. 12. Old Fort Park: Development of a park master plan. 13. Planning Department LDR project - Attending meetings for the new City Code Chapter Tree Removal permits: 3 applications processed. 15. Building permits: Review, inspection and approval. In process of creating 1st Annual Oyster and Seafood Fest - April 7, Continuing to install security cameras throughout marina. Sunrise Theatre Over the past two weeks, the following performances and activities were presented in the Sunrise and Black Box Theatres: Performances and events in the Black Box included: Fort Pierce Jazz and Blues Society and the Sunrise Theatre co-presented Jazz Jam on November 29th & December 6th; Comedy Corner on November 26th; All Star Comedy Jam November 23; on November 27th a Memorial Reception was held in the Black Box for Richard Hellstrom, a strong supporter of the Sunrise Theatre, who passed away earlier in the week. Performances on the main stage included: Chi of Shaolin on Sunday, November 20 followed by a School TIme Performance on Monday, November 21; Kings of Salsa, November 26; Fort Pierce Police Department held an all day law enforcement seminar on December 1; Comedian Steve Solomon presented his one-man show "My Mother's Italian, My Father's Jewish & I'm Home For The Holiday's" on December 3. New additions to the 2011/12 Season just announced are Vince Gill on March 4, 2012, for his second appearance at the Sunrise and Tony Bennett, on March 18 for an exclusive appearance on the East Coast of Florida. On a daily basis offers and contracts continue to be negotiated with artists and their representatives for the 2011/12 Season. Memberships (both new and renewed) are continuing to come in at this time. Sales are up for this coming season with fewer shows on sale at this time than last year. Additional shows and events will be announced as they are confirmed. Assistance with future rental events and co-presentations continue with various community groups including, but not limited to, BlueBird Educational Productions' Nicole Henry on December 9, Faith Baptist School's Annual Christmas Program, Children's Services Council, The Pay It Forward program and Sunrise Theatre's partnership on a Community Toy Drive/Family Christmas Event on December 16, The Love Center on February 12, and a production of A Tribute to Benny Goodman in January with the Fort Pierce Jazz and Blues Society. Budget projections and adjustments for this and next year s fiscal continue to be reviewed and implemented.
