1 The Scotch Brand Most Gifted Wrapper Contest OFFICIAL RULES 1. NO PURCHASE NECESSARY. A purchase will not improve your chances of winning. This contest is sponsored by 3M ( Sponsor ). This contest begins at 10:00 AM Eastern Daylight Time (EDT) May 4, 2009, and ends at 11:59 PM Eastern Daylight Time (EDT) October 5, 2009 (the Contest Period ). 2. ELIGIBILITY: Nominators: To be eligible to nominate yourself or someone else, you must be age 21 or older, as of May 4, 2009, and a legal U.S. resident residing in one of the 48 contiguous United States. Nominees: To be eligible, nominees must be legal U.S. residents residing in one of the 48 contiguous United States, age 21 and older, as of October 5, Both professional gift wrappers (i.e.: Those who are currently employed as or have previously earned income as gift wrappers at department stores, specialty stores, etc.) and amateur gift wrappers (i.e.: Those with no employment experience as gift wrappers) are eligible to participate. Nominees who have never earned income as professional gift wrappers but have served as unpaid gift wrapping volunteers at shopping malls, charitable events, etc. are considered amateurs for this contest. Nominees who wrap or have wrapped gifts for an employer, but for whom gift-wrapping is not the nominees primary job responsibility, will be considered amateurs for this contest. Employees of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and the immediate family or household members of each are not eligible to participate as a nominator or nominee. All past contestants who competed in any of the previous Scotch Brand Most Gifted Wrapper Contests are not eligible to participate. Contestants must be able to travel to New York City for the Scotch Brand Most Gifted Wrapper Contest during the time period of December 3, 2009 through December 6, If an entrant is selected as a contestant and cannot travel during this time, he or she will be disqualified and an alternate contestant will be selected. 3. HOW TO ENTER: In 100 words or less, describe why you believe you or the individual you are nominating should participate in the gift wrapping contest to determine the Scotch Brand Most Gifted Wrapper. Also include the following: Page 1

2 Your name, company/place of employment (if applicable), home address, city, state, zip code, daytime telephone number, and if available, fax number and address. (This information will be used only as contact information with respect to this contest and to provide you with information about Sponsor products and in accordance with Sponsor s privacy policy found at Nominee's name, company(ies) in which the nominee has previously wrapped or is currently wrapping gifts (if applicable), home address, city, state, zip code, daytime telephone number, and, if available, fax number and address. (This information will be used only as contact information with respect to this contest and to provide you with information about Sponsor products and in accordance with Sponsor s privacy policy found at Please specify whether the nominee is a professional or an amateur gift wrapper. To qualify, mail entries must be postmarked no later than October 5, and fax entries must be received no later than October 5, All entries become Sponsor s property and will not be returned. Not responsible for lost, late, illegible, incomplete, misdirected, postage due, or mutilated mail or entries, or for errors, delays or failures in transmission of fax and entries. Submission of an entry grants Sponsor and its agents the right to publish, use, edit, adapt and/or modify such entry in any way, in any and all media, without limitation and without consideration to the entrant. Submission of an entry further constitutes the entrant s consent to irrevocably assign and transfer to Sponsor any and all rights, title and interest in and to the entry, including, without limitation, all copyrights. Contest void in Alaska and Hawaii and where prohibited. 4. JUDGING: Eight contestants four amateurs and four professionals, as defined in Section 2 of the Official Rules will be selected to participate in the Scotch Brand Most Gifted Wrapper Contest. These eight contestants will be selected no later than October 19, 2009 by an independent judge or panel of judges whose decisions are final. Entries will be judged on two criteria: (1) Page 2

3 persuasiveness of the recommendation, and (2) candidate s experience and creativity in wrapping gifts. The eight contestants will be notified via mail by (no later than) October 30, Each contestant must sign and return any required Affidavit of Eligibility/Release of Liability and Publicity form within five (5) days of delivery to such contestant s address as identified on the entry submitted by his/her nominator. Non-compliance within this time period will result in disqualification and an alternate contestant will be selected. Any contestant notification returned to Sponsor as undeliverable will result in disqualification and the naming of an alternate contestant. All contestants must be willing to make media appearances on behalf of 3M, Sponsor of the Scotch Brand Most Gifted Wrapper Contest, prior to, during and after the contest date. All contestants must agree to stay in the Sponsor s hotel of choice on the night before the scheduled contest (on or around December 3, 2009). The Scotch Brand Most Gifted Wrapper Contest will take place in New York City on or about Friday, December 4, Selection of one Grand Prize Winner will be determined by a panel of judges and announced at that time. The Grand Prize Winner also will be announced via a national press release after the selection. The contest consists of three rounds, with qualifying finalists in each round individually wrapping an identical item(s). Contestants will be judged on two criteria: (1) appearance of packages wrapped and (2) technique. In the event of a tie, speed will serve as the tie-breaker. All contestants will be using Scotch transparent tape and other Scotch brand products. Decisions of the judges are final in all matters relating to this contest. No substitution or transfer of prizes permitted. All federal, state, and local taxes on prizes are the sole responsibility of the contestants and Grand Prize Winner. All federal, state, and local laws and regulations apply. Acceptance of prizes offered constitutes permission to use each contestant s and the Grand Prize Winner's name and/or likeness in advertising and promotional activities without additional compensation. 5. PRIZES: One (1) Grand Prize: $10,000. Seven (7) Additional Contestant Prizes worth a total of $4,500: $2,500 for the first runner-up contestant. $500 for each of the two semi-finalists contestants. $250 each for the remaining four contestants. One (1) Nominator Prize: $1,000 is awarded to the person who nominated the Grand Prize Winner. If more than one person nominated the Grand Prize winner, the person who submitted the nomination the earliest (as determined by the time and date stamp on , fax or direct Page 3

4 mail entries) will be eligible to win the $1,000 nominator prize. Note: If the Grand Prize Winner is self-nominated, the $1,000 nominator prize will not be awarded. Eight (8) Contestant Prizes: a round trip coach class airline ticket for one to New York City on or about Thursday, December 3, 2009, to participate in the Scotch Brand Most Gifted Wrapper Contest, departing from the major commercial airport nearest the contestant s home and utilizing Sponsor's carrier of choice. Stopover trips are not allowed. Standard single room accommodations for 3 days/3 nights will be provided by Sponsor. The Sponsor will reimburse the contestant $200 towards purchasing meals while in New York City for the contest within thirty (30) days after receiving receipts documenting the amounts spent. Ground transportation to and from the contestant's home and the airport, to and from the airport and hotel, and from hotel back to the airport, will be the responsibility of the contestant, but The Sponsor will reimburse each contestant for the actual transportation costs incurred, not to exceed a total of $200, within thirty (30) days after receiving receipts documenting the amounts spent. All contestants must mail their receipts to Hunter Public Relations within thirty (30) days following the date of the contest to receive reimbursement of expenses. Transportation to the contest activities will be provided to each contestant. Contestants are responsible for any and all incidental expenses including, but not limited to, personal purchases. Total approximate value of each contestant prize package is $1,950 to $11,700 depending on the prize amount won. Total approximate prize value: $29,100 ($28,100 if the Grand Prize Winner and nominator are the same person). 6. GENERAL CONDITIONS: By participating in the contest, entrants agree (1) to be bound by and abide by these Official Rules and by all decisions of Sponsor, whose decisions are final and not subject to appeal; (2) on behalf of themselves, their executors, heirs and assigns, to release and hold Sponsor, Hunter Public Relations and its and their respective directors, officers, employees, subsidiaries, affiliates, agents, employees, suppliers, divisions, agencies, licensors and advertising, promotional, or judging agencies, and any all prize suppliers ( Released Parties ), harmless from any and all liability whatsoever for all losses arising out of participation in the contest and/or the acceptance, possession or use/misuse of any prize, and claims based on publicity rights, defamation, or invasion of privacy, whether suffered by entrant or a third party, or while preparing for, participating in or traveling to and/or from any prize-related activity or otherwise; and (3) that neither Sponsor, nor any of the foregoing entities, have made or are responsible or liable for any Page 4

5 warranty, express or implied, relative to a prize, including, but not limited to, its quality. Sponsor reserves the right, in its sole discretion, to suspend, modify or cancel the contest. Sponsor will not be liable for any cancellations, postponements or rescheduling of the contest due to any cause beyond its control, including, without limitation, strike, lockout, or other labor dispute, national emergency, war (whether or not declared), terrorist attack, communication line failures, power failures, fires, explosions, floods, accidents, epidemics, earthquakes or other natural or man-made disasters, and all occurrences similar to the foregoing or other acts of God. If the contest is cancelled for any reason, neither Sponsor nor any of the parties contributing to the contest, will be required to reschedule the contest and/or compensate any contestant for lost time, wages, fees, travel expenses or costs of any kind spent in preparation for such contestant's travel to, or arrival in, New York City. Without limiting the foregoing, if, for any reason, the contest cannot be run as originally planned, as the result of tampering or infection by computer virus or for any other reason, Sponsor, at its sole discretion, reserves the right to conduct the contest from among all eligible entries received, if any. Failure to comply with the Official Rules will result in disqualification. An entrant s entry will be disqualified, at the sole discretion of 3M, if he or she attempts (a) to enter the contest through any means other than described in these Official Rules; or (b) to disrupt the contest, circumvent the terms and conditions of these Official Rules, or in any way tamper with any component of the contest. Submission of an entry further constitutes the entrant s consent to irrevocably assign and transfer to 3M any and all rights, title and interest in and to the entry, including, without limitation, all copyrights, and upon 3M s request, entrants will execute any documents necessary to effectuate such ownership. 7.
