3 1. MINUTES SEPTEMBER 21, 2010 Recommendation by the Office of the City Clerk: Approve the September 21, 2010, City Council/Redevelopment Agency Minutes. 2. T-MOBILE USA, INC (TMO) TELECOMMUNICATION SITE LEASE AGREEMENT BASTANCHURY PARK 1717 W. BASTANCHURY ROAD Recommendation by the Engineering Department: 1. Authorize staff to enter into a lease agreement with TMO for the construction, operation, and maintenance of cellular facilities located at Bastanchury Park, subject to final plan approval. 2. Authorize the City Manager to execute the lease agreement on behalf of the City of Fullerton in a form approved by the City Attorney. 3. TRANSPORTATION CENTER PARKING EXPANSION CONSTRUCTION MANAGEMENT Recommendation by the Engineering Department: Authorize the Director of Engineering to execute an agreement with Griffin Structures, Incorporated, in the amount of $473, STATION AREA IMPROVEMENTS AT THE FULLERTON TRANSPORTATION CENTER AND PROPOSED PLUMMER PARKING STRUCTURE EXPANSION PROJECT Recommendation by the Redevelopment and Economic Development Department and Engineering Department: 1. Authorize staff to work with Orange County Transportation Authority (OCTA) to secure funding for station area improvements at the Fullerton Transportation Center (FTC) and expansion of the Plummer parking structure; 2. Request OCTA to submit necessary project amendment(s) to reallocate Proposition 116, or secure other non-federal funds for station area improvements at the FTC and expansion of the Plummer parking structure; 3. Authorize the City Manager or his designee to execute any necessary agreement(s) or documents on a form, or forms, to be approved by the City Attorney to implement the foregoing; October 5, 2010, Page 2

Determine that certain of the station area improvements (rail passenger patron amenities and information systems) were previously evaluated in the Initial Study/Mitigated Negative Declaration for the SOCO West Parking Structure (also known as the FTC Parking Structure Expansion Project) prepared pursuant to the California Environmental Quality Act (CEQA); 5. Determine that certain of the station area improvements (elevator improvements) are exempt from CEQA pursuant to CEQA Categorical Exemption Section 15301, Class 1, Existing Facilities); and 6. Determine that expansion of the Plummer parking structure is exempt from CEQA pursuant to CEQA Categorical Exemption Section 15332, Class 32 In-fill Development Project. 5. MINOR LANGUAGE CHANGES TO TOW GUIDELINES AND REQUIREMENTS Recommendation by the Office of the City Clerk: Approve the minor language deletions/additions to Resolution No , Towing Guidelines and Requirements. 6. CITY OF FULLERTON CONTINUITY OF OPERATIONS PLAN (COOP) Recommendation by the Fire Department: Adopt the COOP Plan in the format approved by the City Attorney. 7. RESOLUTION OF INTENTION TO CONSIDER A SPECIFIC PLAN, ZONING AMENDMENT AND GENERAL PLAN REVISION FOR THE FULLERTON TRANSPORTATION CENTER SPECIFIC PLAN (PRJ ) Recommendation by the Community Development Department: Adopt Resolution No RESOLUTION NO A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, DECLARING ITS INTENTION TO CONSIDER A ZONING AMENDMENT, GENERAL PLAN REVISION AND SPECIFIC PLAN DOCUMENT FOR APPROXIMATELY 39 ACRES AROUND THE FULLERTON TRANSPORTATION CENTER 8. Adopt Resolution No adopting the Mitigated Negative Declaration, Mitigation Measures and Mitigation Monitoring Program and approving a General Plan Revision to change the land use designation Medium Density Residential to Industrial ; 2. Have first reading by title only, introduce, and waive further reading of Ordinance No to amend the Zoning Classification Limited Density Multiple-Family Residential (R-3) to Manufacturing, General (M-G) ; 3. Adopt Resolution No approving the Conditional Use Permit and Major Site Plan. CONSIDER APPROVAL OF ISSUANCE OF 2010 TAXABLE TAX ALLOCATION HOUSING BONDS BY THE FULLERTON REDEVELOPMENT AGENCY IN THE AMOUNT NOT TO EXCEED $29,000,000 IN PRINCIPAL AMOUNT The purpose of this item is to request that the City Council/Agency approve the issuance of 2010 Taxable Tax Allocation Housing Bonds by the Agency in the amount not to exceed $29,000,000 in principal amount. Bond proceeds will be used by the Agency to increase, improve, and preserve the City s supply of affordable housing by assisting development of affordable housing in accordance with the City s General Plan Housing Element, Regional Housing Needs Allocation (RHNA) obligations, and Redevelopment Law. Recommendation by the Redevelopment and Economic Development Department: As the Agency: Adopt Resolution No. RDA 466 authorizing the issuance and sale of not to exceed $29,000,000 principal amount of taxable Tax Allocation Housing Bonds to assist development of qualified low-and moderate-income housing in the City of Fullerton, approving related documents and authorizing official actions. As the City Council: Adopt Resolution No approving the issuance by the Fullerton Redevelopment Agency of not to exceed $29,000,000 principal amount of taxable Tax Allocation Housing Bonds to assist development of qualified low- and moderate-income housing in the City of Fullerton. CONSIDER APPROVAL OF THE DRAFT NOTICE OF FUNDING AVAILABILITY FOR AFFORDABLE HOUSING FOR THE CITY OF FULLERTON AND AUTHORIZE TRANSMITTAL TO PRE-QUALIFIED AFFORDABLE HOUSING DEVELOPERS This item is to consider authorizing Agency staff to transmit the Notice of Funding Availability (NOFA) to all affordable housing developers that have pre-qualified with the Agency and solicit proposals from these developers for affordable housing projects. The purpose of the NOFA is to continue to increase, improve, and preserve the community s supply of affordable housing for extremely low, very-low, and low income households. Recommendation by the Redevelopment and Economic Development Department: Authorize staff to transmit the NOFA to all affordable housing developers included on the Agency s pre-qualified affordable housing developer list and solicit proposals for affordable housing projects. 17. EUCLID IMPROVEMENT ZONE Staff will present a status report on the progress of the Euclid Improvement Zone. Recommendation by the Community Development Department: Receive and file. 18. CONSTRUCTION AND DEMOLITION ORDINANCE MODIFICATION This item is a request to modify the Fullerton Municipal Code Chapter 5.16 Waste Reduction and Recycling Plan Requirements for Construction and Demolition Projects. LITTERING ORDINANCE During the recent revision to the Collection of Solid Waste portion of the Fullerton Municipal Code, the littering section was inadvertently removed. The Fullerton Police Department is now unable to issue citations to persons who litter in or upon any public alley, street or highway, or other public place in the City of Fullerton. Recommendation by the Police Department: Have first reading by title only, introduce, and waive further reading of Ordinance No prohibiting littering.
