Background: The Joe DiMaggio Playground ( Park ) is an approximately 110,000 square foot site with a children s play area, tennis courts, bocce courts, pool building and sport courts. It sits directly next to the newly constructed North Beach Branch Library. In October and November 2014, the Recreation and Park Commission passed two resolutions regarding the park: Grant Acceptance and Donor Recognition Plan Approval (October 2014) Award of Construction Contract to Bauman Landscape, Inc. (November 2014) As described in the staff reports, the Friends of Joe DiMaggio has been actively fundraising to provide the Recreation and Park Department (RPD) with a cash grant to fund eight additive alternates. The cost of all eight additive alternates is $496,265. To date, they have committed to granting the project $246,265. They continue to fundraise and will grant the project additional money when fundraising is complete. Simultaneously, RPD staff has applied for a larger grant through the Housing Related Park Program to fund the additive alternates and the construction contingency for the project. This grant will be awarded in June 2015 and will provide up to $900,00 for the project. The current construction contract and schedule requires RPD to notify the contractor in April 2015 if the additive alternates will be added to their contract, without adding significant cost or project delays. As such, RPD staff is requesting the use of the 2012 Bond reserve funds to fund

2 the remaining costs of the additive alternates and the construction contingency. When the grants are awarded, the project will reimburse the 2012 Bond program reserve with the awarded funds. Background Joe DiMaggio Playground ( Park ) is an approximately 110,000 square foot site with a children s play area, tennis courts, bocce courts, pool building and sport courts. It sits directly next to the newly constructed North Beach Branch Library. In November 2012, voters supported and passed the 2012 San Francisco Clean and Safe Neighborhood Parks Bond (2012 Bond) giving RPD an additional $195 million to continue capital projects for the renewal and repair of parks, recreation, and open space assets. The 2012 Bond allocated $5.5 million for the Park for the reorganization and renovation of the children s play area, tennis courts, paved play areas and pathways, access improvements, and related amenities, landscaping and seating improvements to the open space adjacent to the North Beach Branch Library. The Friends of Joe DiMaggio Playground ( the Friends ) is a non-profit organization made up of North Beach residents who use and care about the playground. The Friends have a long history of supporting and collaborating with the Recreation and Park Department on Park projects and are very committed to assisting in maintaining and growing the Park through active participation in special events and fundraising. The Friends believe that: the Joe DiMaggio Playground is an important resource that must be protected and optimized. 1

4 the playground, pool and library form an important neighborhood nexus. the playground must be designed for all ages and ability levels and encourage varied uses. the playground should offer an experience unique and appropriate to our area. our neighborhood needs more green. The San Francisco Parks Alliance ( SFPA ) is a California non-profit public benefit corporation which provides fiscal sponsorship to the Friends. Conceptual Plan On April 25, 2011, the Recreation and Park Commission approved the master plan for the North Beach Library & Joe Di Maggio Playground; Resolution number The goals of the master plan include increasing open space to the North Beach and Chinatown communities, expanding and improving the children s play area with new safety and ADA requirements, and adding landscaping and seating throughout the park. Furthermore, park safety will be increased by reorganizing the site s programmed activities and increasing the internal connections within the park. The plan also transforms one block of Mason Street from a street with vehicular traffic into a public park space. The master plan is included as Exhibit A. Fundraising Campaign SFPA, on behalf of the Friends, intend to provide RPD with a cash grant of up to $500,000.00, for the Project, over the next 5-10 months. The goal is to enhance the construction base budget to fund eight additive alternates, as shown in Exhibit B. The Friends goal is to ensure that the Park is ready for use by neighbors of all ages and ready for the next 100 years. They strongly believe that the cash grant will provide the necessary funding for the finishing touches that will make the park really lovely and special. The Friends, RPD, and SFPA agree that the Grant shall be used to fund the eight additional alternatives, starting with item #1, then #2, then #3, and so on until all eights items are funded or until the total amount of the grant has been expended, as shown in Exhibit B. Donor Recognition and Appreciation The Friends are proposing to recognize donors on tiles which will encircle the Joe DiMaggio Playground on the outside perimeter seat wall along Greenwich, Powell, and Lombard Streets for approximately 700 linear feet. This tile wall will be referred to as The band of North Beach Legacy Tiles. The North Beach Legacy Tile donor recognition plan has seven options for donors to select from, so that donors have choice in how they would like to be recognized, and so that that tile wall has a consistent and artistic style. The proposal includes two size tiles, with different text styles, as outlined below and as shown in Exhibit C. 2

Cash Grant. In support of the Project, SFPA shall donate to the City up to $500, for construction of the Project as set forth in the Conceptual Plan. The Grant shall be used to fund the eight additional alternatives, starting with item #1, then #2, then #3, and so on until all eights items are funded or until the total amount of the grant has been expended. 2. Schedule. SFPA shall award the Grant on or before February 10, 2015, and no later than May 1, It may be awarded in two installments during this time period. 3. Funding. Neither SFPA nor RPD shall be obligated to fund any funding shortfall pursuant to this Commission item or any other document or agreement unless such party expressly so agrees in writing. 4. Public Relations. RPD shall be the lead on all media coordination for the Project. Each party will identify a designated point of contact for media inquiries. SFPA and the Friends shall notify RPD s contact of any and all media inquiries prior to responding to such inquiries, and shall provide RPD the opportunity to review and approve such responses before they are issued. SFPA and the Friends shall also provide RPD the opportunity to review and approve any press releases or media statements on the Project before issuance. Staff Recommendation RESOLVED that this Commission does 1) approve a donor recognition plan for the renovation of Joe DiMaggio Playground ( Project ); and 2) recommend that the Board of Supervisors accept and expend a cash grant, from the San Francisco Parks Alliance ( SFPA ), in the amount of up to $500, for additive alternates to the Project s construction budget ( Grant ). 12 Award of Construction Contract: In July 2014, the Recreation and Parks Department and Department of Public Works advertised a bid package for competitive bids. The bid package included base bid items plus eight additive alternate items that will be funded by donations. No additive alternates are awarded at this time. Three bids were received, ranging from $4,397, to $5,052, The lowest bid is 3% lower than the engineer s estimate of $4,533, It is anticipated that construction will begin January The construction contract calls for 300 days from Notice to Proceed to Substantial Completion. Staff expects the renovated Joe DiMaggio Playground to open Fall Program Reserve Funds: Additional costs are required to fund unforeseen conditions that have been uncovered at the site. The project s Environmental Impact Report included a list of Environmental Mitigation Measures that are required during project planning and construction. The project is also affected by the Maher Ordinance, requiring similar measures. Specifically, the environmental mitigation measures require the collection and testing of soil and groundwater samples from areas beneath the children s playground. This testing was required prior to the start of work and must continue during construction when the contractor is pier drilling. The project scope of work includes the remediation, offhaul and disposal of the contaminated and hazardous soils found during this sampling. The original project budget did not account for these hazardous materials. The approximate costs of this are: Professional Services during Project Planning: $35,000 Construction Costs: $500,000 Environmental Oversight during Construction: $175,000 Reserve: $90,000 Total Request: $800,000 The revised project budget is: Current Budget: $5,500,000 Additional Request: $800,000 New Total Budget: $6,300,000 Recommendation: That the Recreation and Park Commission adopt a resolution to (1) award a construction contract in the amount of $4,397,000 to Bauman Landscape and Construction, Inc. for the Project; and (2) approve the use of the program reserve funds from the 2012 Clean and Safe Neighborhood Parks Bond to supplement the Project budget by $800,000.
