3 The Review & Approval Process Contained within this package is information that should help you complete your permit application form for development within a regulated area, interference with a wetland or an alteration to a watercourse or shoreline under Ontario Regulation 167/06. We strongly recommend that you begin this process by consulting with staff at the Otonabee Region Conservation Authority (ORCA) to discuss your proposal and any additional information that may be required to review your application. ORCA staff can be reached at (705) In most cases, pre-consultation will involve only youself - the applicant - and ORCA staff. For more complex proposals it may involve: the applicant, the applicant s agent or consultant, ORCA staff, municipal staff, provincial agency staff (MNR, MOE, etc.), federal agency staff (Parks Canada, etc.) or others. During pre-consultation, ORCA staff can advise of the permit fees that will apply. Either at or following your pre-consultation meeting, you will be given a form that summarizes ORCA s comments on your proposal and provided a checklist of information required to support any forthcoming application(s). If you decide to proceed, you are required to complete and submit to ORCA a Permit Application form. A copy of the Permit Application is contained within this package but is also available at the ORCA office, by , facsimile or from the ORCA website When reviewing applications ORCA is guided by the following principles: ORCA is committed to reviewing all permit applications in an efficient and effective manner; ORCA is committed to ensuring that the permitting process is aligned with the approval process under the Planning Act; and, ORCA is committed to working with applicants to be certain that the process is easy to understand. Once an application is received and determined to be complete, ORCA is required to make a decision (e.g. recommendation to approve and issue a permit or deny the application) within 30 days for a minor application and 90 days for a major application. An application is considered major if it is highly complex, requires a full technical review, needs to be supported by comprehensive analysis or does not conform to policies contained with ORCA s Watershed Planning and Regulation Policy Manual. A diagram illustrating how ORCA staff process standard applications under Ontario Regulation 167/06 is provided on the next page. 6 Terms and Conditions Permits or Approvals granted by the Otonabee Region Conservation Authority (ORCA) are non-transferable and are valid for a period of two years from the date of issuance. Permits, approvals, etc. may be required from other agencies prior to undertaking the proposed work. Authority permission, if granted for the proposed work, does not exempt the owner/agent from complying with any or all other laws, statutes, ordinances, directives, regulations, approvals, etc. that may affect the property or the use of same. If information provided on or with this application is determined to be untrue or incorrect, or becomes untrue or incorrect, ORCA reserves the right to withdraw any permission granted. Permits contain important conditions. A copy of the permit must be on the work site at all times. Further information and studies may be required by ORCA in order to process this application, the costs of which will be borne by the owner or their authorized agent/applicant. This information may include details related to wetlands, floodplains, hydraulics, slope stability or stream systems. Once submitted, all studies become the property of ORCA and the information may be used by ORCA, its member municipalities and partners. In order for members of the public to view any studies, plans and reports related to your permit, a formal request under the Municipal Freedom of Information Protection and Privacy Act, RSO 1990, c. M. 56, is required. Access is subject to statutory exemptions. The same is true should you wish to access any studies, plans and reports pertaining to other s permits. Insufficient information may delay the processing of your application. Fees subject to change without notice. 8 Preparing Your Site Plan & Cross-Section The following information is provided as a guide only. Pre-consultation with ORCA staff is strongly recommended prior to submitting a permit application. Four (4) copies of all drawings are required and must be folded to 8 ½ x 11 or 14. Structures (New or altered) Identify elevation (in metres geodetic) of the lowest opening (e.g. window, door sill) of the proposed structure or the elevation change from the lowest opening to the current water level (shoreline properties only). Dimensions of any proposed structure. Location of any existing structures. Distances from at least two property boundaries and other natural features (e.g. watercourse). Cross-section of the proposed structure showing existing grade and finished grade. Fill Placement Location of all areas of proposed fill placement and/or removal and the limits of disturbance. Dimensions of the proposed fill area and the depth of fill required. Description of proposed fill (e.g. crushed stone). Cross-section of the proposed fill area showing depth(s), side slopes, before and after elevations. Driveway or Road Construction Distances from at least two property boundaries or other natural features (e.g. watercourse) Description of proposed material (e.g. crushed stone). If proposed construction is not at grade, show proposed depth and limits of fill. Location, length, diameter, type and pipe invert for any proposed culvert(s). Natural Feature Identification Location of any watercourses, ditches, drainage features, wetlands, forested areas or any steep slopes. Erosion Control Measures Location and type of measures proposed, installation details and site re-vegetation plan. Additional information that may be required to process a permit application includes but is not limited to: Copy of a legal survey of the property; Professionally prepared topographic survey, Lot Grading/Drainage Plan; Flood Plain Analysis/Delineation Study, Hydrology/Hydraulic Analysis; Environmental Impact Study, Planting or Vegetation Plan or Tree Retention Plan; Hydrogeological Analysis, Fluvial Geomorphological Assessment, Meander Belt Allowance Assessment; Stormwater Management Plan or Sediment and Erosion Control Plan; and/or, Slope Stability/Erosion Study. 6 of 10

12 THE FINE PRINT Minor An application is determined to be Minor where there is low risk of impact on a natural hazard or natural features and no technical letters or studies are required. Intermediate An application is determined to be Intermediate where there is moderate risk of impact on natural hazards or natural features and/or the review of a single technical report/plan (e.g. Environmental Impact Study, Floodplain Analysis, Stormwater Management Plan) is required. Major An application is determined to be Major where risk to natural hazard and natural features is high and/or the review of 2 or more technical reports/plans (e.g., Environmental Impact Study, Floodplain Analysis, Stormwater Management Plan) is required. 1. Applicants and/or municipalities are encouraged to consult with staff prior to submission of all applications to determine the extent and nature of information required to accompany the application, and to determine the appropriate fee. 2. Application fees must be paid at the time of filing an application. A permit will not be issued unless the application fee has been submitted. 3. ORCA reserves the right to modify or adjust fees should the review require a substantially greater or lower level of review and/or assessment. 4. Where an application is made and determined not to be subject to Ontario Regulation 167/06, the application fee will be refunded less a $100 administrative fee. 5. Permits are generally granted for two years. Permit extensions or renewals will not be granted. Applicants may re-apply for the reissuance of a new permit for the original approved works in accordance with most recent technical requirements and legislation. 6. Projects with multiple components will be subject to only the higher of the application fees, not the aggregated amount. 7. Fees for applications requiring technical review are based on the initial submission and two resubmissions. Submissions beyond those three will be reviewed and charged at the hourly technical review rate. 8. ORCA reserves the right to increase fees without notice to address year to year increases that may occur from inflationary increases in operating costs. 9. Peer review fees will be recovered when a report contains information that is beyond the scope of ORCA s inhouse expertise OR come to a third-party resolution where there is conflict. 10. A File Reactivation fee is charged for applications that have been dormant for over one year. 11. All studies submitted to ORCA for review become the property of the Authority and the information may be used by ORCA and its member municipalities.
