5 Taiharuru: Findings on Crown breaches Prioritised political objective of concluding Treaty settlements over a process that was fair to Whakatōhea. Failed to ensure member register was accurate and appropriate before mandate vote was taken. Not sufficiently informed of the true levels of support and opposition to the Pre-settlement Trust mandate. 5

6 Taiharuru: Crown breaches Failed to ensure an adequate way to vote on a hapū basis. Approved a mandate that contains a withdrawal mechanism it acknowledges to be unfair. Should not have included the Mokomoko whānau claim without consent and without honouring commitments previously made. Incorrectly included and described the Te Kahika claimants. 6

7 Tērā Whānui: Recommendations That substantive work on the Whakatōhea negotiations be suspended until completion of independent voting process. Whakatōhea hapū should have opportunity to decide how to proceed in more transparent way. 7

8 Tērā Whānui: Recommendations All adult members vote on: 1. Do you support the Trust continuing to negotiate to reach a settlement with the Crown of the historical Treaty grievances of Whakatōhea? If no to question 1: 2. Do you wish to see the current Treaty negotiations stopped so: a. That a mandate process be re-run from the start? OR b. That the Waitangi Tribunal can carry out an inquiry into the historical grievances of Whakatōhea? 8

11 Response to the Recommendation Whakatōhea hapū should have opportunity to decide how to proceed in more transparent way. WPSCT proposed a voting process to test the pulse of the people and reconfirm support amongst all our hapū. This approach is supported by the Crown. 11

15 Crown Response to Recommendation That substantive work on the Whakatōhea negotiations be suspended until completion of independent voting process. Minister has agreed that the Crown should not advance negotiations while the vote is underway, but that technical work within the scope of the AIP could continue. The Crown will also continue to communicate with Whakatohea Presettlement Claims Trust on matters relating to the voting process. 15
