1 LIVONIA PUBLIC SCHOOLS FARMINGTON ROAD LIVONIA, MI (734) The Livonia Public Schools Board of Education, Livonia, Michigan, hereby invites the submission of sealed bids for the purchase of: WASTE REMOVAL for the School Year Sealed bids will be received until 12:30 P.M. on the 14th day of May, 2014 in the Operations/Purchasing Department at the Board of Education complex, Farmington Road, Livonia, Michigan, at which time; all bids will be publicly opened and read. Mailed bids should be sent to the attention of Nick Armelagos, Administrator of Finance, Livonia Public Schools, Farmington Road, Livonia, Michigan, No bids will be accepted after the date and time specified. Oral, telephone, fax, or electronic mail bids are invalid and will not receive consideration. All vendors are invited to attend opening. The Board of Education reserves the right to accept or reject any or all bids, either in whole or in part: to award to other than the low bidder: to waive any irregularities and/or informalities: and in general to make awards in any manner deemed to be in the best interests of the district, including awarding by line item, with rationale to support such a decision. All bids must be accompanied by a sworn and notarized statement of disclosing any familial relationship that exists between the owner or any employee of the bidder and any member of the Board, Wayne RESA Board or the Superintendent of the Livonia Public Schools or the Superintendent of Wayne RESA, An affidavit of compliance- Iran Economics Sanctions act of 2012 and an Equal Opportunity Employer Statement. No bid shall be accepted that does not include these sworn and notarized disclosure statements. All bids must be accompanied by a sworn and notarized statement certifying that the Contractor is not an Iran Linked Business within the meaning of the Iran Economic Sanctions Act of No bid shall be accepted that does not include this sworn and notarized disclosure statement. 7 INVITATION TO BID LIVONIA PUBLIC SCHOOLS Farmington Road Livonia, MI Livonia Public Schools will accept bids for solid waste removal as described in the following specifications: 1. Contractor shall place state and federally approved covered front end loading refuse containers at each location and / or site. 2. Contractor shall provide appropriate documents of insurance coverage pertaining to vehicles, property damage and public liabilities, personal injury, etc., and shall hold the district harmless in any incident involving the contractor, his employees, his equipment and vehicles. 3. Contractor will be held responsible for the care and maintenance of all containers under this contract and shall replace any containers, which are, or become unfit for storage and for protection against vermin. 4. Contractor bidding on the trash and refuse services to Livonia Public Schools will be expected to familiarize themselves with the container location and with the access to the area of each site. 5. Refuse picked up by the contractor under the terms of this contract will be disposed of in a stateapproved landfill. 6. All equipment, transportation, disposal fees and other pertinent expenses necessary for the proper execution of this contract are the responsibility of the contractor and are to be included and considered part of the bid price. 7. Contractor shall submit one, two and three year contract proposals (See Bid Form). The Board of Education reserves the right to accept only a one (1) year contract. 8. Livonia Public Schools reserves the right to terminate the contract at any time because of the contractors failure to comply with the terms and conditions of the contract. 9. The successful bidder may be required to submit a performance bond in the amount of one (1) years contract, to protect the Livonia Public Schools against any expenses which may be incurred by the school district because of the contractors failure to live up to the terms specified herein. 10. Contractors bidding on the trash and refuse service to Livonia Public Schools will be expected to visit each building or site to as to familiarize themselves with the container location and access to the area(s). City ordinance is no pickups before 7:00 a.m. or after 11:00 p.m. 11. Successful Bidders: Must be licensed by Wayne County and the City of Livonia, City of Westland (if required). To be insured. (TAXES) The successful contractor within this context is considered to be providing a service in which the contractor is the consumer of all equipment, supplies and materials used in providing this service. The contractor must pay tax on all equipment, supplies and materials used. When it comes to the affixation of materials to real property or the purchasing of services from a contractor, the school district s exemption does not flow through to the contractor who is the consumer of material for tax purposes. Any questions regarding this issue of tax, please contact the Michigan Department of the Treasury at *Bid Guarantee Type Amount (5% Bid Bond or Certified Check) *A bid bond must be executed by a surety licensed to do business in Michigan. In the event of failure by the undersigned bidder to perform within the time stated in the schedule or purchase order, as the case may be, the bid deposit or bid bond submitted with this bid, or so much Page 8

9 thereof as shall be applicable to the unfilled amount of the award made to the undersigned, shall be retained by the Board of Education. The undersigned shall also be liable for, and agrees to pay to the Board of Education on demand, the difference between the price or prices bid and the price or prices for which such items shall be subsequently purchased less the amount of the bid deposit retained by the Board. No pleas of mistake in such accepted bid shall be available to the undersigned bidder and no bid may be withdrawn before the expiration of thirty (30) days from the date of submission thereof.
