Brust SUBJECT: ANNUAL JOINT OPERATING AND FINANCIAL PLAN BETWEEN THE CITY OF ENCINITAS AND THE COUNTY OF SAN DIEGO DEPARTMENT OF ANIMAL SERVICES RECOMMENDED ACTION: That the City Council Authorize the City Manager to Execute the FY Annual Joint Operating and Financial Plan with the County of San Diego Department of Animal Services. STRATEGIC PLAN: This item applies to the Public Safety focus area of the strategic plan, to create a safe and secure environment for citizens and businesses throughout the City. FISCAL CONSIDERATIONS: There are no additional fiscal considerations associated with this request. Funding for animal control related service in the amount of $375,199 is included in the FY budget. Summary of Cost History: Fiscal Year Net Cost FY $292,907 FY $325,867 FY $329,131 FY $363,394 FY $375,199 BACKGROUND: In January 2013, the City Council authorized a five-year agreement with the County of San Diego Department of Animal Services (DAS) for the provision of animal-related law enforcement Item 8C 1 of 19

2 in the City (Attachment A). That agreement expires on June 30, 2018 and may be extended beyond that date, upon mutual agreement. Each new fiscal year, the City and DAS execute an annual joint operating and financial plan as part of the agreement. On May 7, 2016, the City received the FY Annual Joint Operating and Financial Plan (Attachment B) from DAS for execution by the City Manager. ANALYSIS: DAS provides animal-related law enforcement, sheltering, medical and pet adoption services for the unincorporated areas of the County, and for the cities of Carlsbad, Del Mar, Encinitas, San Diego, Santee, and Solana Beach. Other cities, such as Oceanside and Escondido, that do not contract with DAS, either maintain their own shelter and enforcement agencies or contract with a local humane society for services. Per Chapter 7.18 of the Encinitas Municipal Code (Purchasing & Contracts) and the City s Purchasing Policy (PC01), authority to award contracts and authorize services with an estimated value of over $100,000 requires City Council approval. The FY Annual Joint Operating and Financial Plan with the DAS is in excess of this amount and therefore requires City Council authorization. ENVIRONMENTAL CONSIDERATIONS: The action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because it is not a project under Section 15378(b)(5) of CEQA Guidelines. The action involves an organizational or administrative activity of government that will not result in the direct or indirect physical change in the environment. 19 Attachment B City of Encinitas Contract Animal Control Services Program Joint Operating and Financial Plan Fiscal Year This Joint Operating and Financial Plan made and agreed to for the period beginning July 1, 2016 and ending June 30, 2017, by and between the City of Encinitas and the County of San Diego shall become a part of the Agreement between said parties. The County of San Diego shall provide animal control services to the City of Encinitas as specified in Section 3 through 5 of the Agreement. The gross cost of providing animal control services to Encinitas for fiscal year shall be $478,994. The County shall collect license and other fees, as specified under the County's Animal Services Fee Resolution within City of Encinitas. For fiscal year , the estimated revenue amount to be collected within City of Encinitas is $108,100. After deducting estimated revenues from gross cost, the City of Encinitas shall pay County the net amount of $375,199, which included the amount of $4, to finance the spay/neuter program as provided for in Sections 6 and 8 of the Agreement. The City of Encinitas shall pay County in quarterly payments as specified in Section 6, paragraph 5 of the Agreement.
