Matters involving not just litigation in aid of discovery in arbitration but also complex cases, parts of which may or may not be arbitrable and/or litigable, present a host of strategic considerations, as do private dispute resolution proceedings not denominated in contracts as arbitration but bearing some but not all of the hallmarks of arbitration and, therefore, complicating review by vacatur under federal and state arbitration acts. Two of the program participants, drawing from their experiences with recent sports litigation controversies, and a retired Court of Special Appeals judge, whose cases often involved aspects of arbitration, will discuss and debate such issues they have encountered in the interplay of litigation and arbitration in legal disputes. Maryland is one of two states that has not adopted a modification of the Canons of Professional Ethics to permit an attorney to advertise that they have received board certification in a given area of law. The Rules Committee has prepared an amendment to the existing rule but many open questions remain. (When Platt presented the bill to the putative defendant s insurance carrier, the claims adjuster laughed at Dr. Grossman s diagnosis of Schmartypants Syndrome. ) Prior to settlement, Attorney Platt s client discovered that Dr. Grossman apparently is the only graduate of the La Salle Matchbook Institute of Road Town, BVI (which is located above a well-known bar.). At the time of settlement, the client instructed Platt that under no circumstances was he to pay that quack doctor. But according to Visa, 85% of data breaches occur at small businesses, many involving insiders. Small businesses process financial transactions, maintain databases of social security numbers or medical records, and have other valuable data cyber thieves would love to steal. Why attack a large corporation when you can attack a non-profit, small business, or even a law firm representing these types of entities? And what if an employee leaves an unencrypted laptop at Starbucks? As more businesses, including law firms, store more information about individuals and move to decentralized storage such as Cloud Systems, the challenge of stopping hackers grows more important. Lawyers need to know best practices for data protection and what the law requires in response to the alarm: we ve been hacked!
