2 9. DOCKET PROCEDURES: Attorneys are encouraged to pre-set both civil and criminal cases. All hearings must be scheduled in advance, except in emergency situations. To set a case for trial in a civil matter, the attorney should call the assigned judge s secretary. Prior to setting the date, the attorney should clear available dates with other attorneys in the case. Trial dates run approximately two to three months in advance. Criminal matters are generally pre-set in the Commonwealth s Attorney s office by order endorsed by defense counsel. As an alternative to calling the judge s secretary in civil cases or Commonwealth s Attorney in criminal cases, attorneys may attend docket call to schedule a trial date. Docket call and Grand Jury are held on the 3 rd Tuesday in January, and the 3 rd Monday in March, May, July, September, and November. Criminal cases are set at 9:30 a.m. Juvenile appeals are set at 2:00 p.m. and all other civil cases are set at 2:30 p.m. When setting a case for trial, the attorney should know the case number, style of case, and whether a jury is requested. Trial dates for civil cases may be set by either lawyer, as long as they have dates/avoid dates for the other side. Note: When scheduling civil cases by phone or at docket call, a confirmation letter must be mailed to all parties within 10 business days of scheduling, with a copy to the Court. The confirmation letter must state the trial date, time and whether trial will be by jury or non-jury. In criminal cases not pre-set with the Commonwealth s Attorney s Office, defense counsel must appear for docket call. In criminal cases not pre-set, defendants out on bail are also required to attend docket call with their attorney. Information Concerning Continuances: Continuances are granted according to the Rule 8:14 (a) of the new Rules for Juvenile and Domestic Relations Courts and local order which designates the Clerk to grant continuances in most pending cases where all parties agree to the continuance. Upon entry of a pretrial meeting/discovery order in contested civil cases, the Clerk s authority to continue cases is removed. Continuances by letter on the date of court will generally not be granted. Cases to be Held : Cases are limited to a fifteen minute rule hearing. If the hearing will take more than fifteen minutes, it should be set for a contested date. General Comments: Judges sensitive to accommodating public, police force, witnesses. Therefore, burden of continuance on attorney as well as burden of notifying all parties.
