1 UNIVERSITY OF MINNESOTA VOLUNTEER COACH MEMO OF AGREEMENT Office of Athletic Compliance VOLUNTEER COACH: This form, to be completed and signed by you, details your agreement to be a volunteer coach at the University of Minnesota. NCAA Bylaw Coach, Volunteer. In sports other than football and basketball, a volunteer coach is any coach who does not receive compensation or remuneration from the institution s athletics department or any organization funded in whole or in part by the athletics department or that is involved primarily in the promotion of the institution s athletic program (e.g., booster club, athletics foundation association). The following provisions shall apply: (a) The individual is prohibited from contacting and evaluating prospective student-athletes off campus or from scouting opponents off campus and may not perform recruiting coordinator functions. (see bylaw ) (b) The individual may receive a maximum of two complimentary tickets to home athletics contests in the coach s sport. (c) The individual may receive complimentary meals incidental to organized team activities (e.g., pre- or postgame meals, occasional meal, but not training table meals) or meals provided during a prospective student-athlete s official visit, provided the individual dines with the prospective student-athlete. Any athletically related activities involving prospects (9-12 grade) must be cleared by the Compliance Office before the activity takes place. Dining with Prospects Volunteer coaches may dine with prospects on or off-campus during his or her official visit; however, during an unofficial visit a volunteer coach may only dine with the prospect on-campus. Please check with compliance for a list of permissible on-campus restaurants. Recruiting Roles Volunteer coaches may not recruit prospective-student athletes. This includes evaluating prospects, having off-campus contact with prospects and making telephone calls to prospects unless the call is made for one of the circumstances under bylaw However, volunteer coaches may conduct campus tours, provide transportation for official and unofficial visits, have face-to-face contact with prospects who are on campus and send out general correspondence to of age prospective student-athletes. Institutional Camps It is permissible to be paid to work at an institutional camp as long as you are paid the going rate for work actually performed and are not compensated merely for any value added because of your reputation. Non-institutional Camps Volunteer coaches may work at non-institutional camps as long as the camps meets all requirements of an institutional camp from bylaw Additionally, it is impressible to promote a noninstitutional camp by producing or positing promotional materials. However, it is permissible to include information regarding the camp or clinic, which the coach is employed at in general or electronic correspondence. There is paperwork that must be filled out before working a camp, which may be found on our website. Local Club Team - Volunteer coaches may work with a club team located in the institution s home community in any capacity as long as all of the participants live within a 50 mile radius of the institution. Always check with compliance before working at a non-institutional camp or with a local club team as some sports have different or stricter rules. Pg. 1 of 2

3 DOCUMENT INFORMATION AND INSTRUCTIONS Form Ref: Description: OGC-SC214 Volunteer Agreement and Release GENERAL GUIDELINES FOR ESTABLISHING VOLUNTEER RELATIONSHIPS The talent and services of volunteers are important to the University in accomplishing its mission of research, education, and outreach. Although volunteers are not employees of the University, like with employees, it is important to establish standards and guidelines for volunteer services so that both the volunteer and the University understand the parameters of the volunteer relationship up front. To assist University departments in establishing volunteer relationships, the Office of the General Counsel has developed the following checklist. A University department should use either the Volunteer Agreement and Release or the Volunteer Researcher Agreement and Release, as appropriate to the nature of the volunteer activities. If you have any questions about establishing volunteer relationships, please consult an attorney with the Office of the General Counsel. This information is intended as general guidelines. 1. At the beginning of the volunteer relationship, an appropriate departmental administrator should complete the Volunteer Agreement and Release or Volunteer Researcher Agreement and Release. These volunteer agreements should specifically include: a. The name of the volunteer and the name of the University department; b. A schedule of the days of the week and times it is anticipated that the volunteer will be performing services for the University or a listing of the hours per week the volunteer will be serving; c. The name(s) of staff who will oversee the volunteer's service; and d. A listing of the specific services the volunteer will be performing for the University. 2. After the specific information is added to the appropriate Volunteer Agreement and Release, it should be signed by the volunteer and then the Department Head or Director. A copy of the fully executed Volunteer Agreement and Release or the Volunteer Researcher Agreement and Release should be given to the volunteer and the original should be kept in a departmental file. 3. At the time of signing the Volunteer Agreement and Release or the Volunteer Researcher Agreement and Release, the volunteer should be given a copy of the most current version of the brochure entitled "Equal Opportunity and Affirmative Action at the University of Minnesota," which details the University's equal opportunity policies. 4. If the Volunteer is not a citizen or permanent resident of the United States, the Volunteer must provide documentation of visa status. Individuals on temporary visas may not serve as volunteers in positions where others receive compensation to perform the same services. Individuals with a pending H-1B visa application to work at the University of Minnesota CANNOT SERVE AS VOLUNTEERS. Form : Revision : I-1

4 VOLUNTEER AGREEMENT AND RELEASE The Regents of the University of Minnesota (the "University") and (the "Volunteer") agree that in exchange for the opportunity to volunteer in the Department of Athletics, the following terms shall apply: 1. This volunteer assignment begins, and is expected to continue through 2017_2018 Academic Year. The Volunteer's expected schedule is as follows: As determined by the Either party, however, may terminate this agreement at any time for any reason upon immediate notice, oral or written, to the other party. 2. The Volunteer will perform services under the direction and control of the following University staff:. The Volunteer will perform the following services: Duties assigned by and permitted by NCAA, Conference and University policies and rules. The Volunteer agrees to follow the directions of the staff and to abide by University policies and procedures while carrying out these volunteer services. The Volunteer acknowledges receipt of the University's equal opportunity policies when signing this Agreement. 3. The Volunteer is not an employee of the University and is not entitled to receive salary, benefits or other compensation. The Volunteer understands that he/she does not qualify for workers' compensation benefits and is expected to carry personal medical insurance to cover medical expenses for any injuries he/she incurs while performing volunteer services. 4. Pursuant to the terms of the Regents' Policy regarding legal defense and indemnification, the Volunteer may be eligible for legal defense and indemnification by the University if someone outside the University brings a claim against the Volunteer based on services performed by the Volunteer in good faith as part of his/her University responsibilities. 5. To the extent Volunteer is not a citizen or permanent resident of the United States, Volunteer certifies that he/she has an appropriate visa status that authorizes the Volunteer to be present in the United States and allows Volunteer to participate in this volunteer experience. 6. The parties agree that this is the entire agreement, and no agreement, oral or written, exists outside of this agreement. Form : Revision :

5 RELEASE Volunteer releases the University and its officers, employees, agents, and representatives from any responsibility or liability for personal injury, including death, and damage to or loss of property, that Volunteer may incur due to the negligence of the University, its officers, employees, agents, and representatives or others due to accidental occurrences while visiting the University or otherwise engaging in activities pursuant to the Agreement.
